48 - TSPHZ, TRANSPORTATION SYSTEM PLAN HOLDING ZONE

10A-48-01 - PURPOSE.

The purpose of the Transportation System Plan (TSP) Holding Zone is to ensure compliance with the Oregon Transportation Planning Rule (TPR) prior to development of land that is added to the Ontario Urban Growth Area (UGA).

10A-48-05 - APPLICABILITY.

This Chapter shall be applied to any property that is included within the Ontario UGA that has not been accounted for in the City's adopted and acknowledged TSP. The TSP Holding Zone shall be indicated on the official City of Ontario Zoning Map.

10A-48-10 - DEVELOPMENT PERMIT.

No development permit or intensification of use shall be permitted within the TSP Holding Zone, regardless of uses otherwise permitted in the underlying base zone.

10A-48-10 - REMOVAL OF THE TSP HOLDING ZONE.

The TSP Holding Zone may be removed in conjunction with or following the update, adoption and acknowledgment of the Ontario TSP.

The update of the TSP shall be accomplished in coordination with the Oregon Department of Transportation (ODOT) and shall address and mitigate for transportation impacts resulting from planned urban development allowed in the underlying base zone.

Removal of the TSP Holding Zone requires 45-day notice to the Department of Land Conservation and Development (DLCD) of a post-acknowledgment plan amendment as required by ORS 197.610.

10A-48-15 - ADMINISTRATIVE RESPONSIBILITY.

The City Manager shall designate an official or officials to administer and implement the special provisions of the TSP Holding Zone in accordance with the provisions of this Chapter.
