CHAPTER 1274

A Agricultural Districts

1274.01 SIZE.

   An A Agricultural District shall contain a minimum of five acres.

1274.02 INTENT.

   The intent of A Agricultural Districts is to preserve and protect the decreasing supply of prime agricultural land. A Districts are also established to control the indiscriminate infiltration of urban development in agricultural areas which adversely affects agricultural operations.

1274.03 PERMITTED USES.

   The following uses are permitted in an A Agricultural District:
   (a)   Customary agricultural uses, buildings or structures, including nurseries, greenhouses, farming, dairying, pasturage, agriculture, horticulture, floriculture, viticulture and animal and poultry husbandry, provided that all animal pens, runs and enclosures shall be a minimum of 200 feet from all property lines;
   (b)   Single-family detached dwellings (rural farm houses and rural non-farm homes) on individual parcels;
   (c)   Churches and other places of worship, not including funeral or mortuary chapels, and schools and institutions for academic instruction;
   (d)   Public parks and recreation sites; and
   (e)   Roadside stands offering for sale only agricultural products grown on the premises.

1274.04 CONDITIONAL USES.

   The following uses may be permitted in an A Agricultural District only if expressly authorized by Council in accordance with Chapter 1284 and subject to limitations and restrictions deemed necessary by the Planning Board and/or Council:
   (a)   Farm vacation enterprises, private noncommercial recreation areas and facilities such as swimming pools, recreation clubs, summer camps, golf courses and country clubs;
   (b)   Structures and installations which are necessary public facilities and utilities and which require location in an A District;
   (c)   Home occupations as regulated by Section 1280.27;
   (d)   Community gardens; and
   (e)   Shooting ranges and archery ranges.

1274.05 PROHIBITED USES.

   No building or other structure in an A Agricultural District shall be used by a commercial or industrial establishment.

1274.06 ACCESSORY BUILDINGS AND USES.

   An accessory use or building or other structure customary and incidental to a use permitted in this chapter is permitted in an A Agricultural District.

1274.07 LOTS.

   No zoning lot less than two acres in area is permitted in an A Agricultural District. The ratio of the length of such a lot to its width shall not exceed three to one.

1274.08 YARDS.

   Yard requirements for an A Agricultural District are as follows:
   (a)   Front. There shall be a minimum depth of fifty feet.
   (b)   Side. There shall be a minimum width on either side of twenty-five feet, with the combined width of both side yards not less than fifty
feet.
   (c)   Rear. There shall be a minimum depth of twenty-five feet.

1274.09 COVERAGE OF LOT BY BUILDINGS.

   In an A Agricultural District, the principal and accessory buildings on a lot may occupy up to a maximum of fifteen percent thereof.

1274.10 FLOOR AREA.

   Minimum floor area requirements are not applicable in an A Agricultural District.

1274.11 BUILDING HEIGHT.

   In an A Agricultural District, no building shall exceed three stories or thirty-six feet in height.

1274.12 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading in an A Agricultural District shall be provided for in accordance with Chapter 1292.
