ARTICLE III

Zoning Districts and Map

§ 250-10 Establishment of districts and purposes.

The zoning districts established by this chapter shall be as follows:
A. 
RR — Rural Residential. The purpose of this district is to encourage agriculture, forestry, low-density residential and compatible nonresidential uses in rural and more environmentally sensitive areas where intensive residential development is impractical and undesirable.
B. 
AR — Agricultural/Residential. The purpose of this district is to encourage agriculture and compatible open space uses while maintaining low- and medium-density residential areas.
C. 
R — Residential. The purpose of this district is to maintain existing residential character and allow for new traditional and clustered residential subdivisions and compatible uses.
D. 
RM — Residential Mobile Home. The purpose of this district is to designate areas where mobile home dwellings are appropriate and compatible within the designated district and in relation to adjacent districts and land uses.
E. 
HMU — Hamlet Mixed-Use. The purpose of this district is to maintain and encourage the traditional character, scale, and mix of uses in the existing hamlets by providing an opportunity for residential areas, community services, and some commercial land uses surrounding the core hamlet commercial areas.
F. 
HC — Hamlet Commercial. The purpose of this district is to provide an opportunity for primarily commercial land uses in the traditional hamlet centers of the Town. Hamlet areas provide logical locations for these necessary land uses, and provide protection for rural residential and agricultural land uses elsewhere in the Town.
G. 
NREO — Natural Resource Extraction Overlay. The purpose of this Overlay district is to permit resource extraction in locations within the Town where existing commercial resource extraction activities are already under permit with the New York State Department of Environmental Conservation and, where applicable, the Town of Sand Lake. The boundaries of this overlay district shall be the "Life of Mine" boundaries on approved permits and the Town of Sand Lake where applicable at the time of adoption of this chapter. The Natural Resource Extraction Overlay shall also serve as a "premapped" PDD.
H. 
CRO — Commercial Reuse Overlay. The purpose of this overlay district is to provide a transition area where residential and commercial development can intertwine while maintaining a residential community character. As such, the intent is to encourage existing residential uses as well as small-scale businesses, such as offices and home occupations, which can be located in converted residential structures and blend with existing residential character.
I. 
SPO — Scenic Preservation Overlay. The purposes of the scenic preservation area include the following:
(1) 
To safeguard the scenic resources of the Town of Sand Lake.
(2) 
To enhance community appearance.
(3) 
To promote scenic resources for the pleasure and welfare of the citizens of and visitors to the Town.
(4) 
To stabilize and improve property values.
(5) 
To safeguard against damage due to natural causes, such as flooding.
J. 
PDD — Planned Development District. The purpose of this district is to allow development matched to the unique characteristics of a site and allow innovative development techniques that might not otherwise be possible through strict application of standard use, area, bulk and density specifications. PDDs are created through a procedure for allowing flexible land use and design through creative planning and design. In a "premapped" PDD overlay area, the Town Board shall hear and consider the proposed PDD.
K. 
HDO - Historic District Overlay. The purpose of this district is to promote the preservation and enhancement of historic properties located within the Town of Sand Lake. The potential properties (at least over 100 years old) to be included in the Historic District Overlay are identified as:

(1) 
On Route 43, from the Sand Lake Center for the Arts and 2883 NY 43 to the intersection with Route 66 at Taborton Road.
(2) 
Taborton Road from Route 43/ 66 to Oak Hill Road.
(3) 
Routes 43/66 from Taborton Road to 2669 Routes 43/66.
(4) 
Sand Lake Union Cemetery.
(5) 
The entirety of Schumann Road.
(6) 
Glass Lake Road from Route 43/ 66 to Pillars Lane.
(7) 
Lower Teal Road (17 and 19 Teal Road).

§ 250-11 Zoning Map.

The above districts are shown on the Official Zoning Map of the Town of Sand Lake, adopted by the Town Board, which is incorporated herein and which is in all respects made a part of this chapter.[1]

§ 250-12 Interpretation of boundaries.

A. 
District boundaries shown along property lines shall be interpreted to follow such property lines.
B. 
District boundaries shown within lines of roads, streams, and transportation rights-of-way shall follow the center lines thereof.
C. 
Where district boundaries cannot be determined by the Enforcement Officer through the use of center lines, existing property lines or by the Zoning Map, the Board of Appeals, upon hearing, shall determine such boundaries upon consideration of the purposes set forth in this chapter and all relevant evidence.
D. 
Where a district boundary line divides a lot in a single ownership at the time of the passage of this chapter, the regulations for the more restricted portion of such lot shall extend not more than 30 feet into the less restricted portion, provided that the lot has frontage on a street in the less restricted district.
E. 
Notwithstanding the Natural Resource Extraction Overlay District boundaries shown on the Zoning Map, the boundaries are defined as the "Life of Mine" boundaries as denoted on existing permits approved by the New York State Department of Environmental Conservation and the Town of Sand Lake, where applicable, at the time of the adoption of this chapter.
F. 
The Commercial-Reuse Overlay District boundaries shown on the Zoning Map, where parcel lines are not followed, extend 250 feet perpendicular from the center line of Routes 43 and 150.
G. 
Notwithstanding the Scenic Preservation Overlay District boundaries shown on the Zoning Map, the boundary is defined as a horizontal distance of 100 feet above mean high-water mark around Crystal, Glass, Burden, Crooked and Reichards Lakes and Big and Little Bowman Ponds and along the Wynantskill Creek, to a contour elevation of five feet above the mean high-water mark, but at least 100 feet horizontal from the nearest bank of the lake or stream, whichever is greater.
