01 - GENERAL PROVISIONS
This chapter shall be known, cited, and referred to as the "Unified Development Ordinance" or "this UDO."

This UDO is adopted to regulate and control the use and development of land within the Village of Savoy to:
A.
Provide for orderly growth consistent with the comprehensive plan;
B.
Protect and promote public health, safety, comfort, and welfare;
C.
Secure adequate natural light, pure air, clean water, and safety from hazards;
D.
Maintain and enhance the taxable value of land and improvements;
E.
Establish a sensible pattern of land uses and encourage appropriate use of individual parcels;
F.
Ensure compatibility between land uses and prevent overcrowding and incompatible development;
G.
Minimize traffic congestion and ensure efficient circulation;
H.
To manage stormwater runoff and lessen hazards to persons and property;
I.
Facilitate efficient use of public facilities and utilities; and
J.
Preserve sites and structures of historical, environmental, and architectural importance.

This UDO is adopted pursuant to the authority granted by the Illinois Municipal Code.

This UDO shall take effect immediately upon its passage, approval, and publication by the board of trustees. The effective date of each amendment to this UDO shall be the date of adoption of such amendment unless otherwise provided.

A.
This UDO applies to all land, uses, buildings, and structures in the village and its extraterritorial jurisdiction, including those owned by municipal corporations and government bodies.
B.
All lots created after the effective date of this UDO shall conform to the requirements for the zoning district in which they are located, except as otherwise provided.
C.
Where standards imposed by this UDO are either more restrictive or less restrictive than those imposed by other regulations, the more restrictive provisions shall govern.

A.
Building Permits Issued Prior to Effective Date. When a valid building permit has been lawfully issued prior to the effective date of this UDO, the building or structure may be completed and a certificate of occupancy may be issued in accordance with the plans for which the building permit was issued.
B.
Pending Applications. Where a complete application for a land use or zoning action is pending action by the village on the effective date of this UDO, the provisions in effect when the application was filed shall govern the review and approval.
C.
Existing Special Uses and Variations. All special use permits and variations approved by the board of trustees prior to the effective date of this UDO shall remain in full force and effect. The recipient of the special use permit or variance approval may proceed to develop the property in accordance with the plans approved by the board of trustees and any conditions attached thereto. Property owners shall continue to be obligated to conform to all such conditions and requirements even if the property is rezoned. However, if the recipient has failed to begin construction within six months of the date of adoption of this UDO, then the provisions of this UDO shall govern.
D.
Planned Unit Developments. All planned unit developments (PUDs) approved by the board of trustees prior to the effective date of this UDO shall remain in full force and effect. The recipient of the PUD approval may proceed with development in accordance with the site plans, subdivision plans, or other development plans approved by the Board of Trustees and any conditions attached thereto. Property owners shall continue to be obligated to conform to all such conditions and requirements even if the property is rezoned. However, if construction has not begun within six months of the date of adoption of this UDO, the provisions of this UDO shall govern.
E.
Existing Uses. When a lot is used for a purpose that was classified as a permitted use prior to the effective date of this UDO, and such use is classified as a special use by this UDO, such use is hereby deemed a lawful special use. Any addition, enlargement, or expansion of such use shall conform to the requirements of Chapter 16.09.
F.
Uses, Structures, Buildings, and Lots Rendered Nonconforming. Existing uses, structures, buildings, and lots that do not comply with the regulations of this UDO shall be subject to Chapter 16.09 of this UDO relating to nonconformities.
G.
Existing Unlawful Uses, Structures, and Buildings. No building, structure, or use, which was unlawful at the time of the adoption of this UDO, shall become or be made lawful solely due to adoption of this UDO. To the extent that said unlawful building, structure, or use is in conflict with the requirements of this UDO, said building, structure, or use remains unlawful.

A.
The provisions of this UDO are separable, in accordance with the following provisions.
1.
If any court of competent jurisdiction shall adjudge any provision of this UDO as invalid, such judgment shall not affect any other provision of this UDO not specifically included in said judgment.
2.
If any court of competent jurisdiction shall adjudge invalid the application of any provision of this UDO to a particular property, building, or structure, such judgment shall not affect the application of said provision to any other property, building, or structure not specifically included in the judgment.
