ARTICLE VII
Scenic Preservation Overlay Area
§ 250-71 Applicability.
A Scenic Preservation Overlay is established around Crystal, Glass, Burden, Crooked and Reichards Lakes and Big and Little Bowman Ponds for a horizontal distance of 100 feet above the mean high-water mark and along the Wynantskill Creek, to a contour elevation of five feet above the mean high-water mark, but at least 100 feet horizontal from the nearest bank of the stream, whichever is greater. The regulations described below are in addition to any other district regulations in the Scenic Preservation Overlay area.
§ 250-72 Extent of review limited to exterior features.
The Planning Board shall review only exterior features of a structure and shall not consider interior arrangements, nor shall it disapprove applications except in regard to considerations as set forth in this article.
§ 250-73 Approval required for improvements.
The following activities must be approved by the Planning Board before being commenced within the Scenic Preservation Overlay area. No permits shall be issued until such approval is secured. All applicable state and federal requirements must be met prior to construction.
A.
Any development activities, as defined by this chapter, including any accessory structures.
B.
Any clear-cutting of vegetation.
C.
The removal or topping of individual trees over six inches diameter (19 inches in circumference) measured from 4 1/2 feet above the adjacent grade.
D.
The installation of fences.
§ 250-74 Submission requirements.
Within the Scenic Preservation Overlay area, the following shall be submitted to the Planning Board for review and approval:
A.
A general map showing the location of the site on the associated lake, pond, or creek.
B.
Location of existing and proposed development and/or structures.
C.
Existing and proposed topography, including limits of grading.
D.
Existing and proposed driveways, roads, or other access to the property.
E.
Existing and proposed parking areas.
F.
Landscaping plan, including vegetation to be removed, if any, and location, size, and type of plant materials proposed.
G.
If the project involves the establishment or alteration of any buildings, complete elevations and samples of exterior materials and colors.
H.
Detailed drawings of decorative elements, lettering and any other features which constitute a major element in the appearance of any structure.
I.
Sketches, models, drawings of any sculpture, statuary, fountains, monuments or historical markers or decorative or memorial plaques; illustrations or examples of proposed lampposts, street signs, benches, trash receptacles, kiosks and other similar items.
J.
Location and elevation of proposed signs, including colors, materials, and lettering.
§ 250-75 Factors under consideration.
§ 250-76 Standards of review.
A.
In acting on any application under this article, the Planning Board shall endeavor to ensure that all development and/or structures hereafter erected or altered in exterior appearance, including signs, within the Scenic Preservation Overlay shall be of such design, appearance and relation to one another that they will not impair the attractiveness and appearance of the scenic preservation area in particular and the Town in general.
B.
In furtherance of these purposes, the Planning Board shall seek to ensure good building design, but shall not prescribe any type or particular style of architecture. Nothing in this article shall be construed to prevent ordinary maintenance or repair of any structure within the scenic preservation area; nor shall anything in this article be construed to prevent the construction, alteration, repair, moving or demolition of any structure under a permit issued by the Code Enforcement Officer prior to the adoption of this chapter.
C.
Reimbursable costs. Costs incurred by the Planning Board for reasonable consultation fees or other extraordinary expense in connection with the review of a proposed improvement shall be charged to the applicant.
