ARTICLE 5

Residential R-1 Zone District

Sec. 16-5-10.- Purpose and objectives.

The purpose of the R-1 Zone District is to promote the continuance of single-family neighborhoods and preserve the character and appearance of the existing residences and neighborhoods. The objectives of the R-1 District are to:

1.

Retain the residential areas as quiet, clean and safe residential neighborhoods;

2.

Allow for limited home-based businesses, to help provide homeowners with additional economic means for maintaining permanent residency; and

3.

Ensure that new development is consistent with the appearance and character of the existing residences and neighborhoods.

Sec. 16-5-20. - Use regulations.

A.

Permitted principal uses allowed are single-family dwellings, including modular homes, but not mobile or manufactured homes.

B.

Permitted accessory uses allowed are uses which are customarily incidental to any of the principal uses and are located on the same parcel.

Garages, greenhouses, storage units or sheds which have a permanent foundation or are securely anchored to the ground, are no larger than 120 square feet and have a maximum height of eight feet. These structures must be pre-fabricated or constructed using a rigid framework with inflexible clear glass or plexiglass. No opaque or colored plastic panels, plastic sheeting, fabric walls or tarps are permitted in connection with these structures. Intermodal shipping containers are not permitted on any lot.

Home-based occupations. A home-based business shall be allowed as a permitted accessory use, provided that all of the following conditions are met:

a.

Such use shall be clearly incidental and secondary to the use of the dwelling and shall not change the character thereof.

b.

The business owner or operator must reside and maintain primary residency within the principal single-family dwelling unit on the parcel.

c.

The total area used for such accessory purposes shall not exceed 50 percent of the gross floor area.

d.

There shall be no exterior advertising other than identification of the home occupation; such sign shall not be larger than two square feet and shall not be illuminated.

e.

There shall be only incidental sale of stocks, supplies, or products conducted on the premises.

f.

The storage of heavy equipment, implements and business-related supplies that unreasonably negatively impact the neighborhood is prohibited.

C.

Conditional uses include any use determined by the City Council to be compatible with Section 16-5-10 of this Chapter.

Sec. 16-5-30. - Dimensional requirements.

A.

Lot size . The minimum lot size is 6,250 square feet.

B.

Setbacks. The following are mandatory setbacks, except for unusual circumstances which may require an adjustment to conform to existing structures in the neighborhood.

1.

Front: Due to the unique nature of the historic architecture in the residential areas, all new construction must apply for setback approval through the zoning application process per Section 16-10-10 of this Chapter. When determining an appropriate front setback, consideration shall be given to maintaining consistency with existing front setbacks for other structures located near the property and to ensure protection for existing buildings on safety matters.

Side: 7.5 feet.

3.

Rear: 15 feet.

4.

Fences are not subject to setback requirements.

C.

Front facade . The front facade of a building may be no less than 22 feet in width.

D.

Lot lines . No buildings may be constructed over a lot line, even if the adjoining lot is under common ownership.

Sec. 16-5-40. - Development standards.

In addition to the criteria required to be considered in the planning review stage as described in this Chapter, the City Council shall consider whether the development is located, sited and designed to be non-obtrusive, to blend in with the existing natural environment and to minimize disruption to existing terrain, vegetation, drainage patterns, natural slopes and any distinctive natural features.
