After application, notice and hearing as set forth in this chapter, the Council shall hold a meeting to determine whether the yard requirements set forth in this chapter should be waived. Prior to or at the time of the meeting, the applicant shall present to the Council a statement signed by all owners of real estate within one hundred (100) feet of the exterior boundaries of the real estate which would be affected. This statement shall recite they have been provided with a copy of the application and accompanying documents which have been given to the City and that they have no objections to the Council waiving the applicable yard requirements. The statement shall fully set forth the yard requirements which the applicant is asking be waived. At the time of meeting, objections, if any, may be heard. If no objections are filed, the Council may, if in its judgment a permit should not be granted, refuse to grant the same, or the Council may, if in its judgment such permit should be granted, issue same notwithstanding objections thereto. Granting an application shall require the affirmative vote of four (4) Council Members.
