LOT LINE EASEMENTS: Unless otherwise indicated, easements of eight (8′) feet in width along each front and rear lot line and five (5′) feet in width along each side lot line are hereby created and provided for the purpose of accommodating overhead, surface and underground utilities and drainage. Where an area greater than one lot is used as a building site, the outside boundary of said site shall be subject to the lot line easements.

APPENDIX C22. - PRIVATE STREETS AND DRAINAGE SYSTEMS REQUIREMENTS FOR ARTICLES OF INCORPORATION (HOMEOWNER'S ASSOCIATIONS), PROTECTIVE COVENANTS, AND DEED RESTRICTIONS

The Association shall have the following general power reflected in the Articles of Incorporation:

(1)

Own and convey property.

(2)

Operate and maintain common property, parcels, tracts, etc., containing all private streets and stormwater management facilities including detention areas, retention areas, littoral areas, flow control structures, culverts, and related appurtenances.

(3)

Establish rules and regulations.

(4)

Assess members and enforce such assessments.

(5)

Sue and be sued.

(6)

Contract for services for operation and maintenance.

(7)

Contain as member all homeowners, lot owners, property owners, or unit owners.

The Declaration of Protective Covenants, or Deed Restrictions, should set forth the following:

(1)

It is the responsibility of the Association to operate and maintain the private streets, traffic control devices, and stormwater management system.

(2)

The private streets and stormwater management system is owned by the Association as common property.

(3)

There shall be a method of assessing and collecting the assessment for operation and maintenance of the private streets and stormwater management system. Said method shall address basis of assessment, assessment schedules and rates.
