CHAPTER 19

40 - MHP DISTRICT, MOBILE HOME PARK

19.40.010 - Purpose of district.

The purpose of the mobile home park district is to provide a residential neighborhood for single-family mobile homeowners on rented spaces.

19.40.020 - Principal uses permitted.

The following are principal uses permitted:

A.

One-family dwellings and mobile homes;

B.

Public parks and playgrounds.

19.40.030 - Accessory uses permitted.

Uses and structures which are clearly incidental and subordinate to principal permitted uses and which will not create a nuisance or hazard are permitted as accessory uses.

19.40.040 - Conditional uses.

The following are uses that may be permitted by action of the commission under the conditions and procedures specified in Chapter 19.72 of this title:

A.

Home occupation;

B.

Trailers used for construction purposes;

C.

Public and private schools;

D.

Children's nursery;

E.

Churches;

F.

Public buildings and structures;

G.

Noncommercial radio and television transmitters or towers;

H.

Required essential services.

19.40.050 - Permit required.

It is unlawful for any person to establish, maintain or operate any mobile home park in the city without first having obtained a permit therefore from the city.

19.40.060 - Standards.

A.

A mobile home park shall have an area of not less than two acres nor more than ten acres. No mobile home, parking, office or service building shall be closer than fifteen feet to a public use area or other property line.

B.

Individual mobile home sites shall have an area of not less than four thousand square feet per single wide mobile home and four thousand five hundred square feet per double wide mobile home, and the total number of mobile homes per gross acre will not exceed nine.

C.

The planting of trees and shrubs or the preservation of existing trees or shrubs shall be required to the extent needed to provide a buffer to surrounding properties. Planted vegetation shall be of a sufficient density to provide a substantial visual barrier from public lands and adjacent properties. The minimum buffer width shall be fifteen feet.

D.

A minimum separation of twenty feet between mobile homes, including any attached entrance, lean-to, or other extension from mobile homes, shall be maintained between mobile homes.

E.

A minimum of two parking spaces per mobile home will be provided.

F.

A fenced area for the storage of boats and other recreational vehicles shall be required in mobile home parks with eight or more spaces per acre.

G.

Public facilities necessary to serve the mobile home park, including roads, utilities, water, waste disposal, recreation, schools and fire protection, shall be shown to be provided or available.

19.40.070 - Procedures for mobile home park plan approval.

A.

Application Requirements.

1.

Prior to submitting a formal application to the planning commission, the applicant shall confer with the building official on the review process for the application.

2.

An application for approval of a mobile home park shall be submitted for review by the building official and shall include a site plan containing the following information:

a.

Location and size of all mobile home spaces;

b.

Landscaping, buffering areas and open spaces;

c.

Utility layouts, including sewer, water and electricity;

d.

Parking for cars and recreational vehicles;

e.

Location and size of any building existing or proposed for construction;

f.

Sequential number system for all spaces;

g.

Vehicular circulation and traffic patterns;

h.

Name of the mobile home park and the name and address of the developer;

i.

Existing topography and soils information;

j.

Scale, north arrow, date and general location map.

The application shall include a legal description of the property identifying property dimensions and total area and an affidavit stating that the applicant holds controlling interest in the property and describing the ownership interest of the applicant and all other persons having an interest in the property.

4.

The review process will include a review of the site plan, and the following information:

a.

The character, design and attractiveness of the proposed mobile home park and its adequacy to encourage desirable living conditions, to provide separation and screening between uses where desirable and to preserve the natural amenities of streams and wooded areas.

b.

The adequacy of open space and recreational areas, existing and proposed, to meet the needs of the development.

c.

Traffic circulation into and through the mobile home park.

The building official shall review the application for completeness. Within five working days of receipt, the building official shall either accept the application as submitted or return to the applicant for additional information if the requirements of this section have not been met.

B.

Planning Commission Review. Within thirty days after the mobile home park application has been approved by the building official, the building official shall schedule a public hearing before the planning commission. Any conditions attached to the mobile home park plan, staff recommendations and technical agency review comments will be presented to the planning commission.

C.

Notice to Adjacent Property Owners.

1.

A notice of public hearing required under this title shall be given in accordance with this section.

2.

Forms of notice are as follows:

a.

Publication in the newspaper two consecutive weeks before the public hearing; and

b.

A public hearing notice shall be mailed at least fifteen working days before the public hearing to all record owners of property within a distance of six hundred feet of the exterior boundary of the property that is the subject of the application, or to the record owners of the five taxable parcels nearest the property that is the subject of the application, whichever is the greater number of persons, and if the property described in the application lies within a recorded subdivision, to all persons holding a legal interest in property within that subdivision.

3.

From the time of filing an application or until the time of the hearing thereon, the application, together with all plans, date and other supporting material, shall be available for public inspection in the building official's office.

4.

The failure of any person to receive any notice required under this section, where the records of the city indicate the notice was provided in a timely and proper manner, shall not affect the validity of any proceeding under this title.

D.

Action of the Planning Commission. The planning commission shall review the mobile home park plan and approve the application, give conditional approval, or deny the application. The planning commission shall render its decision and findings in writing; and if its decision is to deny the application, it shall indicate what the applicant might do to make his application acceptable. If given conditional approval, the applicant shall submit final plans meeting the conditions of the planning commission to the building official within thirty days of such approval.

E.

Appeal Process. A decision of the planning commission is final unless an appeal is filed within ten days after the commission's action. Appeals shall be conducted under the provision of Chapter 19.92 of this title.

F.

Expiration of Permit. Any final approval by the commission issued under this chapter, unless construction is commenced, shall expire one year from the date of issuance, unless during that year an extension for a definite time, not to exceed one year from any expiration date, or from any extended expiration date, is granted by the planning commission.

19.40.080 - Park operation permit.

A.

Issuance. The permit for operation of mobile home parks will be issued on a biennial basis after examination of the park by an inspection team consisting of the building official, fire captain and the sanitarian. The inspection will be made for the purpose of examining the park for compliance with this code, building codes, including plumbing, heating and electrical, fire and health codes, and other applicable codes. If deficiencies are found to exist in any portion of the mobile home park, a provisional operations permit will define the deficiencies and remedies to be taken, together with an established time to correct the same. Unless such deficiencies are corrected within the established time, a fine shall be levied against the park owner of ten dollars per unit per day based on total occupied park spaces. The park owner shall be responsible for correction of any deficiencies within the time limit specified.

B.

Review of Penalty. Penalties regarding the operation permits shall be reviewed and reaffirmed or rejected by the planning commission. The owner or manager of any park shall be notified of such hearing in order to present any information for the commission's consideration.

19.40.090 - Submission of as built plans.

Prior to issuance of an operation permit for an existing mobile home park, complete accurate as built plans shall be submitted. The plans shall include all information necessary for final plan approval under this chapter and shall also designate the required yard setback areas.

19.40.100 - Park—Responsibilities of management.

A.

The person to whom a license for a mobile home park is issued shall operate the park in compliance with this chapter and shall provide adequate supervision to maintain the park, its facilities and equipment in good repair and in a clean and sanitary condition.

B.

The park management shall notify park occupants of all applicable provisions of this chapter and inform them of their duties and responsibilities under this chapter.

C.

The park management shall supervise the placement of each mobile home on its mobile home stand, which includes securing its stability and installing all utility connections.

D.

The park management shall maintain a current register containing the names of all park occupants identified by lot number or street address. Such register shall be available to any authorized person inspecting the park.

19.40.110 - Park—Responsibilities of occupants.

A.

The park occupant shall comply with all applicable requirements of this chapter and shall maintain their mobile home lot, its facilities and equipment in good repair and in a clean and sanitary condition.

B.

The park occupant shall be responsible for proper placement of their mobile home on its mobile home stand and proper installation of all utility connections in accordance with the instructions of the park management.

C.

Porches, awnings and other additions shall be installed only if permitted and approved by the park management. When installed, they shall be maintained in good repair. The space immediately underneath a mobile home shall be used for storage only if permitted by the park management. If permitted, the following conditions shall be satisfied:

1.

Stored items shall be located so as not to interfere with the underneath inspection of the mobile home;

2.

The storage area shall be enclosed by skirting.

D.

The park occupant shall store and dispose of all their rubbish and garbage in a clean, sanitary and safe manner, The garbage container shall be rodent-proof, insect-proof and watertight.

19.40.120 - Exceptions.

Where hardship and practical difficulties resulting from peculiarities of the property render it difficult to carry out the provisions of this chapter, the planning commission may grant an exception in harmony with the general purpose and intent of this chapter.
