Districts

§ 350-7 Establishment of districts.

For the purpose of this chapter, the Township of Upper Moreland is hereby divided into districts of different types that are deemed by the Board of Commissioners as most suitable to carry out the goals and objectives of the Upper Moreland 2040 Comprehensive Plan and the general purpose and intent set forth in this chapter, which shall be designated as follows.

§ 350-8 Enumeration of districts.

A. 
For the purposes of this chapter, Upper Moreland Township is hereby divided into the following zoning and overlay districts, which shall be designated as follows.
B. 
Mapped zoning districts.
(1) 
Residential zoning districts:
(a) 
R Conservation Residential District.
(b) 
R-1 Residential District.
(c) 
R-2 Residential District.
(d) 
R-3 Residential District.
(e) 
R-3A Cluster Residential District.
(f) 
R-4 Residential District.
(g) 
MD Multiple Dwelling District.
(2) 
Mixed use and nonresidential zoning districts:
(a) 
TC-1 Town Center 1 District.
(b) 
TC-2 Town Center 2 District.
(c) 
CC Commercial Core District.
(d) 
CMU Corridor Mixed Use District.
(e) 
SC Shopping Center District.
(f) 
BC Business Center District.
(g) 
IND Limited Industrial District.
(h) 
INST Institutional District.
(i) 
RC Recreation Conservation District.
(3) 
Overlay zoning districts:
(a) 
HPO Historic Preservation Overlay District.
(b) 
RCO Riparian Corridor Overlay District.
(c) 
SSO Steep Slope Overlay District.
(d) 
HRO High-Rise Overlay District.

§ 350-9 Zoning Map.

The boundaries of said districts shall be as shown upon the map attached to and made a part of this chapter, which shall be designated the "Zoning Map."[1] The said map and all the notations, references and other things shown thereon are hereby incorporated into this chapter and shall be as much a part of this chapter as if the matters, references, and things shown on the map were fully described herein.

§ 350-10 Boundaries of zoning districts.

Where the uncertainty exists with respect to the boundaries of the various districts, as shown on the Zoning Map, the following rules shall apply:
A. 
The district boundaries are center lines of roads or railroad rights-of-way, or such lines extended or parallel thereto, unless otherwise shown.
B. 
Where the district boundaries are not shown to be roads, the boundaries shall be construed to be property lines or dimensions from streets or roads.
C. 
All district boundaries, where applicable, run to the center line of a road, right-of-way, or watercourse.
D. 
Commercial and industrial districts run 200 feet deep or to the depth of the property, whichever is less.

§ 350-11 Federal and state-owned property.

Whenever federal or state-owned property is in one of the zoning districts, it shall be subject to the provisions of this chapter only insofar as permitted by the Constitution of the United States or Constitution of the Commonwealth of Pennsylvania.

§ 350-12 Public utilities.

Where the Public Utility Commission has issued a certificate to a public utility, the public utility shall be subject to the provisions of this chapter only insofar as permitted by the certificate so issued.
