ARTICLE V

R Conservation Residential District

§ 350-20 Intent.

In expansion of the declaration of legislative intent and the statement of community development objectives found in Article I, and in furtherance of the goals and policies of the adopted Upper Moreland Comprehensive Plan, the intent of the R Conservation Residential District, among others, is as follows:
A. 
Limit development in environmentally sensitive areas.
B. 
Promote the maintenance, stability, continued viability and enhanced value of the Township's residential neighborhoods.
C. 
Ensure new residential infill development and redevelopment is in a character consistent with existing neighborhoods.

§ 350-21 Use regulations.

A building may be erected, altered, or used, and a lot may be occupied or used, in whole or in part, for any of the uses permitted, as shown in the Use Matrix,[1] and no other, provided that such uses shall comply with the district regulations established in this article and all other applicable sections of this chapter. Such uses shall comply with the district regulations established in Article IV, Use Regulations (in the event of a conflict between district and use regulations, the more stringent regulation shall be applicable), and all other applicable sections of this chapter.

§ 350-22 Dimensional regulations.

The following dimensional regulations are the district standards, which must be achieved for any use, addition, or alteration:

§ 350-23 General development regulations.

A. 
Building design. New homes shall be consistent with the pattern of size, mass and footprint, as with other similar homes on the block.
B. 
All new developments shall provide sidewalks along any frontage of a property along a public street or shared common drive.

§ 350-24 Additional regulations for all residential uses.

A. 
Corner lots. In the case of a corner lot, a front yard shall be required on each street on which the lot abuts.
B. 
Garages. Garages, when provided, shall satisfy one of the following design options:
(1) 
Front entry garage. Garages which have entry door(s) facing the same street as the front facade of the primary building must meet the following design requirements:
(a) 
Attached garage. When attached to the primary building, the front facade of any garage or structure having an entryway or door for vehicular access must be set back a minimum of 10 feet behind the front facade of the primary building.
(b) 
Detached garage. When detached from the primary building, the front facade and any garage or structure having an entryway or door for vehicular access must be set back behind the rear facade of the primary building.
(2) 
Side entry garage. Garages which have entry door(s) perpendicular to the front facade of the primary building shall meet the following design requirements:
(a) 
The garage shall be attached to the primary building.
(b) 
The garage shall have the same or greater front setback than the primary building.
(3) 
Rear entry garage. Garages which have entry door(s) that are on the opposite side of the primary buildings from the front facade must meet the following design requirements:
(a) 
The garage may be attached or detached from the primary building.
(b) 
The garage shall have the same or greater front setback than the primary building.
(c) 
Such garages shall be accessed by an alley to the rear, when feasible.

§ 350-25 Conditions for group homes.

The following conditions shall be met for any group home:
A. 
There shall be twenty-four-hour on-site supervision of the residents by persons qualified by training and experience to care for and supervise the residents of a group home.
B. 
All medical or counseling services provided shall be restricted to the residents of the group home, with no outpatient services.
C. 
All other applicable requirements of the Zoning Ordinance, building code, fire code and other applicable regulations shall be met.
D. 
All group homes shall be available for reasonable periodic inspections for building code and fire safety by appropriate Township employees.

§ 350-26 Conditions for Use C-4, Day-care center, adult/child, and Use C-5, Day-care home, family.

In addition to the requirements of the use regulations for Use C-4 and Use C-5 in Article IV, any day-care provider proposing to operate a day-care home shall, prior to the commencement of operation of such day-care home, obtain an annual day-care use permit from the Township and shall demonstrate compliance with the following conditions:
A. 
The use of the premises as a family day-care home or group day-care home shall not be the principal use of the property but shall be accessory to the use of the premises as a single-family dwelling unit. Accordingly, the day-care provider must have his or her principal place of residence at the same location as the proposed family day-care home or group day-care home and must be present on the premises during the hours of operation of such family day-care home or group day-care home. The hours of operation of any family day-care home or group day-care home shall be limited to between the hours of 7:00 a.m. and 7:00 p.m., prevailing time, Monday through Friday.
