Nonconformities
A.
Except as otherwise provided in this Article, a nonconforming lot existing at the time of the enactment of the initial ordinance codified herein, of any pertinent amendment hereto or of annexation, if annexed subsequent to the effective date of this Chapter, devoted to a use permitted in the zone district in which it is located, may be continued in accordance with the provisions of this Article.
B.
A building containing uses permitted in the zone district may be developed on a lot of record that is nonconforming as to minimum lot size, provided that it can be located on the lot so that all other dimensional requirements are met, or a variance from such dimensional requirements is obtained pursuant to Article 11 of this Chapter and provided that the development complies with all other standards of this Chapter.
C.
No lot that is nonconforming as to minimum lot size as of the effective date the initial ordinance codified herein may be reduced in size in such a way that its nonconformity would increase.
D.
Adjacent nonconforming lots under the same ownership at the date they became nonconforming may not utilize this Section, nor may the successors in interest of these lots utilize this Section. The intent of this Section is to require undeveloped nonconforming lots to be combined with adjacent like lots to create conforming lots pursuant to Section 16-20-50 of this Chapter.

A.
Except as otherwise provided in this Section, the lawful use of land or structures existing at the time of the enactment of the initial ordinance codified herein, any pertinent amendment hereto or at the time of annexation, if annexed subsequent to the effective date of this Chapter, may continue even though it does not conform to the requirements of this Chapter.
B.
Normal maintenance, repair or alterations may be performed to permit continuation of a nonconforming use.
C.
Nonconforming uses may not be extended or expanded.
D.
A nonconforming use shall not be changed to any other use unless the new use conforms to the provisions of the zone district in which it is located.
E.
Where a nonconforming use of land or nonconforming use of structure is abandoned or discontinued for a period of one year, the use may not be reestablished or resumed, and any subsequent use must conform to the provisions of this Code.
F.
If any nonconforming use in a structure is removed, it shall no longer be lawful to use structure except in compliance with this Chapter.
G.
If a structure housing a nonconforming use is damaged or destroyed to the extent of more than 50 percent of its replacement cost as determined by the City, it shall only be reconstructed in compliance with the provisions of this Chapter.

If any nonconforming structure is removed, it shall no longer be lawful to use such structure except in compliance with this Chapter.
F.
If a nonconforming structure is damaged or destroyed to the extent of more than 50 percent of its replacement cost as determined by the City, it shall only be reconstructed in compliance with the provisions of this Chapter.
G.
A legal nonconforming mobile home may be replaced by another mobile home that will fit on the existing pad. All such mobile home replacements shall require a certificate of occupancy. The mobile home that was replaced shall be removed from the City within 30 days of replacement.
