OFF-STREET PARKING AND LOADING

§ 25.215 PURPOSE.

   The purpose of this article is to provide for adequate off-street loading and parking for employees, customers, residents and visitors. These regulations are also designed to provide adequate ingress and egress, reduce traffic congestion and allow more efficient use of on-street parking.

§ 25.216 REQUIRED.

   (A)   All buildings or structures which are constructed or moved onto a lot shall provide required off- street parking facilities.
   (B)   The parking requirements shall also apply to all additions made to existing buildings including increases in number of units, seating or floor area.

§ 25.217 NUMBER OF SPACES REQUIRED.

   (A)   Except as otherwise provided in this article, the number of off-street parking spaces required for each use shall be as shown on the attached chart titled “off-street parking requirements, ” § 25.217(D) which is incorporated into this section.
   (B)   The parking spaces required for land uses not specified on the chart in this section shall be determined by the Community Development Director or designee based on the requirements for the most comparable use specified.
   (C)   When the parking requirement is based on the number of fixed seats, each 18 inches of pews or bench seats and each 24 inches of restaurant seating equals one seat. For non-fixed seating, the seating capacity shall be determined by the standards of the Uniform Building Code, as adopted by the city.

§ 25.218 COVERED SPACES REQUIRED.

   (A)   As provided herein, certain uses shall provide “covered” parking spaces. “Covered” means within a garage or carport.
   (B)   The garage or carport shall be sized to accommodate not less than the minimum required number of parking spaces required by § 25.217.

§ 25.219 MULTIPLE USE PREMISES.

   Whenever a single lot contains several different activities, the overall requirement for off-street parking and loading shall be the sum of the requirements for each activity calculated separately or as specifically provided in § 25.218.

§ 25.220 LOCATION.

   (A)   Required parking for commercial or industrial uses is based on the type of use and must be located on the same lot as the activity served or, if secured with a long-term lease or parking agreement, within 300 feet of the lot served.
   (B)   Residential parking must be located on the same lot as the residential unit(s) for which the parking is intended.

§ 25.221 RESIDENTIAL PROPERTY FOR COMMERCIAL OR INDUSTRIAL PARKING.

   The Planning Commission may approve a use permit permitting the use of property or properties for commercial or industrial parking facility use. At least one point within the residential property shall be within 300 feet of the commercial or industrial use for which the parking is intended and shall be fully improved to comply herewith.

§ 25.222 PARKING IN FRONT OR STREET SIDE YARD SETBACKS.

   Parking spaces, as required by this chapter, shall not be located in any front or street side yard setback, except the Community Development Director or designee may approve the spaces when unique land use, locational, environmental, topographic or other conditions are found to occur.

§ 25.223 PAVING AND DESIGN.

   (A)   Parking facilities required by this chapter shall be paved with a minimum of two inches of asphalt concrete, or equivalent, surfacing over compacted subgrade or equivalent and marked in the required number of stalls of ample size with adequate stalls and aisles in accordance with the parking design standards shown on “Drawing 10-40" of the city’s land division standards.
   (B)   (1)   Shade trees shall be planted and maintained in commercial and industrial parking lots. The desired density is not less than one tree per 3,600 square feet, approximately 60 feet on center. The trees shall be placed within a tree well sized not smaller than one non-compact parking space or incorporated into a four-foot minimum wide planter that separates parking space rows or forms the perimeter of the parking lot.
      (2)   The shade trees shall be from the city’s official listing of recommended street and shade trees list (or an equivalent alternative species) approved by the Community Development Director or designee.
   (C)   At a minimum, 8% of the gross area dedicated to parking facilities (spaces, aisles, driveways) shall be landscaped with trees, shrubs and groundcover.
   (D)   (1)   Where commercial, industrial or institutional parking facilities adjoin a residential district a land use barrier shall be provided.
      (2)   The barrier shall be a masonry wall, landscaped berm or equivalent feature approved by the Community Development Director or designee.

§ 25.224 REDUCTION OF REQUIRED PARKING SPACES.

   The number of parking spaces required for residential, public, commercial or industrial uses may be reduced by action of the Planning Commission.

§ 25.225 CHANGE OF USE WITH HIGHER PARKING REQUIREMENTS.

   (A)   For the reoccupation of an existing building, where an existing commercial or industrial use is changed to another permitted commercial or industrial use with higher parking requirements, the change of use shall not be denied solely on the grounds of insufficient off-street parking spaces to comply with this article. The existing parking area shall be fully utilized on a change of use and any unimproved lot area available for off-street parking shall be so improved and used, but in no event shall more parking area be required than is set forth in this article.
   (B)   When, as a result of the change of use, any structures, buildings or parts thereof are removed from the lot or lots upon which the principal structure is located, the additional area thus realized shall be improved and used for parking.

§ 25.226 OFF-STREET PARKING EXCEPTIONS FOR HISTORIC COMMERCIAL DISTRICTS.

   (A)   The purpose of this section is to reduce off-street parking requirements in order to encourage residential re-use of second and higher floors of existing buildings and new residential uses above the ground floor in historic commercial districts.
   (B)   The number of spaces required for second or higher floor residences in historic commercial districts shall be one parking space per dwelling unit, or as provided below. Parking spaces as required by this section need not be covered.
      (1)   For the residential reoccupation of all or portions of second and higher floors in existing buildings, such change of use shall not be denied solely on the grounds of insufficient off-street parking. However, any unimproved lot area available for off-street parking shall be improved and thereafter used for tenant parking upon the change of use.
      (2)   For new buildings which are to contain residences above the first floor, or for above first floor residential additions proposed for existing buildings where one or more additional dwelling units result, one space for each dwelling unit.
      (3)   The exception to the number of parking spaces and coverage requirements provided by this section shall not be applicable to first floor residences except when the Planning Commission finds concurrently with use permit approval, that:
         (a)   The one residence is clearly accessory to an onsite commercial use;
         (b)   The intended occupant thereof is the owner, manager or employee of the onsite commercial use; and
         (c)   No portion of the first floor residence, is nearer than 60 feet to the street right-of-way that adjoins the front yard.

§ 25.227 EXCEPTION TO COVERED PARKING REQUIREMENT FOR HISTORIC RESIDENTIAL DISTRICTS.

   Parking spaces required for uses in historic residential districts need not be covered if the spaces are accessed from an alley adjoining the rear yard and screened from view from a public street by a fence, hedge or wall or other device approved by the Community Development Director or designee.

§ 25.228 DISABLED PARKING.

   All parking facilities must comply with California Administration Code Title 24, 2-7102. These regulations require that parking facilities be designed to accommodate persons with mobility impairment who find it difficult or impossible to use standard parking spaces.

§ 25.229 BICYCLE PARKING.

   (A)   The city encourages the use of bicycles as a means of transportation. All new building projects are encouraged to provide bicycle parking racks for customers and employees. For certain types of activities, the city may require bicycle parking racks.
   (B)   Examples of uses requiring bicycle parking facilities are public buildings, parks, recreation areas, schools, shopping centers, fast food restaurants, arcades, skating rinks, medical complexes, convenience stores and movie theaters. Other uses may require bicycle racks based on location and nature of the use. Bicycle racks shall be conveniently located, provide protection from vehicle damage and theft and not obstruct pedestrian or vehicle movement.

§ 25.230 STACKED PARKING AND DRIVE-THROUGH WINDOW SALES.

   (A)   Stacked parking or spaces stacked two deep may be permitted for all uses when approved by the Technical Advisory Committee.
   (B)   Drive-through window sales may be permitted or permitted with a use permit for those uses in those certain districts as shown herein, provided the Technical Advisory Committee approves the parking configuration, not more than 20% of the total required off-street spaces are included in the drive-through aisle and the stacked parking is not located in required parking aisles or conflict with access to or use of any other required off-street parking.
   (C)   The percentage of spaces which can be provided as stacked or drive-through spaces may be increased or decreased by the Technical Advisory Committee based on traffic safety, circulation, landscaping and other related regulations and amenities.

§ 25.231 LOADING AREAS.

   Commercial, industrial and institutional uses shall provide off-street loading areas sufficient for their purpose. The loading areas shall not encroach on the public right-of-way or obstruct required driveways, aisles or parking spaces.
