CHAPTER 8

BUSINESS AND INDUSTRIAL DISTRICTS

11-8A-1: PURPOSE:

The Central Business District is intended to be the central focus of the City's business, government, service and cultural activities. The uses in this District should be those which are appropriate to such a center and inappropriate uses should be excluded. Room should be provided in appropriate areas for logical and planned expansion of the present central business area. The area should be developed as an attractive and pleasant environment, recognizing its importance to the community and its historic heritage. (Ord. 203, 12-9-1983)

11-8A-2: PERMITTED USES:

Uses permitted in the NHB District.
Ambulance service.
Bakeries.
Barbershops and beauty shops.
Bars, cocktail lounges.
Churches.
Dressmaking.
Financial institutions.
Fire stations.
Hotels and motels.
Laundry and dry cleaning.
Meeting and lodge halls.
Muffler sales and service shops.
Museums, libraries, and galleries.
Parking lots.
Printing offices.
Private schools, such as dance, business, secretarial and technical but not private or public elementary or secondary schools.
Public offices.
Repair services for clothes, dolls, small appliances, watches, glasses, and such other items.
Restaurants and cafes.
Retail sales such as:
   Candy
   Clothing
   Furniture
   Jewelry
   but excluding heavy machinery.
Signs.
Temporary buildings for and during construction only.
Theaters, except drive-ins.
Wholesale establishments that use samples, but do not stock on premises.
Uses customarily accessory to those listed. (Ord. 203, 12-9-1983)

11-8A-3: CONDITIONAL USES:

The following uses may be allowed in the CBD central business district as conditional uses as regulated in chapter 12 of this title:
   Amusement and recreational activities.
   Assisted living facilities.
   Daycare facilities.
   Medical marijuana distribution structure.
   One-family and multiple-family dwellings.
   Senior centers.
   "Sexually oriented business" as defined in title 4, chapter 4 of this code.
   Shopping centers.
   Any other retail use catering directly to consumers. Any other office activity. Any other consumer service. Any other type of meeting hall or club, financial institution or drive-in bank. 11-8A-4: LOT AREA AND WIDTH:

No minimum lot area or width is set forth. (Ord. 203, 12-9-1983)

11-8A-5: LOT COVERAGE:

Building may cover entire lot, provided other requirements are met. (Ord. 203, 12-9-1983)

11-8A-6: YARD REQUIREMENTS:

No minimum yards set forth except a fifteen foot (15') front yard shall be required on all streets except Main Street (provided pedestrian walkways are preserved). Necessary rear yard setbacks may be required on lots and business uses which adjoin an alley. For all lots that are utilized primarily for residential use in this district, the yard requirements will be the same as those in the R district. (Ord. 203, 12-9-1983; amd. Ord. 267, 2-11-2003)

11-8A-7: OFF STREET PARKING:

Off street parking shall be provided in accordance with chapter 13 of this title. (Ord. 203, 12-9-1983)

11-8A-8: OFF STREET LOADING:

Off street loading shall be provided in accordance with chapter 14 of this title. (Ord. 203, 12-9-1983)

11-8A-9: BUILDING HEIGHT:

No maximum building height is set forth. (Ord. 203, 12-9-1983)

11-8B-1: PURPOSE:

The purpose of this district is to provide for the community's needs for wholesale trade, storage and warehousing, trucking and transportation terminals, manufacturing and similar activities. Such uses should be related to the city's major transportation facilities and be so situated that they can be efficiently operated and yet create a minimum of traffic or other adverse effects to the residential areas of the city. Residences shall not be permitted in this district (excluding caretaker residence) and adequate screening from existing residential neighborhoods may be necessary. (Ord. 203, 12-9-1983)

11-8B-2: PERMITTED USES:

Accessory uses.
Auto repair and body shops.
Beverage, bottling, and distributing.
Building equipment and materials, wholesale and retail sales, including storage yards (screened).
Cabinet shops.
Cement products.
Electronic equipment, assembly and repair.
Feed and seed sales, wholesale and retail.
Flour and feed mills.
Food processing plants.
Freight terminals, truck or rail.
Gasoline bulk plants.
Gasoline service stations.
Implement sales and service.
Machine shops.
Manufacturing of light consumer goods, i.e., electronic equipment, appliances, furniture, beverages.
Miniwarehouse/self-storage units:
   A.   Minimum aisle width between buildings shall be twenty four feet (24').
   B.   All stormwater must be contained and drained within the facility.
   C.   The storage facility's complex shall be surrounded by a chainlink fence approximately eight feet (8') in height.
   D.   Outdoor storage of automobiles, boats and recreation vehicles is permitted if they are within the fenced area. Outdoor exterior storage shall be limited to ten percent (10%) of the indoor storage area. Parked vehicles shall not interfere with traffic movement through the complex and shall meet the minimum setbacks of the district.
   E.   One office/dwelling unit is permitted as an accessory use to provide for a full time caretaker.
Outside storage, if accessory to permitted use and if screened from street and/or any neighboring residential areas.
Paint shops.
Post offices.
Professional and business offices.
Repair and service establishments for light consumer goods, i.e., automobiles, appliances, furniture.
Sign shops.
Signs.
Temporary buildings for and during construction, only.
Vehicle and boat sales and service.
Veterinary clinics.

11-8B-3: CONDITIONAL USES:

The following uses may be allowed in the GI general industrial district as conditional uses as regulated in chapter 12 of this title:
Accessory uses clearly subordinate to, but an integral part of the primary use of the property, i.e., plant cafeteria, first aid station, recreational area, caretaker residence.
Any manufacturing or industrial use (excluding confined livestock and poultry yards) is provided by conditional use in this district if in compliance with all provisions of this article. However, no use shall be permitted which causes excessive noise, vibration, smoke, odor, dust or other particulate matter, toxic or nontoxic matter, humidity, heat or glare which extends beyond the lot boundaries of the specific use. "Excessive" is defined for these purposes as a degree that could be observed and agreed upon by the majority of the city council and determined to be offensive or a degree deemed by the state health department to be injurious to the public health, safety, or welfare of the residents of the area.
Medical marijuana distribution structure.

11-8B-4: LOT AREA AND WIDTH:

Lot area for this district shall not be less than seven thousand five hundred (7,500) square feet and no lot width shall be less than seventy five feet (75'). No lot shall have a depth greater than three (3) times its width. (Ord. 203, 12-9-1983)

11-8B-5: LOT COVERAGE:

The entire lot exclusive of required yards and parking, may be occupied by the principal and accessory buildings. (Ord. 203, 12-9-1983)

11-8B-6: YARD REQUIREMENTS:

Every lot shall have the following minimum yards:
Front yard: Twenty feet (20').
Rear yard: None 1 .
Side yard: None. (Ord. 203, 12-9-1983)

11-8B-7: OFF STREET PARKING:

Off street parking shall be provided in accordance with chapter 13 of this title. (Ord. 203, 12-9-1983)

11-8B-8: OFF STREET LOADING:
