Regulations
The purpose of this chapter is to provide clarifications on setbacks for uses that are not defined in each zoning district or other sections of this code. (Ord. 2024-5 (Att. A), 2024).
A. Roof Eaves, Chimneys, Balcony Rails and Other Features. Roof eaves, chimneys, balcony rails and other architectural features, etc., may extend into the required setback areas up to a maximum of two feet. (Ord. 2024-5 (Att. A), 2024).
Both road frontages on a corner lot are subject to the required front property line setback of the zone. (Ord. 2024-5 (Att. A), 2024).
In an area adjacent to a half street and where there is reason to believe or there is a plan for necessary additional right-of-way, and such right-of-way should be dedicated, acquired or otherwise come from the subject property, structures shall be set back from the half-street a distance sufficient to provide for the additional half-street in addition to the normal setback requirement. (Ord. 2024-5 (Att. A), 2024).
Front, rear, and side property line setbacks sometimes require differing setback distances. For this reason, each is defined as:
A. “Front property line” means that line which is marked by the road frontage, point of access, and by frontage to a body of water. A lot may have more than one front property line.
B. “Rear property line” means that lot line which is opposite from the front property line. Some lots may not have a rear property line, which is usually the case for corner lots.
C. “Side property line” means those property lines extending between the front and rear property lines. (Ord. 2024-5 (Att. A), 2024).
