10 - DEFINITIONS
A.
Purpose. For the purpose of interpreting this UDO, certain words, concepts, and ideas are defined herein. Except as defined herein, all other words used in this UDO shall have their everyday meaning as determined by their dictionary definition.
B.
Applicability. The definitions established herein shall apply to the interpretation of all standards of this UDO unless otherwise specified.

A.
"Accessory structure" means a structure that is clearly incidental to and customarily found in connection with a principal structure, is located on the same parcel and serves a structure building, and is subordinate in area, extent and purpose to the principal structure. Accessory structures may include but are not limited to swimming pools, sheds, detached garages or carports, decks, patios, pergolas, and gazebos.
B.
"Accessory use" means a use subordinate to the principal use in terms of area, extent, and purpose that contributes to the comfort, convenience, or necessity of occupants of the principal building or principal use served and is located on the same lot as the principal use served.
C.
"Adjacent" means adjoining, bordering, touching or contiguous. If two lots are separated by a street, public alley or public walk, they shall not be deemed to be adjacent.
D.
"Adult oriented business" means any commercial use of property of which a significant or substantial portion involves an activity distinguished or characterized by its emphasis on matters depicting, describing or relating to specified sexual activities or specified anatomical areas, including, but not limited to, the operation of an adult bookstore and/or video store, adult mini-motion picture theater, adult motion picture theater, adult motion picture arcade, adult motel, adult card, gift or novelty store, or adult entertainment cabaret.
E.
"Airport" means any area of land or water designed and set aside for the landing and take-off of aircraft, including all necessary facilities for the housing and maintenance of air-craft.
F.
"Alcohol/liquor sales" means the retail sale of beer, wine, or other alcoholic beverages for off-premises consumption.
G.
"Alley" means a public or private thoroughfare that affords a secondary means of access to an abutting property.
H.
"Alteration" means any change in the bearing wall, columns, beams, girders or supporting member of a structure, any change or rearrangement in the floor area of a building, any enlargement of a structure whether by extending horizontally or by increasing in height, and/or any movement of a structure from one location or position to another.
I.
"Animal clinic, with outdoor runs" means a facility for the diagnosis, treatment, and hospitalization of animals, including, but not limited to dogs, cats, birds, and horses, that includes a specifically designed outdoor area that allows animals to run and play safely.
J.
"Animal clinic, without outdoor runs" means a facility for the diagnosis, treatment, and hospitalization of animals, including, but not limited to dogs, cats, birds, and horses, that does not include an outdoor area for animals to run and play.
K.
"Animal production" means an area which is used for the raising of animals and the development of animal products on a commercial basis. Typical uses include cattle and sheep ranching, dairy farming, fish farming, and the raising of poultry and swine.
L.
"Artisan manufacturing" means a fully indoor small-scale business that produces goods or specialty foods, primarily for direct sales to consumers, such as artisan leather, glass, wood, paper, ceramic, textile and yarn products, specialty foods and baked goods. This land use does not include uses producing noise, odor, vibration, or similar impacts perceivable by the natural senses outside of the structure or portion of the structure where the use is located. This land use includes the design, processing, fabrication, assembly, treatment and packaging of products; as well as the incidental storage, sales and distribution of such products.
M.
"Antenna" (attached to a building exterior wall) means a telecommunications device mounted on the exterior wall of a building or structure. It consists of a network of electrical conductors designed to efficiently transmit or receive electromagnetic waves or radio frequencies.
N.
"Attention-getting device" means any flag, streamer, spinner, pennant, costumed character, light, balloon, continuous string of pennants, flags, or fringe, or similar device or ornamentation used primarily for the purpose of attracting attention for promotion or advertising a business or commercial activity which is visible by the general public from any public right-of-way or public area.
O.
"Automobile" means a self-propelled, free-moving vehicle for the conveyance of persons on a street and having a seating capacity for not more than ten (10) persons.

A.
"Bank, credit union, financial services" means establishment that engages in financial transactions that create, liquidate, or change ownership of financial assets. Banks, credit unions, and savings institutions may perform central banking functions, accept deposits, and lend funds from these deposits. In addition to banks and credit unions, financial services institutions may include: credit agencies, trust companies, holding companies, savings and loan institutions, check cashing services, securities/commodity contract brokers and dealers, security and commodity exchanges, vehicle finance (equity) leasing agencies, and investment companies.
B.
"Base district" means a base zoning district prescribes a basic set of uniform development regulations for a defined geographic area.
C.
"Bar/tavern" means an establishment principally for the sale and consumption of alcoholic beverages on the premises.
D.
"Bed and breakfast" means a one-family owner-occupied dwelling where short-term lodging is provided through the rental of individual rooms to the general public, with common cooking and dining facilities. A bed and breakfast is not a short-term rental as defined in this UDO.
E.
"Block" means an area of land generally bounded by streets or rights-of-way and occupied by or intended for buildings.
F.
"Brewery" means an establishment primarily engaged in the brewing of ale, beer, malt liquors, and/or nonalcoholic beer that are permitted to do so in accordance with the liquor control commission. Breweries shall have a capacity of fifteen thousand (15,000) barrels or more per year. The definition includes a public tasting room, and retails sales of ale, beer, spirits, or related products brewed or manufactured on site.
G.
"Buildable area" means the space remaining on a zoning lot after the minimum yard requirements of this title have been applied.
H.
"Building" means a structure enclosed within exterior walls and a roof which is used for the shelter of persons, animals, or property.
I.
"Building, attached" means a building having one or more walls in common with another building.
J.
"Building, detached" means a building having no walls in common with another building.
K.
"Building height" means vertical distance measured from the level of the public sidewalk, or the top of the curb if there is no sidewalk or the centerline of the road if there is no sidewalk and no curb, opposite the middle of the front of the building to the highest point of the roof.

L.
"Building material, machinery, and equipment sales or storage" means a facility primarily oriented to the receiving, holding, shipping, and/or sale of building material, machinery, and equipment for a single business or a single group of businesses. With the exception of loading and parking facilities, such land uses are contained entirely within an enclosed building. Examples of this land use include conventional warehouse facilities, long-term indoor storage facilities, and joint warehouse and storage facilities.

A.
"Carwash" means a facility for the washing or steam cleaning of passenger vehicles. A carwash may be:
1.
A single-unit type which has a single bay or a group of single bays with each bay to accommodate one vehicle only where a person uses a high-pressure hose to wash the vehicle by hand;
2.
An automated single-unit type which has a single bay to accommodate one vehicle at a time; or
3.
A tunnel unit type which allows washing of multiple vehicles in a tandem arrangement while moving through the structure.
B.
"Cemetery" means a place designated for burial of the dead.
C.
"Child/adult day care center" means a state licensed facility that provides less than twenty-four (24) hour care, training, education, custody, treatment, or supervision for persons who are unable to care for themselves and who are not related by blood, marriage, or adoption to the owner or operator of the facility, whether or not the facility is operated for profit or charges for the services it offers. This use does not include a facility that:
1.
Is accessory to a primary use, such as a shopping center, business, religious institution or other establishment, where individuals are cared for during short periods of time while parents or persons responsible for them are engaging in activities related to the primary use; or
2.
Operates solely for educational instruction to children in grades kindergarten through at least grade two, that does not provide custodial care for more than one hour during the hours before or after the customary school day.
D.
"Civic meeting facility" means not-for-profit membership organizations such as alumni associations, booster clubs, scouting organizations, ethnic associations, social clubs, fraternal lodges, and veterans' membership organizations primarily engaged in promoting the civic and social interests of their members. This use often includes meeting and storage facilities.
E.
"Clinic" means an establishment operated by one or more medical or dental practitioners, specializing in various branches of the medical or dental professions, for the purpose of studying and treating medical or dental patients.
F.
"College/university" means an institution for post-secondary education, public or private, offering courses in general or religious education and not operated for profit. It operates in buildings owned or leased by the institution for administrative and faculty offices, classrooms, laboratories, chapels, auditoriums, lecture halls, libraries, student and faculty centers, performing arts facilities, athletic facilities, health centers, dormitories, fraternities, sororities, and other on-campus housing, as well as associated maintenance facilities. It does not include vocational schools, online/remote programs, or colleges/universities operated for profit.
G.
"Commercial kitchen" means a facility containing a kitchen or kitchens in which food is prepared for off-site consumption, also called a ghost kitchen.
H.
"Common court" means a shared open space around which a group of related buildings is arranged.
I.
"Community garden" means an outdoor area, privately- or publicly-owned, operated or maintained, for cultivation of fruits, flowers, vegetables, or ornamental plants by more than one person or family. Community gardens may be divided into separate plots for cultivation by one or more individuals or may be maintained and cultivated collectively.
J.
"Community and economic development director" means the department head for the community and economic development department and ex officio zoning administrator as established in Chapter 2.17 of the village code. Where community and economic development director is referred to in this UDO, the term shall be interpreted to mean the community and economic development director or their designee.
K.
"Conforming use" means any use of a building or land which conforms with the use regulations of the district in which the building or land is situated. If the use is a permitted use but does not conform with relevant additional use regulations, it shall not be deemed to be a conforming use.
L.
"Construction, active" means the status in which surveying, construction, maintenance or utility activities is currently taking place.
M.
"Coworking space" means a neutral, nonexclusive, limited shared space defined in a membership-based service arrangement or agreement or subscription wherein a firm has no tenancy interest, leasehold estate, or other real property interest with respect to the accommodation on an as-needed basis. The agreement gives the firm a right to share the use of the space and may include an exclusive mailing address and office services. An executive suite/exclusive desk/dedicated desk/secured suite/private office under a coworking space agreement falls under this definition.
N.
"Crematorium" means a facility for the incineration of corpses, human or animal, to ashes. Crematorium does not include any establishment where incinerators are used to dispose of toxic, hazardous, infectious, or narcotic materials.
O.
"Crops and horticulture" means an area used for the raising or harvesting of agricultural crops such as wheat, field forage, and other plant crops intended to provide food or fiber.
P.
"Contractor shop" means an enclosed space used for the provision of services, storage, operation and housing of equipment and fabrication of building-related products.
Q.
"Contractor trailer" means a modular or portable office or storage structure for use by a contractor during construction activity.

A.
"Deck" means an attached or detached structure or platform which is not walled in or enclosed above a height of two and one-half feet. Open guardrails when required by the building code shall not be construed as a violation of the enclosed height limitation.
B.
"Developer" means the legal or beneficial owner or owners of any lot or any land included in a proposed development including the holder of an option or contract to purchase, or any person with beneficial interest in a land trust, or other persons having enforceable proprietary interest in such land, with the intent of developing the land, by making physical improvements to it by constructing or modifying roads, utility lines, and/or other infrastructure elements.
C.
"Development" means any activity causing a change to be made in the legal rights or physical state of a previously developed site or an unimproved tract of real estate, such that the proposed improvement activity satisfies one or more of the criteria listed herein:
1.
Requires a stormwater management plan; or
2.
Requires a sanitary sewer construction or operation permit from the Illinois Environmental Protection Agency (IEPA); or
3.
Requires a traffic impact analysis; or
4.
Constitutes any mining, quarrying, or other excavations related thereto; or
5.
Constitutes of the creation or a change to a subdivision or a re-subdivision or a lot-line adjustment; or
6.
Constitutes the creation of or a substantial change to a mobile home park; or
7.
Constitutes the creation of or substantial change to a planned unit development.
8.
The following activities are not considered to be development:
a.
The transfer of any existing building or use rights for use of a single individual parcel, as it then exists immediately prior to any sale or lease where such transfer or lease does not create any additional parcel by exception; or
b.
The dedication of land for public use to a public entity, the vacation of any land so dedicated, or the taking of property rights through eminent domain or inverse condemnation; or
c.
The construction of one single-family dwelling and/or farm-related structure on a single lot, or the creation or transfer of a single lot of ten (10) acres or more in size, except where such acreage or structures are at locations of future streets as designated in the village's comprehensive plan; or
d.
The maintenance or improvement of an existing public street or railroad by a public utility not involving redesign, if the work is carried out on land within the boundaries of the right-of-way.
D.
"Distillery" means an establishment primarily engaged in the manufacturing of fortified spirits that is permitted to do so in accordance with the liquor control commission. Distilleries shall have a capacity of more than twenty-five thousand (25,000) gallons per year. The definition includes a public tasting room and retail sales of spirits or related products manufactured on site.
E.
"District" means a territory delineated on the zoning map of Savoy, Illinois, for which the regulations and restrictions of this title governing the use of land and buildings, the height of buildings, the size and location of yards, the intensity of use of land and buildings, and the off-street parking facilities are uniform.
F.
"Drive through facility" means an accessory facility where goods or services may be obtained by motorists without leaving their vehicles. These facilities include drive-through bank teller windows, dry cleaners, fast-food restaurants, drive-through coffee, photo stores, pharmacies, automated teller machines (ATMs), etc. It does not include: gas stations or other vehicle services.
G.
"Dry cleaner, processing on-site" means a building in which the business of dry cleaning, dry dyeing, cleaning, spotting, stain removal and/or pressing of articles and/or goods of fabric is carried on, and in which only noncombustible and nonflammable solvents are, or can be, used which emit no odors or fumes, in which no noise or vibration causes a nuisance or inconvenience within or without the premises, and may include a dry cleaning distribution station.
H.
"Dwelling" means one or more rooms designed to accommodate one-family and containing only one kitchen plus living, sanitary, and sleeping facilities
I.
"Dwelling, above ground floor only" means one unit or more located above a ground floor nonresidential use. The separate uses do not have to be inhabited by the same party.
J.
"Dwelling, cottage court" means a group of small-scale, detached dwelling units located on a single lot or individual lots and arranged around a shared court visible from the street.
K.
"Dwelling, duplex" means a building with two dwelling units, each located on their own lot or on the same lot and that share a wall along the interior side lot line.
L.
"Dwelling, townhome" means a building with attached dwelling units, each located on their own lot and that share a wall(s) with the adjacent unit(s) along the interior side lot line.
M.
"Dwelling, multiple-family" means a dwelling used exclusively for a residence by two or more families.
N.
"Dwelling, multi-unit residential" refers to the use categories of multi-unit buildings with five or more units and multi-unit building complexes.
O.
"Dwelling, quadplex" means a building designed as a single structure, containing four separate living and dwelling units, each of which is designed to be occupied as a separate permanent residence for one household.
P.
"Dwelling, triplex" means a building designed as a single structure, containing three separate living and dwelling units, each of which is designed to be occupied as a separate permanent residence for one household.
Q.
"Dwelling unit" means a room or group of rooms, within a structure designated and equipped for use as living quarters by one-family, including provisions for living, bathing, sleeping, cooking and eating.

A.
"Easement" means a grant by the property owner of either the permanent or temporary use of an area of land to the public, a corporation, or person(s), for specified uses and purposes to be designated as a "public" or "private" easement depending upon the nature of its use.
B.
"Electric vehicle charging station" means the equipment for charging electric-powered vehicles and the space on a site designated for its use.
C.
"Essential nexus" means a direct connection between public health, safety, comfort, and welfare and a condition or exaction placed on a zoning or land use proposal.
D.
"Exaction" means a fee, dedication of land, or other condition imposed on a property owner or developer in connection with the approval of a development proposal.
E.
"Extraterritorial jurisdiction" means the unincorporated area within one and one-half miles of a fourth-class city or a village and within three miles of all other cities. Wherever such statutory extraterritorial powers overlap with those of another city or village, the jurisdiction over the overlapping area shall be divided on a line all points of which are equidistant from the boundaries of each community so that not more than one community exercises extraterritorial powers over any area, unless otherwise determined by a boundary agreement between the affected municipalities.

A.
"Family" means a person living alone or two or more people living together as a single household. For the purposes of definition, "family" shall not include more than five people unrelated to each other by blood, marriage, or adoption.
B.
"Farm" means a tract of land of at least five acres in size used for the growing and storage of agricultural products such as grain, vegetables and fruit, as well as for the raising thereon of farm animals such as horses, cattle, sheep and swine. The term includes the utilization of such land for one or more of the above uses including dairy farms with the necessary operations for treating or storing the produce, provided however, that the operation of any such accessory uses shall be secondary to that of farming activities. Any tract on which the principal use is the raising of fur-bearing animals such as mink, muskrats, rabbits, etc., shall not be considered a farm. A commercial feed lot shall not be considered a farm. Residential structures occupied by persons primarily engaged in farming are included in the term "farming"; however, there shall not be more than three single-family dwellings on any one farm.
C.
"Farmers market" means a common facility or area where the primary purpose is for growers and producers to gather to sell a variety of fresh fruits and vegetables and other locally produced farm and food products directly to consumers.
D.
"Firearms retailer" means a business that derives its principal income from the purchase, sale, or trade of firearms, with or without sale of ammunition or firearms accessories; and either physically delivers firearms to purchasers on the premises or conducts firearms sales from the premises for delivery to offsite purchasers; and is required to possess a firearms dealer license under federal law.
E.
"Food truck" means a readily movable wheeled structure, motorized vehicle, towed vehicle, trailer, or cart that is equipped and operated for the purpose of vending food and/or drink.
F.
"Food truck, court" means a permanent site for the location of multiple food carts or trucks simultaneously.
G.
Fuel sales" means any building or portion thereof or premises used for dispensing or offering for sale at retail any automobile fuels or oils; having pumps and storage tanks; also, where battery, tire and other similar services are rendered, but only if rendered wholly within lot lines. Excluded are open sales lots, parking, storing and sale of automobiles or any other commodity not incidental to fuel sales.
H.
Funeral homes" establishments for preparing the dead for burial or internment and conducting funerals (i.e. providing facilities for wakes, arranging transportation for the dead, indoor stonecutting, and selling caskets and related merchandise). Funeral homes may include accessory crematoriums.

A.
"Garage" means an accessory building designed for the storage of an automobile or automobiles belonging to the occupants of a dwelling or apartment situated on the lot upon which the garage is located.
B.
"Garden, accessory" means an exterior area for the small-scale production of vegetables and flowering plants for personal or small commercial use. This definition includes community and private gardens. This definition does not include crop production and nurseries.
C.
"General retail" means the sale of any product or merchandise to customers for their own personal consumption or use, not for resale.
D.
"Group home" means a dwelling under state license or certification or contract to provide supervision, food, lodging and other services to a service dependent population as herein defined, living and cooking together as a single cooperative household unit, consisting of a basic group of members of a service dependent population and additional staff persons providing supervision of service to the basic group, as specified in the aforesaid licensing, certification or contract regulations.

A.
"Home-based daycare" means any in-house childcare service licensed by the State Department of Children and Family Services (DCFS) which regularly provides care for less than twenty-four (24) hours per day for more than three and up to a maximum of twelve (12) children under the age of twelve (12) in a home. The term does not include facilities which receive only children from a single household, 225 ILCS 10/2.09.
B.
"Home occupation" means a legal trade, occupation or profession conducted by any person within or from a dwelling unit that is clearly incidental and secondary to the premises as a dwelling unit. The home occupation shall be clearly incidental and accessory to the use of the dwelling as a residence and shall not change the physical characteristics of the residence as a home.
C.
"Hospital" means an institution where sick or injured patients are given medical treatment.
D.
"Hotel" means a facility containing six or more guest rooms that are rented to occupants on a daily basis. Hotels may offer food services, convention hosting services, laundry services, and/or entertainment and recreation activities. This definition shall not include bed and breakfast establishments or short-term rentals.

A.
"Industry, heavy" means a nonresidential use that requires a National Pollutant Discharge Elimination System (NPDES) permit for an industrial or stormwater discharge; or that involves the use or storage of any hazardous materials or substances; or that is used for the purpose of manufacturing, assembling, finishing, cleaning, or developing any product or commodity; or that involves the mining or extraction of any minerals, ore, fossil fuels, or other materials from beneath the surface of the earth. Structures house complex operations, some of which might be continuous (operated twenty-four (24) hours a day, seven days a week).
B.
"Industry, light" means a nonresidential use that involves the manufacturing, assembling, finishing, cleaning, or developing any product or commodity. Facilities are typically designed to look and generate impacts like a typical office building, but rely on special power, water, or waste disposal systems for operation. Noise, odor, dust, and glare of each operation are completely confined within an enclosed building, insofar as practical. This includes medical and testing laboratories.

A.
"Laundry, self-service" means a facility where patrons wash, dry or dry clean clothing or other fabrics in machines operated by the patron. The term "self-service laundry" may include establishments, which provide services to wash, dry or dry clean on an individual basis, but specifically excludes commercial laundry services.
B.
"Laundry, commercial" means a facility, which provides laundry and dry cleaning, services for commercial and industrial businesses but does not provide self-service or laundry services for individual needs.
C.
"Live-work unit" means an attached residential building type with a small commercial enterprise on the ground floor and a residential unit above or behind with a common tenant in both spaces.
D.
"Lot, corner" means a lot located at the intersection of two or more streets., where the corner interior angle formed by the intersection of the two streets is one hundred thirty-five (135) degrees.
E.
"Lot, irregularly shaped" means a lot of such a shape or configuration that technically meets the area, frontage, and width to depth requirements of this title but meets these requirements by incorporating unusual elongations, angles, curvilinear lines unrelated to topography or other natural land features.
F.
"Lot line" means the line bounding a lot. Also referred to as a "property line."
G.
"Lot line, exterior" means a side lot line separating a corner lot from a street.
H.
"Lot line, front" means the property line dividing a lot from a street. In the case of multiple street frontages, the shortest in length shall be the front lot line. However, a lot may have more than one required front yard.
I.
"Lot line, interior" means a side lot line which abuts another lot or lots.
J.
"Lot line, rear" means the lot line further from and roughly parallel to the front lot line.
K.
"Lot line, side" means any lot line other than a front or rear lot line.
L.
"Lot of record" means a lot which is part of a subdivision, the map of which has been recorded in the office of the recorder of Champaign County, or a parcel of land, the deed of which was of record as of the effective date of the ordinance codified in this title.
M.
"Lot width" means for regularly shaped lots, the average distance between the side lot lines, measured at right angles to the depth of the lot; for irregularly shaped or wedge-shaped lots, lot width shall be measured at the front yard setback line.

A.
"Manual of practice" means the "Village of Savoy Manual of Practice," a technical document, the current version of which that is an integral part of this title and which is incorporated into the requirements of this title by reference. The purpose of the manual of practice is to establish the design, material, and construction standards for improvements required for developments, as amended.
B.
"Manufactured housing" means a residential structure that is transportable in one or more sections. In traveling mode, it is eight feet or more in width or forty (40) feet or more in length. A manufactured home is designed and constructed to the Federal Manufactured Construction and Safety Standards and is so labeled. When erected on site, the home is at least three hundred twenty (320) square feet, built and remains on a permanent chassis, designed to be used as a dwelling with a permanent foundation built to FHA criteria. The structure must be designed for occupancy as a principal residence by a single-family.
C.
"Materials salvage yard/recycling operations" means a parcel of land where secondhand, discarded or scrap materials are bought, sold, exchanged, stored, processed, or handled. Materials include scrap iron, structural steel, rags, rubber tires, discarded goods, equipment, appliances, or machinery. The term "material salvage yard, recycling operations" also includes a site for collection, sorting, storing and processing of paper products, glass, plastics, aluminum or tin cans prior to shipment for remanufacture into new materials.
D.
"Mechanical unit" means electrical, heating, ventilation, plumbing, and air conditioning equipment and other service facilities.
E.
"Medical clinic" means a facility for examining, consulting with, and treating patients with medical, dental, or optical problems on an outpatient basis.
F.
"Microbrewery/microwinery" means a combination retail, wholesale, and/or small-scale artisan manufacturing business that brews, ferments, processes, packages, distributes, and serves either beer or wine for sale on- or off-site. A microbrewery shall produce no more than one-hundred fifty-five thousand (155,000) gallons of beer per year for sale on the premises for either on-premises or off-premises consumption. These facilities may include an ancillary tasting room and retail component in which guests/customers may sample and purchase the product. Off-site distribution of the beverages shall be consistent with state law.
G.
"Microdistillery" means a small scale artisan manufacturing business that blends, ferments, processes, packages, distributes and serves alcoholic spirits on and off the premises and produces no more than fifteen thousand (15,000) gallons per calendar year on-site. The microdistillery facility may include an ancillary tasting room and retail component in which guests/customers may sample and purchase the product. Off-site distribution of the alcoholic beverages shall be consistent with state law.
H.
"Mini-warehouse/personal storage" means enclosed storage facilities containing independent, fully enclosed bays that are leased to individuals exclusively for long-term storage of household goods or personal property.
I.
"Mobile home" means a vehicle designed or intended for residential purposes and having no foundation other than wheels, blocks, skids, jacks, horses or skirting. When a mobile home has been altered to remove the wheels, undercarriage, tongue, and other facilities normally used for the transportation of the vehicle and is attached to the ground by a permanent foundation, it shall be deemed to be a building.
J.
"Mobile home park" means a lot or tract which has been planned and improved for the placement of mobile homes for residential use, with single control or ownership.
K.
"Motel" means a building or group of related buildings in which lodging is provided or offered for compensation to transient guests customarily traveling by automobile.
L.
"Motor vehicle sales/rental, without outdoor sales lot" means retail establishments that sell new or used automobiles, truck, vans, recreational vehicles, trailers, boats, or motorcycles or other similar motorized transportation vehicles, however, no areas for the storage of inventory or display of vehicles for sale may be stored outside an enclosed building on the site; all such activities shall be conducted within an enclosed building only. Support uses may also exist upon also exist upon the same site, such as maintenance, repair, and service areas and indoor parts storage areas, however all such uses shall be conducted entirely within an enclosed building.
M.
"Motor vehicle sales/rental, with outdoor sales lot" means retail establishments that sell new or used automobiles, truck, vans, recreational vehicles, trailers, boats, or motorcycles or other similar motorized transportation vehicles, which may include the storage of inventory or display of vehicles for sale outside an enclosed building. Support uses may also exist upon also exist upon the same site, such as maintenance, repair, and service areas and indoor parts storage areas, however all such uses shall be conducted entirely within an enclosed building.
N.
"Multi-unit building complex" means a planned residential development with more than two multi-family dwelling buildings on a lot.

A.
"Nonconforming use" means any use of a building or land which lawfully existed prior to the time this title became effective but no longer conforms with the use regulations of the district in which it is situated. The term also includes any use of a building or land which is changed from conforming to nonconforming by virtue of a subsequent amendment of this title.
B.
"Nursery and garden center" means a facility for the cultivation of plants within an enclosed environment on a commercial basis.

A.
"Office" means a room or suite of rooms used for the practice of a profession or for the conduct of a business which does not involve the sale of goods from the premises. The term does not include a personal service shop. If goods or merchandise are sold for delivery on or from the premises in a manner other than incidental to the principal office use, then the premises shall be considered to be a store rather than an office.
B.
"Open space" means the portion of ground level area of a lot which is unobstructed from the ground level upwards, and which meets the following criteria, except as provided in Subsection 5. below. Required yards meeting the criteria below may be included in calculation of open space.
1.
It has a minimum length or width of fifteen (15) feet;
2.
At least fifty percent (50%) of such area is provided as lawns, live plantings, and other permeable ground cover;
3.
No more than fifty percent (50%) of such area is covered by paving for sidewalks, leisure and recreational areas such as patios, tennis courts and swimming pools;
4.
No part of such area is used for parking, drives, storage or loading areas;
5.
For residential uses, at least seventy-five percent (75%) of such area shall be accessible to and for the use of all residents of the building. In the case of a residential building where all units open directly onto open space at ground level, up to seventy-five percent (75%) of such required open area may be divided, as equally as practicable, among all the dwelling units as private open space, provided that each unit shall have at least one hundred fifty (150) square feet with a minimum length or width of nine feet.
C.
"Outdoor display/sale of merchandise, accessory" means the permanent display and/or sale of merchandise or equipment outside of an enclosed building by the occupant of the primary building of the lot.
D.
"Outdoor display/sale of merchandise, temporary" means the temporary display and/or sale of merchandise or equipment outside of an enclosed building by the occupant of the primary building of the lot.
E.
"Outdoor seating for eating and drinking uses" means a dining area of designated size with seats or tables located outdoors of a contiguous restaurant or coffeehouse. This seating may be in addition to the indoor seating area.
F.
"Outdoor storage yard" means the storage of various materials outside of a structure, as an accessory use. This includes salvage yards used for the storage and/or collection of any type of equipment.
G.
"Outdoor display/sale of merchandise, temporary" means the sale of goods and products outside of a permanent structure that are clearly related to the function contained in that structure. This includes, but is not limited to, landscape materials, lawn, and garden supplies, and produce.

A.
"Park" means an area of open space that is maintained in its natural condition or improved for outdoor recreation purposes.
B.
"Parking lot" means a tract of land which is used for the storage of motor vehicles, which is not accessory to any other use on the same or any other lot, and which contains parking spaces which are either free or rented to the general public.
C.
"Parking of trailer, boards, and other vehicles, temporary" means a site intended for the parking of trailers, boats, and other vehicles.
D.
"Parking space" means a space on a lot permanently reserved for the temporary storage of one automobile.
E.
"Patio" means a paved or all-weather surfaced, at grade, courtyard adjoining a dwelling which is used for dining, barbecuing, lounging, or similar recreational purposes.
F.
"Pawn shop" means a facility for loaning money on the security of personal property and the sale of unclaimed property.
G.
"Permitted use" means any use of a building or land which is included in the list of permitted uses in the district in which the building or land is situated.
H.
"Personal services" means personal service uses include, but are not limited, to a barbershop or beauty shop, shoe repair, a tailor, an instructional arts studio, a photographic studio, a laundry or cleaning pickup and receiving station, a handcrafted artwork studio, a travel bureau, and custom printing or duplicating shop.
I.
"Place of worship" means any church, synagogue, mosque, temple or building used primarily for religious worship and related religious activities.
J.
"Planned unit development" means an area for which a comprehensive unitary plan has been prepared for the use and development of a tract as one integrated planned area. The plan should indicate, among other things, such features as the following: land uses, open space allocations, on-site circulation for both pedestrians and automobiles, parking, setbacks, housing densities, building spaces, land coverage, landscaping, relationships with adjoining areas and streets, building heights, accessory uses, storm water control and architectural treatment.
K.
"Plat, preliminary" means a plat and supporting data, indicating the proposed layout of a subdivision or development and all of its phases, in sufficient detail to provide adequate basis for review by the village, and meeting the requirements of this title. A preliminary plat establishes the basic developmental and conceptual design concepts and public improvements required to be approved through the final plat process. See the manual of practice for detailed preliminary plat requirements.
L.
"Pop-up business" means a retail or restaurant use established on a temporary basis in an existing commercial building.
M.
"Porch" means a enclosed, ground-level or first-story platform supported from the ground and extending out from the main portion of the building. Porches are commonly roofed and may be open to the weather in part.
N.
"Professional service" means an activity conducted in an office setting and generally focusing on business, professional, or technical services that make available the knowledge and skills of employees to others. Examples include advertising, communications/media production, counseling, data analysis, design, insurance, legal, not-for-profit organizations, and real estate services.
O.
"Primary entrance" means an entry point into a building which faces a street or public right-of-way and is of greatest importance relative to other building entrances. The primary entrance typically faces the street on which the building is addressed.
P.
"Primary residence." As applied to the operation of short-term rentals, a residence shall be considered to be the property owner's or leaseholder's primary residence if the property owner or leaseholder resides there for at least seven months out of each calendar year.
Q.
"Principal building" means a building in which the principal use of the lot is conducted.
R.
"Principal use" means the main use of a lot or buildings as distinguished from a subordinate or accessory use.
S.
"Public cultural and community facility" means a public facility for the development, production, and presentation of the visual and performing arts, including live theater, dance, music, painting, sculpture, and crafts.
T.
"Public service/safety facility" means facilities for federal, state, and local governmental uses, law enforcement, and fire protection agencies, and their accessory uses including office space, temporary holding cells, equipment and evidence storage facilities, training facilities, and vehicle garages. This definition is not intended to be inclusive of vehicle impoundment lots or Correctional Institution.
U.
"Public utility facilities" means area dedicated to public use for utility purposes, including transmission and collection lines, pumping stations, elevated water storage tanks, water and wastewater package treatment plants, and generation, production, or treatment facilities such as power plants, water and sewage plants.

A.
"Real estate sales, temporary" means a short-term office use for the on-site sale of real property.
B.
"Research and development" means facilities for basic and applied laboratory research or experimental study, testing or analysis in the natural sciences, including educational activities incidental or accessory to such research. The term "research and development" shall include, but not be limited to, biotechnology, pharmaceuticals, genetics, plastics, polymers, resins, coatings, fibers, fabrics, films, heat transfers, and radiation research, but not facilities for the manufacture or sale of products, except those incidental to research activities.
C.
"Residence" means a dwelling used primarily to house a family or families. Buildings having a principal use that is commercial, industrial or public in nature shall not be considered residences.
D.
"Restaurant" means an establishment without drive-in or drive-through service means an establishment principally for the sale and consumption of food.
E.
"Replacement value" means the replacement value of a building or structure shall be based either on a sale within the previous year; an appraisal within the last two years; or the amount for which the structure or building was insured prior to the date of the damage or destruction.
F.
"Retail" means a store in which goods are sold for delivery on or from the premises to the ultimate consumer. If eighty percent (80%) or more of the annual dollar volume of the sales tax made from a store are subject to the Illinois Retailers Occupation Tax, the store shall be considered to be a retail store.
G.
"Right-of-way" means the area on, below, or above a public street, sidewalk, alley, parkway, or utility easement legally dedicated for public circulation and service.
H.
"Rooming house" means a building in which lodging and meals are regularly provided or offered for compensation to three or more persons by pre-arrangement and for definite periods of time, but which is not open to transient guests. The term shall include residence clubs.
I.
"Rough proportionality" means a corresponding relationship between the impact of a proposed development and the degree of exaction placed on that development.

A.
"School, public/private" means a public or private institution for education or learning, including athletic or recreational facilities, which does not include lodging. This institution includes any school licensed by the state that meets the state requirements for education.
B.
"School, vocational/technical" means a public or private institution for education or learning including athletic or recreational facilities, which does not include lodging. These schools offer vocational and technical training in a variety of technical subjects and trades. Training may lead to job-specific certification.
C.
"Seasonal sales" means temporary outdoor sales, typically recurring on an annual basis, located on a lot with a principal use for which the seasonal sales are not associated.
D.
"Senior housing, dependent" means housing/accommodations, other than a single-family dwelling, and services designed and staffed to provide housing and services along the continuum of an elderly person's needs, such as assistance for bathing, dressing, medication, meal preparation, or other functions. In addition to housing, this type of facility may also provide convenience services, such as meals, housekeeping, transportation, and community facilities, such as central dining rooms and activity rooms.
E.
"Senior housing, independent" means a facility which provides sleeping accommodations in the form of assisted living units, to persons fifty-five (55) years of age and older. Assistance with daily life activities and supportive and intermittent health related services shall be provided by a full-time on-site staff. An assisted living facility is not subject to licensure by the State of Illinois. An assisted living facility has both institutional and residential characteristics. An assisted living facility is not a multiple-family dwelling.
F.
"Shooting range, indoor" means a totally enclosed facility designed to offer a controlled shooting environment that includes impenetrable walls, floor and ceiling, adequate ventilation and lighting systems, and acoustical treatment for sound attenuation suitable for the type and caliber of weapons approved for use at the facility.
G.
"Shooting range, outdoor" means a facility where individuals may discharge firearms in a controlled setting for the purpose of target, trap, or skeet shooting.
H.
"Short-term rental" means a dwelling unit, or portion thereof, that is leased for periods of less than thirty (30) days per occurrence.
I.
"Single-family dwelling" means a dwelling used exclusively for the residence of one-family.
J.
"Solar energy collection system, canopy" means a solar energy collection system consisting of elevated solar panels installed above parking lots, carports, and other paved areas.
K.
"Solar energy collection system, ground mounted" means a solar energy collection system and associated mounting hardware that is affixed to or placed upon the ground including, but not limited to fixed, passive, or active tracking racking systems and located on a site with a primary use.
L.
"Solar energy collection system, roof mounted" means a solar energy collection system that is structurally mounted to the roof of a building or other permitted structure, including limited accessory equipment associated with system which may be ground mounted.
M.
"Solar farm" means a series of solar energy collection systems and associated mounting hardware that are affixed to or placed upon the ground including, but not limited to fixed, passive, or active tracking racking systems and located on a site with no other principal use. Definition includes appurtenant office, utility, storage, and other required structures.
N.
"Small cell wireless facilities" means any facility that transmits and/or receives signals by electromagnetic or optical means, including antennas, microwave dishes, horns, or similar types of equipment, towers or similar structures supporting such equipment, and equipment buildings.
O.
"Storage/distribution warehouse" means a facility for the inside storage and distribution of items.
P.
"Story" means that portion of a building between the surface of a floor and the surface of the floor next above it or, if there is no floor above it, then that portion between the surface of the floor and the ceiling next above it.
Q.
"Street" means a roadway which is either: a) within the boundaries of a public right-of-way; or b) located on private property within a PUD, or within a mobile home park, or upon which all lots that front on it meet current minimum lot width requirements; which is constructed in accordance with this title and which affords the principal means of access to abutting property. A street may also be referred to as an avenue, boulevard, circle, court, drive, highway, lane, parkway, way, place, road, thoroughfare, or other appropriate name. An alley is not a street. The functional classification of streets into a network of arterials, collectors, and local streets is determined by the Illinois Department of Transportation (IDOT) in coordination with the Champaign-Urbana Urbanized Area Transportation Study (CUUATS). For purposes of this title, the following represent functional classifications and types of streets:
1.
"Arterial street" is defined by the IDOT Bureau of Local Roads (BLRS) Manual, Section 27-3.02 as "generally characterized by [its] ability to quickly move relatively large volumes of traffic, but often with restricted accessibility to abutting properties. The arterial system provides for high travel speeds and the longest trip movements. The rural and urban arterial systems are connected to provide continuous through movements at approximately the same level of service (LOS)."
2.
"Collector street" is defined by the IDOT BLRS Manual, Section 27-3.02 as "characterized by a relatively even distribution of access and mobility functions. Traffic volumes and speeds are typically lower than those of arterials."
3.
"Cul-de-sac street" means a local street with only one outlet that terminates in a vehicular turnaround, having an appropriate terminal for the safe and convenient reversal of traffic movement.
4.
"Local street" is defined by the IDOT BLRS Manual, Section 27-3.02 as any public street "not classified as arterials or collectors" and/or "The many points of direct access to adjacent properties characterize local streets," and/or "streets where speeds and volumes are usually low and trip distances short."
5.
"Private street" means a street not located within a public right-of-way and not publicly owned or maintained.
6.
"Stub street" means a street right-of-way or improvement that terminates at the boundary of a development and is expected to continue through abutting property in its subsequent future development.
R.
"Street, perimeter" means any existing street to which a parcel abuts on one or more sides.
S.
"Street, primary" means the perimeter street on which the lot is addressed, or the perimeter street facing the primary entrance of a building on the lot. On a corner lot, if the primary entrance does not face the street on which the building is addressed, the perimeter street facing the primary entrance shall be considered the primary street. A building with multiple primary entrances shall be considered to have multiple primary streets.
T.
"Street, primary internal" means a private main road that provides access within the immediate site and may be extended to provide access to the adjacent parcels.
U.
"Street, secondary" means the perimeter street(s) of a corner lot not determined to be the primary street.
V.
"Street, secondary internal" means a private road within a site that supports internal circulation and provides access to specific areas or uses. It does not typically connect to adjacent parcels, serving instead as a subordinate route for internal connectivity.
W.
"Structural alteration" means any change in the bearing walls, columns, beams, girders or other supporting members of a building.
X.
"Structure" means anything which is constructed or built and has a permanent location on or in the ground, is attached to the ground, or is attached to something having a permanent location on the ground.
Y.
"Structure, attached" means a structure which is connected to another structure.
Z.
"Structure, detached" means a structure which is not connected to another structure.

"Use" means the specific purpose for which land, a structure or premises is designed, arranged, intended or for which it is or may be occupied or maintained.

"Value" means the full, fair, cash market value.
B.
"Vehicle services—Major repair/body work" means the repair, servicing, alteration, restoration, towing, painting, cleaning, or finishing of automobiles, trucks, recreational vehicles, boats, large appliances, commercial and industrial equipment, and other vehicles as a primary use, including the incidental wholesale and retail sale of vehicle parts as an accessory use. This includes major repair and body work which encompasses towing, collision repair, other body work and painting services, and tire recapping.
C.
"Vehicle services—Minor maintenance/repair" means the repair, servicing, alteration, restoration, towing painting, cleaning, or finishing of automobiles, trucks, recreational vehicles, boats, and other vehicles as a primary use, including the incidental wholesale and retail sale of vehicle parts as an accessory use. Minor facilities providing limited repair and maintenance services. Examples include car stereo and alarm system installers; detailing services; muffler and radiator shops; quick-lube services; tire and battery sales and installation (not including recapping).
D.
"Video gaming café" means an establishment whose primary or major focus is video gaming as authorized by the Video Gaming Act (230 ILCS 40/1 et seq.) and the service of alcohol and food is incidental to the operation of video gaming.

A.
"Warehouse, distribution/storage" means structures, or part thereof, or area used principally for the storage or distribution of goods and merchandise to retailers, nonresidential users, or to other wholesalers.
B.
"Wireless telecommunications equipment" means any equipment used for the purpose of collecting or transmitting electromagnetic signals, or to provide immediate support to such equipment or structure.
C.
"Wireless telecommunications, tower" means any type of tower structure or similar that is built for the sole or primary purpose of supporting any FCC-licensed or authorized antennas and their associated facilities, including structures that are constructed for wireless communications services including, but not limited to, private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul, and the associated site.
D.
"Winery" means an establishment primarily engaged in the brewing of ale, beer, malt liquors, and/or nonalcoholic beer that are permitted to do so in accordance with the liquor control commission. Wineries shall have a capacity of fifteen thousand (15,000) barrels or more per year. The definition includes a public tasting room, and retails sales of ale, beer, spirits, or related products brewed or manufactured on site.

"Yard." That portion of a lot which adjoins or surrounds a building.
1.
"Front yard." That portion of a lot between the principal building on a lot and the front lot line and extending across the entire front of the lot from side lot line to side lot line. On a corner lot, the front yard shall be the portion of the lot between the principal building on a lot and the lot line which abuts the primary street; where there are multiple primary streets, the lot shall be considered to have multiple front yards abutting each primary street. The mean horizontal distance between the front lot line and the front of the principal building or any projection therefrom, other than the projections permitted by Section 16.02.004, shall be used to determine the depth of a front yard. The term "required front yard" means the minimum front yard required by the applicable regulations of this title.
2.
"Rear yard." That portion of a lot between the main building on the lot and the rear lot line. On a corner lot the rear yard shall extend from the exterior side or front yard line to the interior side lot line. On all other lots the rear yard shall extend from side lot line to side lot line. The mean horizontal distance between the rear lot line and the rear of the main building or any projection therefrom, other than the projections Section 16.02.004, shall be used to determine the depth of a rear yard. The term "required rear yard" means the minimum rear yard required by the applicable regulations of this title.
3.
"Interior side yard." That portion of a lot between the main building on the lot and an interior side lot line. The interior side yard shall extend from the front yard line to the rear yard line. The mean horizontal distance between the side lot line and the side of the main building or any projection therefrom, other than the projections Section 16.02.004, shall be used to determine the width of a side yard. The term "required interior side yard" means the minimum interior side yard required by the applicable regulations of this title.
4.
"Exterior side yard." That portion of a corner lot between the main building on the lot and a side lot line adjacent to the secondary street. The exterior side yard shall extend from the front yard line to the rear lot line. The mean horizontal distance between the side lot line and the side of the main building or any projection therefrom, other than the projections Section 16.02.004, shall be used to determine the width of a side yard. The term "required exterior side yard" means the minimum exterior side yard required by the applicable regulations of this title.

"Zoning map" means a map that graphically shows all zoning district boundaries and classifications within the village, as contained within the UDO.

10 - DEFINITIONS
A.
Purpose. For the purpose of interpreting this UDO, certain words, concepts, and ideas are defined herein. Except as defined herein, all other words used in this UDO shall have their everyday meaning as determined by their dictionary definition.
B.
Applicability. The definitions established herein shall apply to the interpretation of all standards of this UDO unless otherwise specified.

A.
"Accessory structure" means a structure that is clearly incidental to and customarily found in connection with a principal structure, is located on the same parcel and serves a structure building, and is subordinate in area, extent and purpose to the principal structure. Accessory structures may include but are not limited to swimming pools, sheds, detached garages or carports, decks, patios, pergolas, and gazebos.
B.
"Accessory use" means a use subordinate to the principal use in terms of area, extent, and purpose that contributes to the comfort, convenience, or necessity of occupants of the principal building or principal use served and is located on the same lot as the principal use served.
C.
"Adjacent" means adjoining, bordering, touching or contiguous. If two lots are separated by a street, public alley or public walk, they shall not be deemed to be adjacent.
D.
"Adult oriented business" means any commercial use of property of which a significant or substantial portion involves an activity distinguished or characterized by its emphasis on matters depicting, describing or relating to specified sexual activities or specified anatomical areas, including, but not limited to, the operation of an adult bookstore and/or video store, adult mini-motion picture theater, adult motion picture theater, adult motion picture arcade, adult motel, adult card, gift or novelty store, or adult entertainment cabaret.
E.
"Airport" means any area of land or water designed and set aside for the landing and take-off of aircraft, including all necessary facilities for the housing and maintenance of air-craft.
F.
"Alcohol/liquor sales" means the retail sale of beer, wine, or other alcoholic beverages for off-premises consumption.
G.
"Alley" means a public or private thoroughfare that affords a secondary means of access to an abutting property.
H.
"Alteration" means any change in the bearing wall, columns, beams, girders or supporting member of a structure, any change or rearrangement in the floor area of a building, any enlargement of a structure whether by extending horizontally or by increasing in height, and/or any movement of a structure from one location or position to another.
I.
"Animal clinic, with outdoor runs" means a facility for the diagnosis, treatment, and hospitalization of animals, including, but not limited to dogs, cats, birds, and horses, that includes a specifically designed outdoor area that allows animals to run and play safely.
J.
"Animal clinic, without outdoor runs" means a facility for the diagnosis, treatment, and hospitalization of animals, including, but not limited to dogs, cats, birds, and horses, that does not include an outdoor area for animals to run and play.
K.
"Animal production" means an area which is used for the raising of animals and the development of animal products on a commercial basis. Typical uses include cattle and sheep ranching, dairy farming, fish farming, and the raising of poultry and swine.
L.
"Artisan manufacturing" means a fully indoor small-scale business that produces goods or specialty foods, primarily for direct sales to consumers, such as artisan leather, glass, wood, paper, ceramic, textile and yarn products, specialty foods and baked goods. This land use does not include uses producing noise, odor, vibration, or similar impacts perceivable by the natural senses outside of the structure or portion of the structure where the use is located. This land use includes the design, processing, fabrication, assembly, treatment and packaging of products; as well as the incidental storage, sales and distribution of such products.
M.
"Antenna" (attached to a building exterior wall) means a telecommunications device mounted on the exterior wall of a building or structure. It consists of a network of electrical conductors designed to efficiently transmit or receive electromagnetic waves or radio frequencies.

"Attention-getting device" means any flag, streamer, spinner, pennant, costumed character, light, balloon, continuous string of pennants, flags, or fringe, or similar device or ornamentation used primarily for the purpose of attracting attention for promotion or advertising a business or commercial activity which is visible by the general public from any public right-of-way or public area.
O.
"Automobile" means a self-propelled, free-moving vehicle for the conveyance of persons on a street and having a seating capacity for not more than ten (10) persons.

A.
"Bank, credit union, financial services" means establishment that engages in financial transactions that create, liquidate, or change ownership of financial assets. Banks, credit unions, and savings institutions may perform central banking functions, accept deposits, and lend funds from these deposits. In addition to banks and credit unions, financial services institutions may include: credit agencies, trust companies, holding companies, savings and loan institutions, check cashing services, securities/commodity contract brokers and dealers, security and commodity exchanges, vehicle finance (equity) leasing agencies, and investment companies.
B.
"Base district" means a base zoning district prescribes a basic set of uniform development regulations for a defined geographic area.
C.
"Bar/tavern" means an establishment principally for the sale and consumption of alcoholic beverages on the premises.
D.
"Bed and breakfast" means a one-family owner-occupied dwelling where short-term lodging is provided through the rental of individual rooms to the general public, with common cooking and dining facilities. A bed and breakfast is not a short-term rental as defined in this UDO.
E.
"Block" means an area of land generally bounded by streets or rights-of-way and occupied by or intended for buildings.
F.
"Brewery" means an establishment primarily engaged in the brewing of ale, beer, malt liquors, and/or nonalcoholic beer that are permitted to do so in accordance with the liquor control commission. Breweries shall have a capacity of fifteen thousand (15,000) barrels or more per year. The definition includes a public tasting room, and retails sales of ale, beer, spirits, or related products brewed or manufactured on site.
G.
"Buildable area" means the space remaining on a zoning lot after the minimum yard requirements of this title have been applied.
H.
"Building" means a structure enclosed within exterior walls and a roof which is used for the shelter of persons, animals, or property.
I.
"Building, attached" means a building having one or more walls in common with another building.
J.
"Building, detached" means a building having no walls in common with another building.
K.
"Building height" means vertical distance measured from the level of the public sidewalk, or the top of the curb if there is no sidewalk or the centerline of the road if there is no sidewalk and no curb, opposite the middle of the front of the building to the highest point of the roof.

L.
"Building material, machinery, and equipment sales or storage" means a facility primarily oriented to the receiving, holding, shipping, and/or sale of building material, machinery, and equipment for a single business or a single group of businesses. With the exception of loading and parking facilities, such land uses are contained entirely within an enclosed building. Examples of this land use include conventional warehouse facilities, long-term indoor storage facilities, and joint warehouse and storage facilities.

A.
"Carwash" means a facility for the washing or steam cleaning of passenger vehicles. A carwash may be:
1.
A single-unit type which has a single bay or a group of single bays with each bay to accommodate one vehicle only where a person uses a high-pressure hose to wash the vehicle by hand;
2.
An automated single-unit type which has a single bay to accommodate one vehicle at a time; or
3.
A tunnel unit type which allows washing of multiple vehicles in a tandem arrangement while moving through the structure.
B.
"Cemetery" means a place designated for burial of the dead.
C.
"Child/adult day care center" means a state licensed facility that provides less than twenty-four (24) hour care, training, education, custody, treatment, or supervision for persons who are unable to care for themselves and who are not related by blood, marriage, or adoption to the owner or operator of the facility, whether or not the facility is operated for profit or charges for the services it offers. This use does not include a facility that:
1.
Is accessory to a primary use, such as a shopping center, business, religious institution or other establishment, where individuals are cared for during short periods of time while parents or persons responsible for them are engaging in activities related to the primary use; or
2.
Operates solely for educational instruction to children in grades kindergarten through at least grade two, that does not provide custodial care for more than one hour during the hours before or after the customary school day.
D.
"Civic meeting facility" means not-for-profit membership organizations such as alumni associations, booster clubs, scouting organizations, ethnic associations, social clubs, fraternal lodges, and veterans' membership organizations primarily engaged in promoting the civic and social interests of their members. This use often includes meeting and storage facilities.
E.
"Clinic" means an establishment operated by one or more medical or dental practitioners, specializing in various branches of the medical or dental professions, for the purpose of studying and treating medical or dental patients.
F.
"College/university" means an institution for post-secondary education, public or private, offering courses in general or religious education and not operated for profit. It operates in buildings owned or leased by the institution for administrative and faculty offices, classrooms, laboratories, chapels, auditoriums, lecture halls, libraries, student and faculty centers, performing arts facilities, athletic facilities, health centers, dormitories, fraternities, sororities, and other on-campus housing, as well as associated maintenance facilities. It does not include vocational schools, online/remote programs, or colleges/universities operated for profit.
G.
"Commercial kitchen" means a facility containing a kitchen or kitchens in which food is prepared for off-site consumption, also called a ghost kitchen.
H.
"Common court" means a shared open space around which a group of related buildings is arranged.
I.
"Community garden" means an outdoor area, privately- or publicly-owned, operated or maintained, for cultivation of fruits, flowers, vegetables, or ornamental plants by more than one person or family. Community gardens may be divided into separate plots for cultivation by one or more individuals or may be maintained and cultivated collectively.
J.
"Community and economic development director" means the department head for the community and economic development department and ex officio zoning administrator as established in Chapter 2.17 of the village code. Where community and economic development director is referred to in this UDO, the term shall be interpreted to mean the community and economic development director or their designee.
K.
"Conforming use" means any use of a building or land which conforms with the use regulations of the district in which the building or land is situated. If the use is a permitted use but does not conform with relevant additional use regulations, it shall not be deemed to be a conforming use.
L.
"Construction, active" means the status in which surveying, construction, maintenance or utility activities is currently taking place.
M.
"Coworking space" means a neutral, nonexclusive, limited shared space defined in a membership-based service arrangement or agreement or subscription wherein a firm has no tenancy interest, leasehold estate, or other real property interest with respect to the accommodation on an as-needed basis. The agreement gives the firm a right to share the use of the space and may include an exclusive mailing address and office services. An executive suite/exclusive desk/dedicated desk/secured suite/private office under a coworking space agreement falls under this definition.
N.
"Crematorium" means a facility for the incineration of corpses, human or animal, to ashes. Crematorium does not include any establishment where incinerators are used to dispose of toxic, hazardous, infectious, or narcotic materials.
O.
"Crops and horticulture" means an area used for the raising or harvesting of agricultural crops such as wheat, field forage, and other plant crops intended to provide food or fiber.
P.
"Contractor shop" means an enclosed space used for the provision of services, storage, operation and housing of equipment and fabrication of building-related products.
Q.
"Contractor trailer" means a modular or portable office or storage structure for use by a contractor during construction activity.

A.
"Deck" means an attached or detached structure or platform which is not walled in or enclosed above a height of two and one-half feet. Open guardrails when required by the building code shall not be construed as a violation of the enclosed height limitation.
B.
"Developer" means the legal or beneficial owner or owners of any lot or any land included in a proposed development including the holder of an option or contract to purchase, or any person with beneficial interest in a land trust, or other persons having enforceable proprietary interest in such land, with the intent of developing the land, by making physical improvements to it by constructing or modifying roads, utility lines, and/or other infrastructure elements.
C.
"Development" means any activity causing a change to be made in the legal rights or physical state of a previously developed site or an unimproved tract of real estate, such that the proposed improvement activity satisfies one or more of the criteria listed herein:
1.
Requires a stormwater management plan; or
2.
Requires a sanitary sewer construction or operation permit from the Illinois Environmental Protection Agency (IEPA); or
3.
Requires a traffic impact analysis; or
4.
Constitutes any mining, quarrying, or other excavations related thereto; or
5.
Constitutes of the creation or a change to a subdivision or a re-subdivision or a lot-line adjustment; or
6.
Constitutes the creation of or a substantial change to a mobile home park; or
7.
Constitutes the creation of or substantial change to a planned unit development.
8.
The following activities are not considered to be development:
a.
The transfer of any existing building or use rights for use of a single individual parcel, as it then exists immediately prior to any sale or lease where such transfer or lease does not create any additional parcel by exception; or
b.
The dedication of land for public use to a public entity, the vacation of any land so dedicated, or the taking of property rights through eminent domain or inverse condemnation; or
c.
The construction of one single-family dwelling and/or farm-related structure on a single lot, or the creation or transfer of a single lot of ten (10) acres or more in size, except where such acreage or structures are at locations of future streets as designated in the village's comprehensive plan; or
d.
The maintenance or improvement of an existing public street or railroad by a public utility not involving redesign, if the work is carried out on land within the boundaries of the right-of-way.
D.
"Distillery" means an establishment primarily engaged in the manufacturing of fortified spirits that is permitted to do so in accordance with the liquor control commission. Distilleries shall have a capacity of more than twenty-five thousand (25,000) gallons per year. The definition includes a public tasting room and retail sales of spirits or related products manufactured on site.
E.
"District" means a territory delineated on the zoning map of Savoy, Illinois, for which the regulations and restrictions of this title governing the use of land and buildings, the height of buildings, the size and location of yards, the intensity of use of land and buildings, and the off-street parking facilities are uniform.
F.
"Drive through facility" means an accessory facility where goods or services may be obtained by motorists without leaving their vehicles. These facilities include drive-through bank teller windows, dry cleaners, fast-food restaurants, drive-through coffee, photo stores, pharmacies, automated teller machines (ATMs), etc. It does not include: gas stations or other vehicle services.
G.
"Dry cleaner, processing on-site" means a building in which the business of dry cleaning, dry dyeing, cleaning, spotting, stain removal and/or pressing of articles and/or goods of fabric is carried on, and in which only noncombustible and nonflammable solvents are, or can be, used which emit no odors or fumes, in which no noise or vibration causes a nuisance or inconvenience within or without the premises, and may include a dry cleaning distribution station.
H.
"Dwelling" means one or more rooms designed to accommodate one-family and containing only one kitchen plus living, sanitary, and sleeping facilities
I.
"Dwelling, above ground floor only" means one unit or more located above a ground floor nonresidential use. The separate uses do not have to be inhabited by the same party.
J.
"Dwelling, cottage court" means a group of small-scale, detached dwelling units located on a single lot or individual lots and arranged around a shared court visible from the street.
K.
"Dwelling, duplex" means a building with two dwelling units, each located on their own lot or on the same lot and that share a wall along the interior side lot line.
L.
"Dwelling, townhome" means a building with attached dwelling units, each located on their own lot and that share a wall(s) with the adjacent unit(s) along the interior side lot line.
M.
"Dwelling, multiple-family" means a dwelling used exclusively for a residence by two or more families.
N.
"Dwelling, multi-unit residential" refers to the use categories of multi-unit buildings with five or more units and multi-unit building complexes.
O.
"Dwelling, quadplex" means a building designed as a single structure, containing four separate living and dwelling units, each of which is designed to be occupied as a separate permanent residence for one household.
P.
"Dwelling, triplex" means a building designed as a single structure, containing three separate living and dwelling units, each of which is designed to be occupied as a separate permanent residence for one household.
Q.
"Dwelling unit" means a room or group of rooms, within a structure designated and equipped for use as living quarters by one-family, including provisions for living, bathing, sleeping, cooking and eating.

A.
"Easement" means a grant by the property owner of either the permanent or temporary use of an area of land to the public, a corporation, or person(s), for specified uses and purposes to be designated as a "public" or "private" easement depending upon the nature of its use.
B.
"Electric vehicle charging station" means the equipment for charging electric-powered vehicles and the space on a site designated for its use.
C.
"Essential nexus" means a direct connection between public health, safety, comfort, and welfare and a condition or exaction placed on a zoning or land use proposal.
D.
"Exaction" means a fee, dedication of land, or other condition imposed on a property owner or developer in connection with the approval of a development proposal.
E.
"Extraterritorial jurisdiction" means the unincorporated area within one and one-half miles of a fourth-class city or a village and within three miles of all other cities. Wherever such statutory extraterritorial powers overlap with those of another city or village, the jurisdiction over the overlapping area shall be divided on a line all points of which are equidistant from the boundaries of each community so that not more than one community exercises extraterritorial powers over any area, unless otherwise determined by a boundary agreement between the affected municipalities.

A.
"Family" means a person living alone or two or more people living together as a single household. For the purposes of definition, "family" shall not include more than five people unrelated to each other by blood, marriage, or adoption.
B.
"Farm" means a tract of land of at least five acres in size used for the growing and storage of agricultural products such as grain, vegetables and fruit, as well as for the raising thereon of farm animals such as horses, cattle, sheep and swine. The term includes the utilization of such land for one or more of the above uses including dairy farms with the necessary operations for treating or storing the produce, provided however, that the operation of any such accessory uses shall be secondary to that of farming activities. Any tract on which the principal use is the raising of fur-bearing animals such as mink, muskrats, rabbits, etc., shall not be considered a farm. A commercial feed lot shall not be considered a farm. Residential structures occupied by persons primarily engaged in farming are included in the term "farming"; however, there shall not be more than three single-family dwellings on any one farm.
C.
"Farmers market" means a common facility or area where the primary purpose is for growers and producers to gather to sell a variety of fresh fruits and vegetables and other locally produced farm and food products directly to consumers.
D.
"Firearms retailer" means a business that derives its principal income from the purchase, sale, or trade of firearms, with or without sale of ammunition or firearms accessories; and either physically delivers firearms to purchasers on the premises or conducts firearms sales from the premises for delivery to offsite purchasers; and is required to possess a firearms dealer license under federal law.
E.
"Food truck" means a readily movable wheeled structure, motorized vehicle, towed vehicle, trailer, or cart that is equipped and operated for the purpose of vending food and/or drink.
F.
"Food truck, court" means a permanent site for the location of multiple food carts or trucks simultaneously.
G.
Fuel sales" means any building or portion thereof or premises used for dispensing or offering for sale at retail any automobile fuels or oils; having pumps and storage tanks; also, where battery, tire and other similar services are rendered, but only if rendered wholly within lot lines. Excluded are open sales lots, parking, storing and sale of automobiles or any other commodity not incidental to fuel sales.
H.
Funeral homes" establishments for preparing the dead for burial or internment and conducting funerals (i.e. providing facilities for wakes, arranging transportation for the dead, indoor stonecutting, and selling caskets and related merchandise). Funeral homes may include accessory crematoriums.

A.
"Garage" means an accessory building designed for the storage of an automobile or automobiles belonging to the occupants of a dwelling or apartment situated on the lot upon which the garage is located.
B.
"Garden, accessory" means an exterior area for the small-scale production of vegetables and flowering plants for personal or small commercial use. This definition includes community and private gardens. This definition does not include crop production and nurseries.
C.
"General retail" means the sale of any product or merchandise to customers for their own personal consumption or use, not for resale.
D.
"Group home" means a dwelling under state license or certification or contract to provide supervision, food, lodging and other services to a service dependent population as herein defined, living and cooking together as a single cooperative household unit, consisting of a basic group of members of a service dependent population and additional staff persons providing supervision of service to the basic group, as specified in the aforesaid licensing, certification or contract regulations.

A.
"Home-based daycare" means any in-house childcare service licensed by the State Department of Children and Family Services (DCFS) which regularly provides care for less than twenty-four (24) hours per day for more than three and up to a maximum of twelve (12) children under the age of twelve (12) in a home. The term does not include facilities which receive only children from a single household, 225 ILCS 10/2.09.
B.
"Home occupation" means a legal trade, occupation or profession conducted by any person within or from a dwelling unit that is clearly incidental and secondary to the premises as a dwelling unit. The home occupation shall be clearly incidental and accessory to the use of the dwelling as a residence and shall not change the physical characteristics of the residence as a home.
C.
"Hospital" means an institution where sick or injured patients are given medical treatment.
D.
"Hotel" means a facility containing six or more guest rooms that are rented to occupants on a daily basis. Hotels may offer food services, convention hosting services, laundry services, and/or entertainment and recreation activities. This definition shall not include bed and breakfast establishments or short-term rentals.

A.
"Industry, heavy" means a nonresidential use that requires a National Pollutant Discharge Elimination System (NPDES) permit for an industrial or stormwater discharge; or that involves the use or storage of any hazardous materials or substances; or that is used for the purpose of manufacturing, assembling, finishing, cleaning, or developing any product or commodity; or that involves the mining or extraction of any minerals, ore, fossil fuels, or other materials from beneath the surface of the earth. Structures house complex operations, some of which might be continuous (operated twenty-four (24) hours a day, seven days a week).
B.
"Industry, light" means a nonresidential use that involves the manufacturing, assembling, finishing, cleaning, or developing any product or commodity. Facilities are typically designed to look and generate impacts like a typical office building, but rely on special power, water, or waste disposal systems for operation. Noise, odor, dust, and glare of each operation are completely confined within an enclosed building, insofar as practical. This includes medical and testing laboratories.

A.
"Laundry, self-service" means a facility where patrons wash, dry or dry clean clothing or other fabrics in machines operated by the patron. The term "self-service laundry" may include establishments, which provide services to wash, dry or dry clean on an individual basis, but specifically excludes commercial laundry services.
B.
"Laundry, commercial" means a facility, which provides laundry and dry cleaning, services for commercial and industrial businesses but does not provide self-service or laundry services for individual needs.
C.
"Live-work unit" means an attached residential building type with a small commercial enterprise on the ground floor and a residential unit above or behind with a common tenant in both spaces.
D.
"Lot, corner" means a lot located at the intersection of two or more streets., where the corner interior angle formed by the intersection of the two streets is one hundred thirty-five (135) degrees.
E.
"Lot, irregularly shaped" means a lot of such a shape or configuration that technically meets the area, frontage, and width to depth requirements of this title but meets these requirements by incorporating unusual elongations, angles, curvilinear lines unrelated to topography or other natural land features.
F.
"Lot line" means the line bounding a lot. Also referred to as a "property line."
G.
"Lot line, exterior" means a side lot line separating a corner lot from a street.
H.
"Lot line, front" means the property line dividing a lot from a street. In the case of multiple street frontages, the shortest in length shall be the front lot line. However, a lot may have more than one required front yard.
I.
"Lot line, interior" means a side lot line which abuts another lot or lots.
J.
"Lot line, rear" means the lot line further from and roughly parallel to the front lot line.
K.
"Lot line, side" means any lot line other than a front or rear lot line.
L.
"Lot of record" means a lot which is part of a subdivision, the map of which has been recorded in the office of the recorder of Champaign County, or a parcel of land, the deed of which was of record as of the effective date of the ordinance codified in this title.
M.
"Lot width" means for regularly shaped lots, the average distance between the side lot lines, measured at right angles to the depth of the lot; for irregularly shaped or wedge-shaped lots, lot width shall be measured at the front yard setback line.

A.
"Manual of practice" means the "Village of Savoy Manual of Practice," a technical document, the current version of which that is an integral part of this title and which is incorporated into the requirements of this title by reference. The purpose of the manual of practice is to establish the design, material, and construction standards for improvements required for developments, as amended.
B.
"Manufactured housing" means a residential structure that is transportable in one or more sections. In traveling mode, it is eight feet or more in width or forty (40) feet or more in length. A manufactured home is designed and constructed to the Federal Manufactured Construction and Safety Standards and is so labeled. When erected on site, the home is at least three hundred twenty (320) square feet, built and remains on a permanent chassis, designed to be used as a dwelling with a permanent foundation built to FHA criteria. The structure must be designed for occupancy as a principal residence by a single-family.
C.
"Materials salvage yard/recycling operations" means a parcel of land where secondhand, discarded or scrap materials are bought, sold, exchanged, stored, processed, or handled. Materials include scrap iron, structural steel, rags, rubber tires, discarded goods, equipment, appliances, or machinery. The term "material salvage yard, recycling operations" also includes a site for collection, sorting, storing and processing of paper products, glass, plastics, aluminum or tin cans prior to shipment for remanufacture into new materials.
D.
"Mechanical unit" means electrical, heating, ventilation, plumbing, and air conditioning equipment and other service facilities.
E.
"Medical clinic" means a facility for examining, consulting with, and treating patients with medical, dental, or optical problems on an outpatient basis.
F.
"Microbrewery/microwinery" means a combination retail, wholesale, and/or small-scale artisan manufacturing business that brews, ferments, processes, packages, distributes, and serves either beer or wine for sale on- or off-site. A microbrewery shall produce no more than one-hundred fifty-five thousand (155,000) gallons of beer per year for sale on the premises for either on-premises or off-premises consumption. These facilities may include an ancillary tasting room and retail component in which guests/customers may sample and purchase the product. Off-site distribution of the beverages shall be consistent with state law.
G.
"Microdistillery" means a small scale artisan manufacturing business that blends, ferments, processes, packages, distributes and serves alcoholic spirits on and off the premises and produces no more than fifteen thousand (15,000) gallons per calendar year on-site. The microdistillery facility may include an ancillary tasting room and retail component in which guests/customers may sample and purchase the product. Off-site distribution of the alcoholic beverages shall be consistent with state law.
H.
"Mini-warehouse/personal storage" means enclosed storage facilities containing independent, fully enclosed bays that are leased to individuals exclusively for long-term storage of household goods or personal property.
I.
"Mobile home" means a vehicle designed or intended for residential purposes and having no foundation other than wheels, blocks, skids, jacks, horses or skirting. When a mobile home has been altered to remove the wheels, undercarriage, tongue, and other facilities normally used for the transportation of the vehicle and is attached to the ground by a permanent foundation, it shall be deemed to be a building.
J.
"Mobile home park" means a lot or tract which has been planned and improved for the placement of mobile homes for residential use, with single control or ownership.
K.
"Motel" means a building or group of related buildings in which lodging is provided or offered for compensation to transient guests customarily traveling by automobile.
L.
"Motor vehicle sales/rental, without outdoor sales lot" means retail establishments that sell new or used automobiles, truck, vans, recreational vehicles, trailers, boats, or motorcycles or other similar motorized transportation vehicles, however, no areas for the storage of inventory or display of vehicles for sale may be stored outside an enclosed building on the site; all such activities shall be conducted within an enclosed building only. Support uses may also exist upon also exist upon the same site, such as maintenance, repair, and service areas and indoor parts storage areas, however all such uses shall be conducted entirely within an enclosed building.
M.
"Motor vehicle sales/rental, with outdoor sales lot" means retail establishments that sell new or used automobiles, truck, vans, recreational vehicles, trailers, boats, or motorcycles or other similar motorized transportation vehicles, which may include the storage of inventory or display of vehicles for sale outside an enclosed building. Support uses may also exist upon also exist upon the same site, such as maintenance, repair, and service areas and indoor parts storage areas, however all such uses shall be conducted entirely within an enclosed building.
N.
"Multi-unit building complex" means a planned residential development with more than two multi-family dwelling buildings on a lot.

A.
"Nonconforming use" means any use of a building or land which lawfully existed prior to the time this title became effective but no longer conforms with the use regulations of the district in which it is situated. The term also includes any use of a building or land which is changed from conforming to nonconforming by virtue of a subsequent amendment of this title.
B.
"Nursery and garden center" means a facility for the cultivation of plants within an enclosed environment on a commercial basis.

A.
"Office" means a room or suite of rooms used for the practice of a profession or for the conduct of a business which does not involve the sale of goods from the premises. The term does not include a personal service shop. If goods or merchandise are sold for delivery on or from the premises in a manner other than incidental to the principal office use, then the premises shall be considered to be a store rather than an office.
B.
"Open space" means the portion of ground level area of a lot which is unobstructed from the ground level upwards, and which meets the following criteria, except as provided in Subsection 5. below. Required yards meeting the criteria below may be included in calculation of open space.
1.
It has a minimum length or width of fifteen (15) feet;
2.
At least fifty percent (50%) of such area is provided as lawns, live plantings, and other permeable ground cover;
3.
No more than fifty percent (50%) of such area is covered by paving for sidewalks, leisure and recreational areas such as patios, tennis courts and swimming pools;
4.
No part of such area is used for parking, drives, storage or loading areas;

For residential uses, at least seventy-five percent (75%) of such area shall be accessible to and for the use of all residents of the building. In the case of a residential building where all units open directly onto open space at ground level, up to seventy-five percent (75%) of such required open area may be divided, as equally as practicable, among all the dwelling units as private open space, provided that each unit shall have at least one hundred fifty (150) square feet with a minimum length or width of nine feet.
C.
"Outdoor display/sale of merchandise, accessory" means the permanent display and/or sale of merchandise or equipment outside of an enclosed building by the occupant of the primary building of the lot.
D.
"Outdoor display/sale of merchandise, temporary" means the temporary display and/or sale of merchandise or equipment outside of an enclosed building by the occupant of the primary building of the lot.
E.
"Outdoor seating for eating and drinking uses" means a dining area of designated size with seats or tables located outdoors of a contiguous restaurant or coffeehouse. This seating may be in addition to the indoor seating area.
F.
"Outdoor storage yard" means the storage of various materials outside of a structure, as an accessory use. This includes salvage yards used for the storage and/or collection of any type of equipment.
G.
"Outdoor display/sale of merchandise, temporary" means the sale of goods and products outside of a permanent structure that are clearly related to the function contained in that structure. This includes, but is not limited to, landscape materials, lawn, and garden supplies, and produce.

A.
"Park" means an area of open space that is maintained in its natural condition or improved for outdoor recreation purposes.
B.
"Parking lot" means a tract of land which is used for the storage of motor vehicles, which is not accessory to any other use on the same or any other lot, and which contains parking spaces which are either free or rented to the general public.
C.
"Parking of trailer, boards, and other vehicles, temporary" means a site intended for the parking of trailers, boats, and other vehicles.
D.
"Parking space" means a space on a lot permanently reserved for the temporary storage of one automobile.
E.
"Patio" means a paved or all-weather surfaced, at grade, courtyard adjoining a dwelling which is used for dining, barbecuing, lounging, or similar recreational purposes.
F.
"Pawn shop" means a facility for loaning money on the security of personal property and the sale of unclaimed property.
G.
"Permitted use" means any use of a building or land which is included in the list of permitted uses in the district in which the building or land is situated.
H.
"Personal services" means personal service uses include, but are not limited, to a barbershop or beauty shop, shoe repair, a tailor, an instructional arts studio, a photographic studio, a laundry or cleaning pickup and receiving station, a handcrafted artwork studio, a travel bureau, and custom printing or duplicating shop.
I.
"Place of worship" means any church, synagogue, mosque, temple or building used primarily for religious worship and related religious activities.
J.
"Planned unit development" means an area for which a comprehensive unitary plan has been prepared for the use and development of a tract as one integrated planned area. The plan should indicate, among other things, such features as the following: land uses, open space allocations, on-site circulation for both pedestrians and automobiles, parking, setbacks, housing densities, building spaces, land coverage, landscaping, relationships with adjoining areas and streets, building heights, accessory uses, storm water control and architectural treatment.
K.
"Plat, preliminary" means a plat and supporting data, indicating the proposed layout of a subdivision or development and all of its phases, in sufficient detail to provide adequate basis for review by the village, and meeting the requirements of this title. A preliminary plat establishes the basic developmental and conceptual design concepts and public improvements required to be approved through the final plat process. See the manual of practice for detailed preliminary plat requirements.
L.
"Pop-up business" means a retail or restaurant use established on a temporary basis in an existing commercial building.
M.
"Porch" means a enclosed, ground-level or first-story platform supported from the ground and extending out from the main portion of the building. Porches are commonly roofed and may be open to the weather in part.
N.
"Professional service" means an activity conducted in an office setting and generally focusing on business, professional, or technical services that make available the knowledge and skills of employees to others. Examples include advertising, communications/media production, counseling, data analysis, design, insurance, legal, not-for-profit organizations, and real estate services.
O.
"Primary entrance" means an entry point into a building which faces a street or public right-of-way and is of greatest importance relative to other building entrances. The primary entrance typically faces the street on which the building is addressed.
P.
"Primary residence." As applied to the operation of short-term rentals, a residence shall be considered to be the property owner's or leaseholder's primary residence if the property owner or leaseholder resides there for at least seven months out of each calendar year.
Q.
"Principal building" means a building in which the principal use of the lot is conducted.
R.
"Principal use" means the main use of a lot or buildings as distinguished from a subordinate or accessory use.
S.
"Public cultural and community facility" means a public facility for the development, production, and presentation of the visual and performing arts, including live theater, dance, music, painting, sculpture, and crafts.
T.
"Public service/safety facility" means facilities for federal, state, and local governmental uses, law enforcement, and fire protection agencies, and their accessory uses including office space, temporary holding cells, equipment and evidence storage facilities, training facilities, and vehicle garages. This definition is not intended to be inclusive of vehicle impoundment lots or Correctional Institution.
U.
"Public utility facilities" means area dedicated to public use for utility purposes, including transmission and collection lines, pumping stations, elevated water storage tanks, water and wastewater package treatment plants, and generation, production, or treatment facilities such as power plants, water and sewage plants.

A.
"Real estate sales, temporary" means a short-term office use for the on-site sale of real property.
B.
"Research and development" means facilities for basic and applied laboratory research or experimental study, testing or analysis in the natural sciences, including educational activities incidental or accessory to such research. The term "research and development" shall include, but not be limited to, biotechnology, pharmaceuticals, genetics, plastics, polymers, resins, coatings, fibers, fabrics, films, heat transfers, and radiation research, but not facilities for the manufacture or sale of products, except those incidental to research activities.
C.
"Residence" means a dwelling used primarily to house a family or families. Buildings having a principal use that is commercial, industrial or public in nature shall not be considered residences.
D.
"Restaurant" means an establishment without drive-in or drive-through service means an establishment principally for the sale and consumption of food.
E.
"Replacement value" means the replacement value of a building or structure shall be based either on a sale within the previous year; an appraisal within the last two years; or the amount for which the structure or building was insured prior to the date of the damage or destruction.
F.
"Retail" means a store in which goods are sold for delivery on or from the premises to the ultimate consumer. If eighty percent (80%) or more of the annual dollar volume of the sales tax made from a store are subject to the Illinois Retailers Occupation Tax, the store shall be considered to be a retail store.
G.
"Right-of-way" means the area on, below, or above a public street, sidewalk, alley, parkway, or utility easement legally dedicated for public circulation and service.
H.
"Rooming house" means a building in which lodging and meals are regularly provided or offered for compensation to three or more persons by pre-arrangement and for definite periods of time, but which is not open to transient guests. The term shall include residence clubs.
I.
"Rough proportionality" means a corresponding relationship between the impact of a proposed development and the degree of exaction placed on that development.

A.
"School, public/private" means a public or private institution for education or learning, including athletic or recreational facilities, which does not include lodging. This institution includes any school licensed by the state that meets the state requirements for education.
B.
"School, vocational/technical" means a public or private institution for education or learning including athletic or recreational facilities, which does not include lodging. These schools offer vocational and technical training in a variety of technical subjects and trades. Training may lead to job-specific certification.
C.
"Seasonal sales" means temporary outdoor sales, typically recurring on an annual basis, located on a lot with a principal use for which the seasonal sales are not associated.
D.
"Senior housing, dependent" means housing/accommodations, other than a single-family dwelling, and services designed and staffed to provide housing and services along the continuum of an elderly person's needs, such as assistance for bathing, dressing, medication, meal preparation, or other functions. In addition to housing, this type of facility may also provide convenience services, such as meals, housekeeping, transportation, and community facilities, such as central dining rooms and activity rooms.
E.
"Senior housing, independent" means a facility which provides sleeping accommodations in the form of assisted living units, to persons fifty-five (55) years of age and older. Assistance with daily life activities and supportive and intermittent health related services shall be provided by a full-time on-site staff. An assisted living facility is not subject to licensure by the State of Illinois. An assisted living facility has both institutional and residential characteristics. An assisted living facility is not a multiple-family dwelling.
F.
"Shooting range, indoor" means a totally enclosed facility designed to offer a controlled shooting environment that includes impenetrable walls, floor and ceiling, adequate ventilation and lighting systems, and acoustical treatment for sound attenuation suitable for the type and caliber of weapons approved for use at the facility.
G.
"Shooting range, outdoor" means a facility where individuals may discharge firearms in a controlled setting for the purpose of target, trap, or skeet shooting.
H.
"Short-term rental" means a dwelling unit, or portion thereof, that is leased for periods of less than thirty (30) days per occurrence.
I.
"Single-family dwelling" means a dwelling used exclusively for the residence of one-family.
J.
"Solar energy collection system, canopy" means a solar energy collection system consisting of elevated solar panels installed above parking lots, carports, and other paved areas.
K.
"Solar energy collection system, ground mounted" means a solar energy collection system and associated mounting hardware that is affixed to or placed upon the ground including, but not limited to fixed, passive, or active tracking racking systems and located on a site with a primary use.
L.
"Solar energy collection system, roof mounted" means a solar energy collection system that is structurally mounted to the roof of a building or other permitted structure, including limited accessory equipment associated with system which may be ground mounted.
M.
"Solar farm" means a series of solar energy collection systems and associated mounting hardware that are affixed to or placed upon the ground including, but not limited to fixed, passive, or active tracking racking systems and located on a site with no other principal use. Definition includes appurtenant office, utility, storage, and other required structures.
N.
"Small cell wireless facilities" means any facility that transmits and/or receives signals by electromagnetic or optical means, including antennas, microwave dishes, horns, or similar types of equipment, towers or similar structures supporting such equipment, and equipment buildings.
O.
"Storage/distribution warehouse" means a facility for the inside storage and distribution of items.
P.
"Story" means that portion of a building between the surface of a floor and the surface of the floor next above it or, if there is no floor above it, then that portion between the surface of the floor and the ceiling next above it.
Q.
"Street" means a roadway which is either: a) within the boundaries of a public right-of-way; or b) located on private property within a PUD, or within a mobile home park, or upon which all lots that front on it meet current minimum lot width requirements; which is constructed in accordance with this title and which affords the principal means of access to abutting property. A street may also be referred to as an avenue, boulevard, circle, court, drive, highway, lane, parkway, way, place, road, thoroughfare, or other appropriate name. An alley is not a street. The functional classification of streets into a network of arterials, collectors, and local streets is determined by the Illinois Department of Transportation (IDOT) in coordination with the Champaign-Urbana Urbanized Area Transportation Study (CUUATS). For purposes of this title, the following represent functional classifications and types of streets:

"Arterial street" is defined by the IDOT Bureau of Local Roads (BLRS) Manual, Section 27-3.02 as "generally characterized by [its] ability to quickly move relatively large volumes of traffic, but often with restricted accessibility to abutting properties. The arterial system provides for high travel speeds and the longest trip movements. The rural and urban arterial systems are connected to provide continuous through movements at approximately the same level of service (LOS)."
2.
"Collector street" is defined by the IDOT BLRS Manual, Section 27-3.02 as "characterized by a relatively even distribution of access and mobility functions. Traffic volumes and speeds are typically lower than those of arterials."
3.
"Cul-de-sac street" means a local street with only one outlet that terminates in a vehicular turnaround, having an appropriate terminal for the safe and convenient reversal of traffic movement.
4.
"Local street" is defined by the IDOT BLRS Manual, Section 27-3.02 as any public street "not classified as arterials or collectors" and/or "The many points of direct access to adjacent properties characterize local streets," and/or "streets where speeds and volumes are usually low and trip distances short."
5.
"Private street" means a street not located within a public right-of-way and not publicly owned or maintained.
6.
"Stub street" means a street right-of-way or improvement that terminates at the boundary of a development and is expected to continue through abutting property in its subsequent future development.
R.
"Street, perimeter" means any existing street to which a parcel abuts on one or more sides.
S.
"Street, primary" means the perimeter street on which the lot is addressed, or the perimeter street facing the primary entrance of a building on the lot. On a corner lot, if the primary entrance does not face the street on which the building is addressed, the perimeter street facing the primary entrance shall be considered the primary street. A building with multiple primary entrances shall be considered to have multiple primary streets.
T.
"Street, primary internal" means a private main road that provides access within the immediate site and may be extended to provide access to the adjacent parcels.
U.
"Street, secondary" means the perimeter street(s) of a corner lot not determined to be the primary street.
V.
"Street, secondary internal" means a private road within a site that supports internal circulation and provides access to specific areas or uses. It does not typically connect to adjacent parcels, serving instead as a subordinate route for internal connectivity.
W.
"Structural alteration" means any change in the bearing walls, columns, beams, girders or other supporting members of a building.
X.
"Structure" means anything which is constructed or built and has a permanent location on or in the ground, is attached to the ground, or is attached to something having a permanent location on the ground.
Y.
"Structure, attached" means a structure which is connected to another structure.
Z.
"Structure, detached" means a structure which is not connected to another structure.

"Use" means the specific purpose for which land, a structure or premises is designed, arranged, intended or for which it is or may be occupied or maintained.

"Value" means the full, fair, cash market value.
B.
"Vehicle services—Major repair/body work" means the repair, servicing, alteration, restoration, towing, painting, cleaning, or finishing of automobiles, trucks, recreational vehicles, boats, large appliances, commercial and industrial equipment, and other vehicles as a primary use, including the incidental wholesale and retail sale of vehicle parts as an accessory use. This includes major repair and body work which encompasses towing, collision repair, other body work and painting services, and tire recapping.
C.
"Vehicle services—Minor maintenance/repair" means the repair, servicing, alteration, restoration, towing painting, cleaning, or finishing of automobiles, trucks, recreational vehicles, boats, and other vehicles as a primary use, including the incidental wholesale and retail sale of vehicle parts as an accessory use. Minor facilities providing limited repair and maintenance services. Examples include car stereo and alarm system installers; detailing services; muffler and radiator shops; quick-lube services; tire and battery sales and installation (not including recapping).
D.
"Video gaming café" means an establishment whose primary or major focus is video gaming as authorized by the Video Gaming Act (230 ILCS 40/1 et seq.) and the service of alcohol and food is incidental to the operation of video gaming.

A.
"Warehouse, distribution/storage" means structures, or part thereof, or area used principally for the storage or distribution of goods and merchandise to retailers, nonresidential users, or to other wholesalers.
B.
"Wireless telecommunications equipment" means any equipment used for the purpose of collecting or transmitting electromagnetic signals, or to provide immediate support to such equipment or structure.
C.
"Wireless telecommunications, tower" means any type of tower structure or similar that is built for the sole or primary purpose of supporting any FCC-licensed or authorized antennas and their associated facilities, including structures that are constructed for wireless communications services including, but not limited to, private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul, and the associated site.
D.
"Winery" means an establishment primarily engaged in the brewing of ale, beer, malt liquors, and/or nonalcoholic beer that are permitted to do so in accordance with the liquor control commission. Wineries shall have a capacity of fifteen thousand (15,000) barrels or more per year. The definition includes a public tasting room, and retails sales of ale, beer, spirits, or related products brewed or manufactured on site.

"Yard." That portion of a lot which adjoins or surrounds a building.

"Front yard." That portion of a lot between the principal building on a lot and the front lot line and extending across the entire front of the lot from side lot line to side lot line. On a corner lot, the front yard shall be the portion of the lot between the principal building on a lot and the lot line which abuts the primary street; where there are multiple primary streets, the lot shall be considered to have multiple front yards abutting each primary street. The mean horizontal distance between the front lot line and the front of the principal building or any projection therefrom, other than the projections permitted by Section 16.02.004, shall be used to determine the depth of a front yard. The term "required front yard" means the minimum front yard required by the applicable regulations of this title.
2.
"Rear yard." That portion of a lot between the main building on the lot and the rear lot line. On a corner lot the rear yard shall extend from the exterior side or front yard line to the interior side lot line. On all other lots the rear yard shall extend from side lot line to side lot line. The mean horizontal distance between the rear lot line and the rear of the main building or any projection therefrom, other than the projections Section 16.02.004, shall be used to determine the depth of a rear yard. The term "required rear yard" means the minimum rear yard required by the applicable regulations of this title.

"Interior side yard." That portion of a lot between the main building on the lot and an interior side lot line. The interior side yard shall extend from the front yard line to the rear yard line. The mean horizontal distance between the side lot line and the side of the main building or any projection therefrom, other than the projections Section 16.02.004, shall be used to determine the width of a side yard. The term "required interior side yard" means the minimum interior side yard required by the applicable regulations of this title.

"Exterior side yard." That portion of a corner lot between the main building on the lot and a side lot line adjacent to the secondary street. The exterior side yard shall extend from the front yard line to the rear lot line. The mean horizontal distance between the side lot line and the side of the main building or any projection therefrom, other than the projections Section 16.02.004, shall be used to determine the width of a side yard. The term "required exterior side yard" means the minimum exterior side yard required by the applicable regulations of this title.
