ARTICLE XVIII

Route 150 Planned District

§ 250-182 Area affected.

Notwithstanding any other provision of the Town of Sand Lake Zoning Code, Town Code and the Zoning Map of the Town of Sand Lake, the zoning in the area within the boundaries described in § 250-183 of this chapter shall constitute a planned development district to be known and described as "Route 150 Planned District."

§ 250-183 Property description.

The Route 150 Planned District shall consist of:
All that tract or parcel of land situated in the Town of Sand Lake, County of Rensselaer and State of New York, bounded and described as follows:
Beginning at an existing 5/8" capped iron rod on the westerly highway line of New York State Route 150 (S.H. #8365) at its point of intersection with the division line between lands on the north now or formerly of Jeffrey A. Lawrence and Sharon L. Lawrence (Bk. 1601, Pg. 96. Lot 10 -
Drawer 1988 Map 169) and lands on the south of Scott A. Blair and Lori A. Gaba (Roll 263, Frame 600, Bk. 1475, Pg. 73 & Bk. 1622, Pg. 321 & Bk., Pg.) and runs thence from said point of beginning, N 66°-20' W., along said division line and generally along wire fence remains and tree line the following distances, 276.02 feet to an existing 3/4" capped iron rod, 37.68 feet to an existing 3/4" capped iron rod and 145.42 feet to an existing 3/4" capped iron rod, total distance being, 459.12 feet; thence, N 57°-10'-45" W., along the lands now or formerly of William H. Hoffay (Bk. 1640, Pg. 50 - Drawer 49, Map 26), 104.48 feet to an existing 3/4" capped iron rod, thence, S 41 °-28'-15" W., continuing along the lands of Hoffay, 358.83 feet to an existing 3/4" capped iron rod, thence, S. 71° - 55'-45" E, continuing still along the lands of the aforesaid Hoffay and along the northerly line of lands now or formerly of Michael Moss (Bk. 1730, Pg. 284) the following distances, 168.00 feet to an existing%" capped iron rod and 241.15 feet to an existing 3/4" capped iron rod, total distance being, 409.15 feet; thence, S. 64°-03'-15"E., along the northerly line of lands now or formerly of Gerald Moss (Bk. 1730, Pg. 280 -Drawer 1994 Map 67) the following distances, 66.61 feet to an existing concrete monument and 228.68 feet to an existing concrete monument, total distance being, 295.29 feet; thence, N 17°-50'-45" E., along the 1930 westerly highway line of New York State Route 150 (Map 36) 298.39 feet to the point of beginning.
Containing 4.35± acres of land, more or less.

§ 250-184 Uses.

A. 
The Route 150 Planned District may be used for all uses and subject to all of the dimensional and other restrictions of Chapter 250 as permitted by the underlying zoning district as it existed on the date of the adoption of this article or as it may be amended or replaced. In addition to those uses, the parcel(s) described above may be used for the following uses.
(1) 
Outdoor or indoor storage of construction and excavation equipment.
(2) 
Outdoor or indoor storage of landscape materials.
(3) 
Outdoor or indoor processing of topsoil, mulch, and other landscape materials. Processing of topsoil, mulch, and other landscape materials shall not include stone crushing and washing activities.
(4) 
Such other uses as shall be approved by the Town Board upon application thereto in accordance with the provisions of Article X of this chapter or such article or section that provides for the amendment or adoption of Planned Districts in the Town of Sand Lake.
(5) 
Any and all building within the Route 150 Planned District shall be subject to the process contained in the Planned Development Districts Article of Chapter 250, Zoning.

§ 250-185 Additional restrictions.

A. 
Any construction or excavation equipment stored outside must be set back at least 25 feet from adjoining properties and shall be appropriately screened from such properties or any public thoroughfare by landscaping or fencing.
B. 
Any processing equipment used shall be set back at least 75 feet from adjoining properties.
C. 
The topsoil, mulch, and other landscape materials processing activities shall be limited to dates between April 1 and November 1 annually.
D. 
The topsoil, mulch, and other landscape materials processing activities shall not be allowed earlier than 7:00 a.m. shall not be allowed later than 5:00 p.m.
E. 
The topsoil, mulch, and other landscape materials processing activities shall only be permitted on Mondays through Fridays, and shall be prohibited entirely on Saturdays and Sundays and all national holidays.
F. 
The forgoing time and date restrictions shall apply only to processing activities and are not intended to prevent the operator from storage of equipment and materials and said restrictions are not intended to prevent the operator from delivering or retrieving equipment or materials from the property at other times.
