ARTICLE 12

- LEGAL STATUS PROVISIONS

Sec. 12.01.- Conflict with other regulations.

Whenever the regulations of this ordinance require more restrictive standards than are required under any other statute, the requirement of this ordinance shall govern. Whenever the provisions of any other statute require more restrictive standards than are required by this ordinance, the provisions of such statue shall govern.

Sec. 12.02. - Validity.

Should any Section or provision of this ordinance be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration shall not affect the validity of the ordinance as a whole or any part thereof which is not specifically declared to be invalid or unconstitutional.

Sec. 12.03. - Re-enactment and repeal of existing zoning ordinance.

This ordinance amends and in part carries forward by re-enactment some of the provisions of the zoning ordinance of the City of Tarrant, Alabama, adopted on July 1, 1985, as amended, and it is not the intention to repeal but rather to re-enact and continue in force such existing provision so that all rights and liabilities that have accrued hereunder are preserved and may be enforced. All provisions of the zoning ordinance of the City of Tarrant, Alabama, enacted on July 1, 1985, as amended, which are not enacted herein are hereby repealed. All suits at law or in equity and/or all prosecutions resulting form the violation of any zoning ordinance heretofore in effect, which are not pending in any of the courts of this state or of the United States, shall not be abated or abandoned by reason of the adoption of this ordinance, but shall be prosecuted to their finality the same as if this ordinance had not been adopted; any and all violations of existing zoning ordinance, prosecutions for which have not yet been instituted, may be hereafter filed and prosecuted; and nothing in this ordinance shall be so construed as to abandon, abate, or dismiss any litigation or prosecution now pending, and/or which may heretofore have been instituted or prosecuted.

Sec. 12.04. - Effect upon outstanding permits.

Nothing herein contained shall require any change in the plans, construction, size or designated use of any building structure or part thereof for which a permit had been granted by the city before the time of passage of this ordinance; provided, however, that where construction is not begun under such outstanding permit within a period of sixty (60) days subsequent to passage of this ordinance or where it has not been completed within eighteen (18) months subsequent to passage of this ordinance, any further construction or use shall be in conformance with the ordinance.

Sec. 12.05. - Effective date.

This ordinance shall take effect and be in force immediately after adoption by the city council of the City of Tarrant, Alabama.
