ARTICLE XI

M Multiple Dwelling District

§ 350-59 Intent.

In expansion of the declaration of legislative intent and the statement of community development objectives found in Article I, and in furtherance of the goals and policies of the adopted Upper Moreland Comprehensive Plan, the intent of the M Multiple Dwelling District, among others, is as follows:
A. 
Provide residential neighborhoods with a variety of housing unit types and densities.
B. 
Preserve the suburban or town character of existing neighborhoods.
C. 
Promote the maintenance, stability, continued viability and enhanced value of the Township's residential neighborhoods.
D. 
Ensure new residential infill development and redevelopment is in character with existing neighborhoods.

§ 350-60 Use regulations.

A building may be erected, altered, or used, and a lot or premises may be occupied or used, in whole or in part, for any of the uses permitted, as shown in the Use Matrix,[1] and no other, provided that such uses shall comply with the district regulations established in this article and all other applicable sections of this chapter. Such uses shall comply with the district regulations established in Article IV, Use Regulations (in the event of a conflict between district and use regulations, the more stringent regulation shall be applicable), and all other applicable sections of this chapter.

§ 350-61 Dimensional regulations.

The following dimensional regulations are the district standards which must be achieved for any use, addition, or alteration:

§ 350-62 General regulations.

The tract of land on which each permitted use is conducted shall be held in single ownership and shall be operated under unified control or management, except for single-family detached dwellings.

§ 350-63 Additional requirements for developments of Use G-4, Multifamily building, and Use G-5, Single-family attached dwelling (townhouse).

A. 
Improvement agreement.
(1) 
In order to assure that the construction shall be completed in accordance with the approved plans, the applicant, prior to the issuance of any construction permit, shall enter into a written agreement with the Township, providing for the completion of the entire project in accordance with the approved plan within a period of two years from the date of issuance of the permit or within such other mutually agreed time period.
(2) 
Such agreement shall be secured by a completion guarantee in the form of a bond, with or without corporate surety, in the discretion of the Board of Commissioners, in an amount equal to the construction costs and/or improvement costs of all street, off-street parking facilities, buffer areas and screening devices, and sanitary and storm sewers as shall be estimated by the Township Engineer.

§ 350-64 Additional regulations.

A. 
Building height. No building shall exceed 45 feet, or three stories, in height, measured from the mean ground level.
B. 
Below ground level. No more than two walls of any living unit shall be below ground level, and no more than 25% of the ground-story height of these two walls shall be below ground level.
C. 
Landscaping. Use G-4, Multifamily building, and Use G-5, Single-family attached dwelling (townhouse), shall have a minimum landscape buffer area of 25 feet from the adjacent property.
D. 
Common recreation areas. A minimum recreation area at least equal to the number of dwelling units multiplied by 500 square feet is required for each tract developed for multifamily dwellings.
(1) 
Amenities. Amenities shall be provided to enhance the use of the common recreation areas by residents. At a minimum, this shall include:
(a) 
An improved path or trail of at least 1/4 mile in length through the open space or green area (in addition to required sidewalks). Path or trail shall be paved in areas that are flood-prone or often wet. In other areas, it shall be improved with pervious paving, crushed stone, wood chips or aggregate.
(b) 
Common gathering space with seating and tables.

The common gathering space shall be accessible by pedestrian walkways from all buildings.
[2] 
The common gathering space shall provide landscaping, including shade trees and groups of flowering shrubs, ground covers, grasses, and perennials. A minimum of one shade tree shall be provided per 250 square feet.
[3] 
Playground or tot-lot.
[a] 
The playground or tot-lot shall provide shade by using one or more of the following elements: shade trees, canopies, trellises, umbrellas, or similar elements.
[b] 
Six seating spaces shall be provided within the playground or tot-lot area.

§ 350-65 Additional regulations applying to Use G-6, Single-family detached, Use G-7, Single-family semidetached (twin), and Use G-8, Two-family detached (duplex), dwelling types.

A. 
Garages. To maintain the character of the neighborhood, surface parking in the front yard shall be minimized to the greatest extent possible. If a proposed lot abuts an existing alley, the parking shall be placed in the rear yard of the property with access to the parking from said alley and garage facing the alley or side. Garages, when provided, shall satisfy one of the following design options:
(1) 
Front entry garage. Garages which have entry door(s) facing the same street as the front facade of the primary building must meet the following design requirements:
(a) 
Attached garage. When attached to the primary building, the front facade of any garage or structure having an entryway or door for vehicular access must be set back a minimum of 10 feet behind the front facade of the primary building.
(b) 
Detached garage. When detached from the primary building, the front facade and any garage or structure having an entryway or door for vehicular access must be set back behind the rear facade of the primary building.
(2) 
Side entry garage. Garages which have entry door(s) perpendicular to the front facade of the primary building must meet the following design requirements:
(a) 
Must be attached to the primary building.
(b) 
Must have the same or greater front setback than the primary building.
(3) 
Rear entry garage. Garages which have entry door(s) that are on the opposite side of the primary buildings from the front facade must meet the following design requirements:
(a) 
May be attached or detached from the primary building.
(b) 
Must have the same or greater front setback than the primary building.
(c) 
Such garages must be accessed by an alley to the rear of the lot unless alternative access is available.
