Pursuant to P.L. 1975, c. 291, the Planning Board may grant conditional uses wherever permitted in this chapter unless a variance from a conditional use requirement is needed, in which case the Board of Adjustment shall have jurisdiction. Application for a conditional use shall be made in accordance with the procedures set forth in Article VII, Subdivision and Site Plan Review, for preliminary subdivision plat approval, and the Planning Board shall act on the application in accordance with the procedures for preliminary subdivision plat approval. Application for a conditional use shall be granted if the same will not be detrimental to the health, safety and general welfare of the community, is not likely to involve unusual risks of traffic safety or traffic congestion, and is reasonably necessary for the convenience of the community.
