ARTICLE 3

- ESTABLISHMENT OF ZONES

Sec. 3.01.- Zones.

For the purposes of this ordinance, the City of Tarrant, Alabama, is hereby divided into the following zones:

(a)

Residential zones.

R-LD Low-Density Single-Family Zone
R-MD Medium-Density Single-Family Zone
R-HD High-Density Single-Family Zone
R-MF Multi-Family and Attached Dwelling Zone
R-AH Affordable Housing Development Zone

 

(b)

Specialty zones.

AG Agriculture Zone

 

(c)

Business zones.

NC Neighborhood Center Zone
GB General Business Zone
TC Town Center Zone

 

(d)

Industrial zones.

LI Light Industrial Zone
GI General Industrial Zone
PI Planned Industrial Zone

 

Sec. 3.02. - Zone boundaries established; map.

The boundaries of each zone are indicated upon the official zoning map of the City of Tarrant, Alabama, which is made a part of this ordinance. Said map and all notations, references and other information shown therein shall be as much a part of this ordinance as if fully described herein. Said map shall be retained in the office of the city clerk.

Sec. 3.03. - Interpretation of zone boundaries.

Where uncertainty exists as to the boundaries of any zone shown on the zoning map, the following rules shall apply:

(a)

Where such zone boundaries are indicated as approximately following center lines of thoroughfares, alleys, lot or property lines, stream center lines, or corporate limit lines, such lines shall be considered to be such boundaries.

(b)

In unsubdivided property or where a zone boundary divides a lot, the location of such boundary, unless the same is indicated by dimensions shown on the zoning map, shall be determined by the use of a scale appearing on the zoning map.

(c)

Where physical or cultural features existing on the ground appear different from those shown on the zoning map, or in other circumstances not covered by the preceding rules, the planning commission, hereinafter referred to as the commission, shall interpret the zone boundaries.

Sec. 3.04. - Zoning of annexed land.

All land, properties, and areas annexed by the City of Tarrant, subsequent to the adoption of this ordinance, shall be zoned in accordance with the following procedure.

(a)

Application. An application for rezoning shall be filed with the city clerk on forms provided by the clerk for such purpose. Such application and submission requirements shall be provided by the city clerk to the owner or the owner's authorized agent upon filing an application for rezoning concurrently with the petition for annexation. Any member of the council may also initiate the rezoning of said property by introduction of a resolution for such purposes. The zoning classification to be applied for shall be that City of Tarrant zone closest to and most compatible with the county classification applicable to the property at the time of filing of the petition for annexation. Should two (2) different zones be close to and compatible with the county classification, then in such event, the zone imposing greater restrictions shall be applied for. However, if plans are submitted with the petition for annexation for a development on the property which is different from the current county zoning classification, then in such event, the owner or his designated agent may request the appropriate city zone in lieu of the closest and most compatible zone.

(b)

The procedure for rezoning annexed property shall proceed pursuant to the procedure detailed in Article 11. The ordinance for rezoning shall be acted upon immediately following the adoption of the ordinance for annexation or as soon thereafter as possible.
