Temporary Uses and Structures
A.
The following uses may be considered temporary uses and may require a permit from the City in accordance with the requirements of this Article:
1.
Farmers' market or seasonal sales in the C-1 Zone District. Farmers' market or seasonal sales means a temporary or permanent structure or vehicle used for the sale of agricultural produce or seasonal items.
2.
Sidewalk sale in the C-1 Zone District. Sidewalk sale means sales that are conducted by either the store owner or occupant, outside of his or her store, or by one or more commercial businesses, on a public or private sidewalk and/or adjacent pedestrian area.
3.
Mobile vendor in any zone district. Mobile vendor means a commercial establishment that sells goods and freshly made and/or packaged food items from motorized vehicles or a temporary structure instead of a storefront location.
4.
Public interest or special event in any zone district. Public interest or special event means outdoor gatherings, auctions, art sales, block parties and bake sales for the benefit of the community at large, or community service or nonprofit organizations. These events may also include, but are not limited to, outdoor concerts, auctions, carnivals, circuses, outdoor meetings and special entertainment at commercial properties.
B.
The City Administrator may approve other temporary uses under the permit process in this Article.
C.
Exceptions to temporary uses are:
1.
Garage sales in residential districts which meet all applicable requirements of the City; and
2.
City-sponsored events utilizing City property, public streets or the public right-of-way.

A.
An application for a temporary use permit shall contain the following:
1.
The name, address and phone number of the applicant on a completed application form supplied by the City.
2.
A description of the proposal, including a discussion of hours of operation, potential noise impacts, parking accommodation, impacts on adjacent property, any associated signs or lighting and provision for temporary utility services, as applicable.
3.
Proof of ownership and/or written owner permission.
4.
Application fee pursuant to the City's Fee and Fine Schedule .
5.
Any other information deemed appropriate by the City Administrator for complete review of the application.
B.
The following criteria shall be evaluated to determine whether to approve a temporary use:
1.
Whether the proposed temporary use will result in grading or other permanent alterations to the site or environmental damage;
2.
Whether the proposed temporary use is adverse to the public health, safety and welfare;
3.
Whether the proposed temporary use will result in the erection or installation of permanent buildings or structures;
4.
Whether the proposed temporary use will adversely affect surrounding uses; and
5.
Whether there is adequate parking for the use.
C.
The City Administrator is authorized to issue a permit for a temporary use and may impose such conditions on the permit as appropriate. Such permits shall not be issued for more than 180 days within any period of 12 consecutive months. The City Administrator is authorized to grant extensions to the permit for demonstrated good cause.
D.
The City Administrator is authorized to terminate a permit for a temporary use upon any violation of this Code and to order the temporary use to be ceased immediately.

Any temporary use occurring on public property or the public right-of-way shall require the applicant to obtain liability insurance with the minimum limits of the Colorado Governmental Immunity Act, as amended. The applicant shall provide the City proof of such insurance and shall name the City as an additional insured.

A.
Temporary structures are structures or buildings that are installed for a temporary purpose not to exceed 180 days within any period of 12 consecutive months. A permit shall be obtained from the City in accordance with the requirements of this Section.
B.
The City Administrator is authorized to issue a permit for a temporary structure and may impose such conditions on the permit as appropriate. Such permits shall not be issued for more than 180 days within any period of 12 consecutive months. The City Administrator is authorized to grant extensions to the permit for demonstrated good cause.
C.
Temporary structures shall conform to any applicable building regulations pursuant to Chapter 18 of this Code.
D.
The City Administrator is authorized to terminate a permit for a temporary structure upon any violation of this Code and to order the temporary structure to be immediately dismantled and removed.
E.
The City Administrator may refer an application for a temporary structure to the Building Official if necessary.

The name, address and phone number of the applicant on a completed application form supplied by the City.
2.
A description of the proposed structure, including the proposed material and how the structure will be attached to the ground, if attached.
3.
Application fee pursuant to the City's Fee and Fine Schedule .
4.
Any other information deemed appropriate by the City Administrator for complete review of the application.
B.
The following criteria shall be evaluated to determine whether to approve a temporary structure:
1.
Whether the proposed temporary structure will result in grading or other permanent alterations to the site, or environmental damage;
2.
Whether the proposed temporary structure is adverse to the public health, safety and welfare;
3.
Whether the proposed temporary structure will adversely affect surrounding uses; and
4.
Whether there is adequate parking for the use.

A.
It is unlawful to conduct a temporary use or erect a temporary structure on any property within the City without obtaining a permit under this Article.
B.
It is unlawful to fail to remove from the property, within 15 days after expiration of a temporary use or structure permit, all temporary uses and structures.

Application to conduct a special event shall be administered through the City's Facility Use-Special Events Policy.
