ARTICLE XXII

PROHIBITED USES

§ 25.213 PROHIBITED USES.

   The following uses are prohibited within the city:
   (A)   Tire storage, except for short-term concealed storage which is incidental to retail tire sales occurring on the same lot;
   (B)   Tire recycling yards;
   (C)   Outside storage of debris, waste and vehicle parts unless concealed and approved by the city;
   (D)   Outside storage of inoperable or abandoned vehicles or vehicles not licensed for on-street operation unless visually concealed from normal view within structures or landscaping approved by the city;
   (E)   Except as provided in § 25.207, any utility connections to or the occupation of a recreational vehicle, except when the recreational vehicle is within a state-approved recreational vehicle park;
   (F)   The keeping of livestock, except when the keeping is at the site of a legally operating veterinary hospital or as provided in §§ 25.205 or 25.207;
   (G)   Dangerous buildings, as defined in the Uniform Code for the Abatement of Dangerous Buildings;
   (H)   Noise from construction or mechanical excavation in a residential district or within 100 feet of an occupied dwelling between the hours of 7 p.m. and 7 a.m.;
   (I)   The emission of dust onto adjoining property when the result of untreated or improperly treated earth grading, excavation or vehicular movement; and
   (J)   Commercial uses within an apartment in any commercial or industrial district, except as provided in Article XIX or as an onsite resident manager’s office for a multi-family housing complex.

§ 25.214 CANNABIS USES PROHIBITED UNLESS SPECIFICALLY AUTHORIZED.

   (A)   No person shall engage in, conduct and/or operate a commercial cannabis business, or cause, allow, permit and/or maintain a commercial cannabis business on any real property within the city except as specifically authorized both by the provision of this code, including but not limited to this chapter, Chapter 6B, and state law.
   (B)   Except as specifically authorized in this chapter and Chapter 6B, or expressly made exempt from city regulation by state law, the cultivation, manufacturing, processing, storing, laboratory testing, labeling, transporting, dispensing, furnishing, distribution, delivery, and/or sale of cannabis or a cannabis product, and/or conducting a cannabis event, is expressly prohibited anywhere in the city.
   (C)   No commercial cannabis business may be located within a 600 foot linear radius measured from property line to property line of a school, day care center or youth center pursuant to the requirements of Chapter 6B.
