CHAPTER 16

MOBILE HOME PARKS

11-16-1: PURPOSE:

The purpose of this Chapter is to provide for mobile home park development at appropriate locations in Three Forks and to establish development standards in order to integrate mobile homes into an area without adversely affecting surrounding properties and to provide safeguards. 11-16-2: DEFINITIONS1:

   DENSITY: The number of mobile home units per acre.
   MOBILE HOME: A factory-assembled structure or structures (i.e., double wide); with dimensions of ten feet (10') wide by thirty five feet (35') long or greater, equipped with the necessary service connections and made so as to be readily moveable as a unit or units on its (their) own running gear and designed to be used as a single dwelling unit(s) without a permanent foundation.
   MOBILE HOME LOT: A designated portion of a mobile home park designed for the accommodation of one mobile home and its accessory buildings or structures for the exclusive use of the occupants.
   MOBILE HOME PARK: Tract of land that has been planned and improved for the placement of two (2) or more mobile homes for residential use (lots for rent or lease).
   MOBILE HOME STAND: That area of a mobile home lot which has been reserved for the placement of a mobile home, appurtenant structures or additions.
   RECREATION AREA: An area including open space and playgrounds and buildings and apparatus designed for recreational activities set aside for the use of the mobile home park residents.
   SITE: The entire gross area of the mobile home park. (Ord. 203, 12-9-1983)

11-16-3: PERMITTED USES:

Accessory buildings and uses customarily incidental thereto. However, no part of any park shall be used for nonresidential purposes, except such uses that are required for direct servicing and well-being of park residents and for management and maintenance of the park. Nothing in this Chapter shall be deemed as prohibiting the sale of a mobile home located on a mobile home stand and connected to the pertinent utilities.
Mobile homes, excluding commercial sales of mobile homes.
Signs as follows:
   A.   One identification sign on each major street frontage, approved in conjunction with the final plan approval of the mobile home park. In no case shall the sign be greater than forty (40) square feet in surface area nor have any moving parts and/or flashing lights nor stand higher than fifteen feet (15') from the ground to top of the sign.
   B.   Such sign shall be no closer to a public right-of-way line than twenty feet (20'). (Ord. 203, 12-9-1983)

11-16-4: OTHER LAWS:

The regulations in this District shall not be interpreted so as to supersede or amend any State or Federal regulations pertaining to mobile home park development. These regulations are intended to be supplemental to other established mobile home park regulations and their amendments. When the standards and regulations in this District are more restrictive than other established standards and regulations, the more restrictive shall be used. (Ord. 203, 12-9-1983)

11-16-5: ADMINISTRATIVE PROVISIONS:

   A.   Permits Required: It shall be unlawful for any person to construct, alter, or extend any mobile home park unless he holds necessary valid permits issued by the Division of Environmental Sanitation, State Department of Health and the Three Forks Zoning Official. (Ord. 253-99, 10-13-1998)
   B.   Local Fees:
      1.   Mobile home parks must have a City license under which to operate, if located within the City limits.
      2.   Local fees for individual mobile home structures will be assessed. (Ord. 203, 12-9-1983)

11-16-6: DESIGN STANDARDS:

   A.   Site: The mobile home park site shall not be exposed to smoke, dust, noise, odors, or other adverse influences which might create damage to property or bring harm to occupants of the park.
   B.   Site Size And Park Density: Minimum size for a mobile home park shall be two (2) acres with a minimum of twelve (12) lots. Average park density shall not exceed nine (9) mobile home units per acre.
   C.   Lot Size: Minimum lot area shall be four thousand five hundred (4,500) square feet with no less than thirty feet (30') of lot width where both Municipally approved water and sewer systems are available.
   D.   Site Coverage: Maximum mobile home lot coverage shall not exceed fifty percent (50%). Coverage shall mean any manmade apparatus.
   E.   Setbacks:
      1.   All mobile homes and accessory buildings shall be set back not less than ten feet (10') from all property lines except front or street property lines. Front and street setbacks shall be the same as the zoning district in which the mobile home park is to be located.
      2.   Mobile home or its attached structures, such as carports or awnings, may be located within twenty feet (20') of any other mobile home or attachments.
      3.   No detached structure such as a storage shed, may be located within five feet (5') of any mobile home or its attached structures. (Ord. 203, 12-9-1983)
   F.   Mobile Home Stand: Each mobile home lot shall be provided with a well-drained stand with a firm base, approved by the City Zoning Official, for the placement of the mobile home, appurtenant structures or additions. Each stand must be at least twelve feet by fifty feet (12' x 50') for single-wide units and twenty four feet by fifty feet (24' x 50') for double-wide units. (Ord. 253-99, 10-13-1998)
   G.   Height: Maximum height for any structures within a mobile home park shall be that of the district in which the park is to be located.
   H.   Streets:
      1.   All mobile home parks shall be provided with safe and convenient vehicular access from abutting public streets and throughout the mobile home park.
      2.   Street widths should be of adequate widths to accommodate any contemplated parking and expected traffic load, but, in all cases, shall meet the following minimum requirements:
         a.   Collector streets with guest parking, thirty six feet (36') wide, face of curb to face of curb.
         b.   Collector streets with no parking, twenty two feet (22') wide, face of curb to face of curb.
         c.   Minor streets with no parking, twenty feet (20') wide, face of curb to face of curb.
         d.   All dead-end streets shall be limited to a maximum length of five hundred feet (500') and shall be provided with a cul- de-sac at least one hundred feet (100') in diameter.
         e.   Minimum access width to each mobile home stand shall be twelve feet (12').
         f.   All roads and driveways shall be hard surfaced and so constructed as to handle all anticipated peak loads, adequately drained and lighted for safety and ease of movement of vehicles. A concrete curb and gutter shall be placed along both sides of all roads.
   I.   Parking: Number of spaces shall be no less than two (2) spaces per lot. Size of spaces shall be nine feet (9') in width by eighteen feet (18') in length.
   J.   Recreation Area: A minimum of ten percent (10%) of the gross site area shall be reserved for park and recreation development. Such areas shall be located centrally and be adequately landscaped with trees, grass, recreational equipment, etc.
   K.   Utilities And Other Services:
      1.   All sanitary sewer and water facilities, including connections provided to individual lots, shall meet the requirements of the Three Forks utility standards and the Montana Department of Health and Environmental Standards.
      2.   The water supply system servicing the mobile home park shall be subject to the rules and regulations of the local fire protection authority as well as any State and/or national standards. Fire protection systems must be reviewed and approved by the City Fire Department. (Ord. 203, 12-9-1983)

11-16-7: APPROVAL:

   A.   Conditional Use Permit Procedure: Approval of a mobile home park shall be obtained through conditional use permit procedure as specified in Chapter 12 of this Title. Mobile home park design(s) shall be submitted outlining the development criteria that has been set forth.
   B.   Other Standards And Safeguards: The City Council and City Zoning and Planning Board may require other standards and safeguards (i.e., buffer landscaping along perimeter of mobile home park) as specific locations and circumstances dictate. (Ord. 203, 12-9-1983)
