ARTICLE 14.

OFF-PREMISE OUTDOOR ADVERTISING SIGNS

§ 14.1.- Definition.

An "outdoor advertising sign" means a sign including the supporting sign structure which directs the attention of the general public to a business, service, or activity not usually conducted or a product not usually offered or sold upon the premises where such a sign is located. None of the following shall be deemed an outdoor advertising sign:

1.

Directional and other official signs authorized by law.

2.

Signs advertising the sale or lease of property upon which they are located.

3.

Signs advertising activities conducted on or products sold on the property upon which they are located.

4.

Signs which have a significant portion of their face area devoted to giving time, date, temperature, and weather.

§ 14.2. - Permitted zones.

Outdoor advertising signs which conform to the provisions of this ordinance shall be permitted in the following districts: C-3, C-4, M-1, M-2 and AR.

§ 14.3. - Nonconforming signs.

Any nonconforming signs, structures, or nonconforming use, which is damaged by fire, flood, wind, or other act of God or man, may be constructed and used as before, if it is done within one year of such damage, unless damaged to extent of more than 50 percent of its replacement value, in which case any repair or reconstruction shall be in conformity with the provisions of this ordinance.

§ 14.4. - General provisions.

14.4.1.

Outdoor advertising signs shall not be established at any location having principle frontage on any street within three hundred feet of any property which is used for public parks, public schools, church, courthouse, city hall or public museum having principle frontage on the same street.

14.4.2.

No outdoor advertising sign shall be placed on, or extended over the right-of-way line of any street or highway.

14.4.3.

No outdoor advertising sign shall be constructed which resembles any official marker erected by the city, state or any governmental agency, or which by reason of position, shape or color would conflict with the proper functioning of any traffic sign or signal.

14.4.4.

All outdoor advertising signs shall be maintained in good and safe structural condition. The painted portions of outdoor advertising signs shall be periodically repainted and kept in good condition.

14.4.5.

No outdoor advertising signs or part thereof shall be located on any property without the consent of the owner, holder, leaser, agent or trustee.

14.4.6.

The general ground area in the vicinity of any outdoor advertising sign must be kept free and clear of sign materials, weeds, debris, and trash and other refuse.

14.4.7.

The maximum area for any sign facing shall be 800 square feet inclusive of any border and trim, but excluding the base or apron, supports and other structural members.

14.4.8.

No outdoor advertising sign may be established within 300 feet of any other outdoor advertising sign site.

§ 14.5. - Lighting of signs.

Signs which are not effectively shielded as to prevent beams or rays from being directed at any portion of the traveled ways and are of such intensity or brilliance to cause glare or impair the vision of the driver of any motor vehicle or which otherwise interfere with any driver's operation of a motor vehicle are prohibited. No sign shall be so illuminated that it interferes with the effectiveness or obscures an official traffic sign, device or signal.

§ 14.6. - Height of signs.

No ground or roof sign may exceed the building height limitation of the zone in which it is located. Measurement is to be made from the ground level or from the grade level of the street to which the sign faces, whichever is higher.

§ 14.7. - Permits required.

The Alabama Department of Transportation is the governing body for all off-premise outdoor advertising signs on state right-of-way. The City of Scottsboro shall not permit an off-premise outdoor advertising sign until official documentation is received from the Alabama Department of Transportation that such sign has been approved. All off-premise outdoor advertising signs shall be permitted by the City of Scottsboro.
