Certificate of Occupancy and Compliance.
(A)
Building inspections, building permits and new Certificates of Occupancy required for structural alterations and changes in use. No building or any type of structure, or premises, erected or structurally altered shall be used, newly occupied, or changed in use until all applicable inspections are conducted, a building permit has been issued by the Building Inspector stating that the building, structure, or premises complies with the building, zoning and all other applicable provisions of all City codes, and a Certificate of Occupancy has been issued.
(B)
Certificate of occupancy and compliance required. Certificates of occupancy and compliance shall be applied for coincident with the application for building permit and shall be issued within ten (10) days after the erection and structural alterations of such buildings shall have been completed in conformity with the provisions of this ordinance. A record of all certificates shall be kept on file in the office of the City and copies shall be furnished on request to any person having a proprietary or tenancy interest in the building affected. A temporary certificate of occupancy may be issued by the Building Official, with the approval of the Planning/Public Works Director, in rare cases, for minor issues like final landscaping if there is no threat to the health and safety of the public and to the occupant, and that portion or portions of the work allows the occupant to occupy the premises safely. The Building Official shall set a time frame during which the certificate of occupancy is valid. If the permanent certificate of occupancy is not issued within the time allowed by the Building Official, the temporary certificate of occupancy shall be revoked, and the occupant shall vacate the premises until in full compliance. Failure to vacate shall constitute a violation punishable by a maximum fine of five hundred dollars ($500.00) per day and each day the violation continues shall be a separate offense.
(C)
Certificates of occupancy and compliance for buildings located with the boundaries of The Shores Planned Development District shall be issued in accordance with Section 20-23.1(3) of this chapter.
Excavation prohibited without permit. No permit for excavation for any building shall be issued before application has been made for a certificate of occupancy and compliance.
Architect or engineer to be legally registered. Before a permit shall issue for a building of three (3) stories or more in height or 5,000 square feet in area, except one and two-family dwellings, the designer of such building shall be an architect or engineer legally registered under the laws of this State and he shall affix his official seal to the drawings and specifications for the building.
