ARTICLE 4

Commercial C-1 Zone District

Sec. 16-4-10.- Purpose and objectives.

The purpose of the C-1 Zone District is to encourage a broad range of commercial services for visitors and residents, which are conveniently accessible and which are designed to complement each other in character, scale and proximity. The objectives of the C-1 Zone District are to:

1.

Accommodate retail sales, services and entertainment facilities which are oriented to serving a majority of the needs of residents and visitors and which generate substantial volumes of traffic.

2.

Encourage well-planned, attractive clusters or groupings of development that complement existing historic features.

3.

Encourage a mix of complementary commercial uses that share ingress and egress and clustered on-site parking, and that are linked by attractive pedestrian corridors and plazas.

4.

Provide for limited mixed use with commercial uses on the street level and residential uses on the floors above.

Sec. 16-4-20. - Use regulations.

A.

Permitted principal uses are those that are like or similar to one or more of the following:

1.

Retail stores, including antique stores, thrift stores, book stores, candy or tobacco stores, camera shops, jewelry stores, gift shops, liquor stores, drugstores, appliance stores, clothing stores, paint shops, sporting goods, hardware stores, etc.

2.

Furniture and upholstery stores.

3.

Automobile mechanic shops with interior vehicle storage; small engine and appliance repair (i.e., lawnmowers, chainsaws, sewing machines, vacuums, etc.).

4.

Lodging accommodations.

5.

Restaurants, coffee shops and internet cafes; food and drink manufacturing and preparation facilities (i.e., brewery, bakery, coffee roasting, etc.).

6.

Indoor recreation and amusement, including bowling alleys, movie theatres, dance academies, video arcades, pool halls, gyms and health clubs, fraternal organizations and music and vocal instruction.

7.

Bars and lounges.

8.

Offices (i.e., real estate, property management, newspaper, attorney, accountant, etc.).

9.

Guides and outfitters and historical tour guides.

10.

Parks, parking lots and common areas.

11.

Post offices, financial institutions and banks.

12.

Art galleries and studios.

13.

Recreational transportation or equipment rental shops (i.e., bicycles, OHVs, sports equipment, etc.)

14.

Community and government buildings, libraries, museums and aquariums.

15.

Copying, printing, shipping and office supply businesses.

16.

Pet supply or grooming shops, with live animal sales limited to birds, fish, small rodents and reptiles.

17.

Beauty and nail salons, barbershops and tattoo parlors.

18.

Medical and dental offices, clinics and laboratories.

19.

Nursery sales of flowers and plants (not marijuana).

20.

Single-family residential uses, provided that the single-family residential use is only on the floors above the street level.

B.

Permitted accessory uses are those uses which are customarily incidental to any of the permitted principal uses and are located on the same parcel, such as:

1.

Dumpster enclosures.

2.

Garages, greenhouses, storage units or sheds which have a permanent foundation or are securely anchored to the ground, are no larger than 120 square feet and have a maximum height of eight feet. These structures must be pre-fabricated or constructed using a rigid framework with inflexible clear glass or plexiglass. No opaque or colored plastic panels, plastic sheeting, fabric walls or tarps are permitted in connection with these structures. Intermodal shipping containers are not permitted on any lot.

C.

Conditional uses are any use determined by the City Council to be compatible with this Section.

Sec. 16-4-30. - Dimensional requirements.

A.

Setbacks . Due to the unique nature of the historic architecture in the downtown commercial area, all new development must apply for setback approval through the zoning application process per Section 16-10-10 of this Chapter. When determining an appropriate front setback, consideration shall be given to maintaining consistency with existing front setbacks for other structures located near the property and to ensure protection for existing buildings on safety matters (e.g., firewalls). Fences shall not be subject to setback requirements.

B.

Lot lines . No buildings may be constructed over a lot line even if the adjoining lot is under common ownership.

C.

Maximum height . The maximum height of all structures in the C-1 Zone District shall be 30 feet.

Sec. 16-4-40. - Development standards.

A.

All development shall be designed so that, for the given location, egress points, grading and other elements of the development satisfy the requirements set forth below to the greatest extent practicable:

1.

Reduce the number of access points onto an arterial or collector street;

2.

Minimize adverse impacts on any existing or planned uses;

3.

Improve pedestrian or vehicle safety within the site and egress from it;

4.

Reduce the visual intrusion of parking areas, screened storage areas and similar accessory areas and structures;

5.

Complement existing development in scale and location; and

6.

Create pocket parks or green spaces that are accessible to the public, if practicable.

B.

In addition to the criteria required to be considered in the planning review stage as described in this Chapter, the City Council shall consider whether the development is located, sited and designed to be non-obtrusive, to blend in with the existing natural environment and to minimize disruption to existing terrain, vegetation, drainage patterns, natural slopes and any distinctive natural features.
