CHAPTER 69

PARKING REGULATIONS

69.01 PARKING LIMITED OR CONTROLLED.

Parking of vehicles shall be controlled or limited where so indicated by designated traffic control devices in accordance with Chapter 61 of this Traffic Code. No person shall stop, park or stand a vehicle in violation of any such posted parking regulations unless in compliance with the directions of a peace officer.

69.02 PARK ADJACENT TO CURB.

No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the right-hand wheels of the vehicle within 18 inches of the curb or edge of the roadway except as hereinafter provided in the case of angle parking and vehicles parked on the left-hand side of one-way streets.

69.03 PARKING ON ONE-WAY STREETS.

No person shall stand or park a vehicle on the left-hand side of a one-way street other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the left-hand wheels of the vehicle within 18 inches of the curb or edge of the roadway except as hereinafter provided in the case of angle parking.

69.04 ANGLE PARKING.

Angle or diagonal parking is permitted only in the following locations:

1.   High Street, on the south side, from U.S. HWY 63 to the alley between Church Street and Green Street;
2.   High Street, on the north side, from Main Street to Church Street;
3.   Main Street from Carleton Street to State Street;
4.   Broadway Street from Carleton Street to State Street;
5.   South Church Street, on the west side, from alley between State Street and High Street to alley between High Street and Carleton Street.

69.05 MANNER OF ANGLE PARKING.

Upon those streets or portions of streets which have been signed or marked for angle parking, no person shall park or stand a vehicle other than at an angle to the curb or edge of the roadway or in the center of the roadway as indicated by such signs and markings. No part of any vehicle or the load thereon, when said vehicle is parked within a diagonal parking district, shall extend into the roadway more than a distance of 16 feet when measured at right angles to the adjacent curb or edge of roadway.

69.06 PARKING FOR CERTAIN PURPOSES ILLEGAL.

No person shall park a vehicle upon public property for more than 24 hours, unless otherwise limited under the provisions of Section 69.01 of this chapter, or for any of the following principal purposes:

1.   Sale. Displaying such vehicle for sale.
2.   Repairing. For lubricating, repairing or for commercial washing of such vehicle except such repairs as are necessitated by an emergency.
3.   Advertising. Displaying advertising.
4.   Merchandise Sales. Selling merchandise from such vehicle except in a duly established market place or when so authorized or licensed under the Code of Ordinances.

69.07 PARKING PROHIBITED.

No one shall stop, stand or park a vehicle except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or traffic control device, in any of the following places:
1.   Crosswalk. On a crosswalk.

2.   Center Parkway. On the center parkway or dividing area of any divided street.

3.   Mailboxes. Within 20 feet on either side of a mailbox which is so placed and so equipped as to permit the depositing of mail from vehicles on the roadway.

4.   Sidewalks. On or across a sidewalk.

5.   Driveway. In front of a public or private driveway.

6.   Intersection. Within an intersection or within 10 feet of an intersection of any street or alley.

7.   Fire Hydrant. Within five feet of a fire hydrant.

8.   Stop Sign or Signal. Within 10 feet upon the approach to any flashing beacon, stop or yield sign, or traffic control signal located at the side of a roadway.

9.   Railroad Crossing. Within 50 feet of the nearest rail of a railroad crossing, except when parked parallel with such rail and not exhibiting a red light.

10.   Fire Station. Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance when properly sign posted.

11.   Excavations. Alongside or opposite any street excavation or obstruction when such stopping, standing or parking would obstruct traffic.

12.   Double Parking. On the roadway side of any vehicle stopped or parked at the edge or curb of a street.

13.   Hazardous Locations. When, because of restricted visibility or when standing or parked vehicles would constitute a hazard to moving traffic, or when other traffic conditions require, the Council may cause curbs to be painted with a yellow color and erect no parking or standing signs.

14.   Theatres, Hotels and Auditoriums. A space of 50 feet is hereby reserved at the side of the street in front of any theatre, auditorium, hotel having more than 25 sleeping rooms, hospital, nursing home, taxicab stand, bus depot, church, or other building where large assemblages of people are being held, within which space, when clearly marked as such, no motor vehicle shall be left standing, parked or stopped except in taking on or discharging passengers or freight, and then only for such length of time as is necessary for such purpose.

15.   Alleys. No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property. The provisions of this subsection shall not apply to a vehicle parked in any alley which is 18 feet wide or less; provided said vehicle is parked to deliver goods or services.

16.   Ramps. In front of a curb cut or ramp which is located on public or private property in a manner which blocks access to the curb cut or ramp.

17.   In More Than One Space. In any designated parking space so that any part of the vehicle occupies more than one such space or protrudes beyond the markings designating such space.
18.   Parking or Terrace. Upon the parking or terrace, designated as that area between the curb line, where curbing has been installed.

69.08 PERSONS WITH DISABILITIES PARKING.

The following regulations shall apply to the establishment and use of persons with disabilities parking spaces:
1.   Establishment. Persons with disabilities parking spaces shall be established and designated in accordance with Chapter 321L of the Code of Iowa and Iowa Administrative Code, 661-18. No unauthorized person shall establish any on-street persons with disabilities parking space without first obtaining Council approval.
2.   Improper Use. The following uses of a persons with disabilities parking space, located on either public or private property, constitute improper use of a persons with disabilities parking permit, which is a violation of this Code of Ordinances:

   A.   Use by an operator of a vehicle not displaying a persons with disabilities parking permit;
   B.   Use by an operator of a vehicle displaying a persons with disabilities parking permit but not being used by a person issued a permit or being transported in accordance with Section 321L.2[1b] of the Code of Iowa;
   C.   Use by a vehicle in violation of the rules adopted under Section 321L.8 of the Code of Iowa.
3.   Wheelchair Parking Cones. No person shall use or interfere with a wheelchair parking cone in violation of the following:
   A.   A person issued a persons with disabilities parking permit must comply with the requirements of Section 321L.2A[1] of the Code of Iowa when utilizing a wheelchair parking cone.
   B.   A person shall not interfere with a wheelchair parking cone which is properly placed under the provisions of Section 321L.2A[1] of the Code of Iowa.

69.09 TRUCK PARKING LIMITED.

No person shall park a motor truck, semi-trailer, or other motor vehicle with trailer attached in violation of the following regulations. The provisions of this section shall not apply to pick-up, light delivery, or panel delivery trucks. Such parking shall not exceed two (2) hours.

69.10 SNOW REMOVAL.

The purpose of this section is to provide procedures for ordering the location of vehicles parked on City streets so as not to impede the progress of snow removal equipment endeavoring to clear the streets of snow and to provide for the tow-away of vehicles so stopped, standing, or parked as to constitute safety hazards by impeding the passage of vehicles on the streets or the removal of unsafe accumulations of snow and ice.
1.   Snow Routes. Stopping, standing or parking of vehicles upon streets designated as snow routes, except as required at intersections or otherwise to avoid collision, is prohibited when the snow ordinance goes into effect until the snow removal operations have been completed for the entire width of the streets. For purposes of this section, the snow ordinance is in effect when the accumulation of snow exceeds one inch, as measured by the National Weather Service for the City, in any particular snowstorm or snow event. The snow ordinance will end 48 hours after the end of the snow event. Vehicles found to be parked in violation of this section shall be cited for said violation, and to obviate the safety hazards occasioned by incomplete snow removal, shall be summarily towed on orders of a police officer to some place where the vehicle may be lawfully parked, or to a privately owned impoundment lot. The cost of such towing shall be assessed to and paid by the operator or registered owner of the vehicle.
2.   Snow Routes Designated. On the following streets or portions of streets designated in this section, it is unlawful, once official signs have been erected giving notice of such as “snow routes,” to operate a motor vehicle contrary to this section.
   A.   Broadway Street between State Street and Business Highway 30, except parking is permitted immediately in front of the Hotel Toledo on the west side the street;
   B.   Church Street from High Street to Business Highway 30;
   C.   Madison Street from Highway 63 to Elm Street;
   D.   State Street from Highway 63 to east City Limits;
   E.   Ross Street from Highway 63 to east City Limits;
   F.   Elm Street from Ross Street to Vine Street;
   G.   Vine Street from Elm Street to Church Street;
   H.   High Street from Highway 63 to Ann Street;
   I.   Main Street from State Street to High Street.
   J.   Business Highway 30 from east City limits to west City limits.
3.   Temporary Tow-Away Zones for Snow Removal. After especially heavy snow accumulations, the Public Works Director may post other streets with snow removal/tow-away notice signs or place notices on the vehicles on such streets and cause the towing of vehicles parked contrary to such notice posted for more than 12 hours when such is deemed necessary to enable City crews to clear out snow from areas that had numerous parked cars or which, for some other reason, could not be effectively cleared of snow by ordinary snow plowing operations, so as to obviate the occurrence or continuance of a special hazard caused by the said condition.
4.   In the event a U.S. Mail box is knocked over by a piece of City owned equipment during the process of snow removal the City, at the Cities option, will either replace or repair it with a standard metal mail box mounted on a 4” x 4” post rated for ground contact. If it is determined it was hit or removed by flying snow or slush then the City will not repair or replace the box or post. Mail boxes must be mounted behind the back of curb and no part may be protruding beyond the back of curb.

69.11 ALTERNATE PARKING.

Alternate parking is in force in designated areas. The change in parking is effective at 9:00 a.m. each day.

69.12 TRUCK, TRAILER, AND BOAT PARKING LIMITED.

1.   No person shall park a trailer unhooked from the towing unit at any time, on any street, public alley or public parking area without the consent of the Toledo Police Chief or their designee.
2.   No person shall park a tractor, road tractor, truck-tractor unit (semi-truck and trailer), recreational vehicle, motor home, or equipment of any kind on City streets, public alleys, or public parking areas
3.   Trailers with towing unit attached may be parked on City streets, public alleys, or public parking during the process of loading and unloading, but in no case shall exceed 24 hours. Semi-truck and trailers parking shall not exceed two (2) hours, and in either case the parking shall not interfere with normal traffic.
4.   Equipment may not be parked on City streets, public alleys, or public parking areas except while actively using the equipment during the normal 7:00 a.m. to 5:00 p.m. working hours.
