CHAPTER 1254

R-4 One and Two-Family Residential Districts

1254.01 SIZE.

   An R-4 One and Two-Family Residential District shall contain a minimum of ten acres.

1254.02 INTENT; DENSITY; UTILITIES.

   The intent of R-4 One and Two-Family Residential Districts is to maintain the integrity of established neighborhoods where one and two-family dwelling units are the predominant housing forms. Residential uses shall not exceed four dwelling units per gross acre. Centralized water and sewer facilities are required.

1254.03 PERMITTED USES.

   The following uses are permitted in an R-4 One and Two-Family Residential District:
   (a)   Single-family detached dwellings;
   (b)   Churches and other places of worship, not including funeral chapels or mortuary chapels, and schools and institutions for academic instruction; and
   (c)   Public parks and recreation sites.

1254.04 CONDITIONAL USES.

   The following uses are permitted in an R-4 One and Two-Family Residential District only if expressly authorized by Council in accordance with Chapter 1284 and subject to limitations and restrictions deemed necessary by the Planning Board and/or Council:
   (a)   Two-family dwellings, as regulated by the Board in accordance with Section 1280.02;
   (b)   Private, noncommercial recreation areas and facilities such as recreation clubs, golf courses and country clubs;
   (c)   Structures and installations which are necessary public facilities and utilities and which require location in an R-4 District;
   (d)   Cemeteries;
   (e)   Home occupations, as regulated by Section 1280.27;
   (f)   State Highway Patrol outposts.
   (g)   Community gardens.

1254.05 PROHIBITED USES.

   No building or other structure in the R-4 One and Two-Family Residential District shall be used by a commercial or industrial establishment.

1254.06 ACCESSORY BUILDINGS AND USES.

   An accessory use or building or other structure customary and incidental to a use permitted in this chapter is permitted in an R-4 One and Two-Family Residential District, provided that such accessory use or building or other structure does not involve any type of business, trade, manufacturing or industry.

1254.07 LOTS.

   Zoning lots not less than 10,000 square feet per dwelling unit are permitted in an R-4 One and Two-Family Residential District. No lot in such a District shall have a width less than seventy feet. Such lots are permitted only if they are serviced by group or central sewage treatment.

1254.08 YARDS.

   Yard requirements for an R-4 One and Two-Family Residential District are as follows:
   (a)   Front. There shall be a minimum depth of twenty-five feet for the principal structure, but will allow front porch projection of not more than ten feet. Such front porch projections shall require the porch to be permanently attached to the principal structure.
   (b)   Side. There shall be a minimum width on either side of five feet, with the combined width of both side yards not less than fifteen feet.
   (c)   Rear. There shall be a minimum depth of forty feet.

1254.09 COVERAGE OF LOT BY BUILDINGS.

   In an R-4 One and Two-Family Residential District, the principal and accessory buildings on a lot may occupy up to a maximum of thirty percent thereof.

1254.10 FLOOR AREA.

   In an R-4 One and Two-Family Residential District, buildings shall have a minimum floor area of 1,000 square feet.

1254.11 BUILDING HEIGHT.

   In an R-4 One and Two-Family Residential District, no building shall exceed two and one-half stories, or thirty feet in height.

1254.12 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading in an R-4 One and Two-Family Residential District shall be provided for in accordance with Chapter 1292.
