The Shores PDD.
(1)
Upon approval of any proposed PDD by the City Council, the final site plan as approved, together with the Planned Development District Standards, Specifications, Zoning PDD, and the Design Code, shall be considered by the Planning and Zoning Commission who shall make recommendations, if any, to the city council for their consideration, and if approved by the city council after a public hearing pursuant to Section 20-18 shall automatically be incorporated within, and shall thereafter comprise a part of the City Zoning Ordinance, and shall be applicable within the boundaries of such approved PDD.
This section 20-23.1, and all requirements contained therein shall also apply to all other proposed or approved Planned Development Districts.

The Shores Planned Development District Standards, Specifications, the Zoning PDD, and the Shores Design Code, and any amendments or modifications thereto, must be considered by the Planning and Zoning Commission who shall make recommendations, if any, to the city council for consideration, and if approved by the city council after a public hearing pursuant to Sec. 20-18 shall be incorporated within, and thereafter comprise and become a part of the City of south Padre Island Zoning Ordinance, and shall be enforceable by the city within the boundaries of The Shores PDD, and any other Planned Development District.

The city shall issue a certificate of occupancy and compliance pursuant to Section 20-15(B) for any building located within the boundaries of The Shores PDD if The Shores Design Board certifies in writing that the building in question has complied with all The Shores PDD Standards, Specifications, and Zoning PDD, and The Design Code and have complied with all other applicable city codes.

If a building within The Shores boundaries is not in compliance with The Shores PDD Standards, Specifications, the Zoning PDD, the Shores Design Code or any other applicable city code, a certificate of occupancy will not be issued by the city UNLESS a written waiver of any such non-compliance is sent by The Shores Design Review Board specifically allowing any such matter not in compliance, and the owner acknowledges any such non-compliance to the city in writing and states that they will not hold the city responsible for allowing any such non-compliant matter.
