165.21 SIGNS

   1.   General Provisions.
      A.   Applicability. All permanent, temporary and portable signs shall meet all requirements as set forth in this section.
      B.   Permit Required. A zoning certificate pursuant to the provisions of Section 165.26 shall be required for all signs except temporary garage sale, open house, window signs and real estate signs.
      C.   Area Defined. The area of a sign shall be determined as follows:
         (1)   The total area of all permanent exterior signs visible from a public way.
         (2)   The total area of permanent signs placed upon the surface of windows and doors visible from a public way.
         (3)   The total area within the outline enclosing the lettering, modeling or insignia of signs integral with the wall and not designed as a panel.
      D.   Corner Lot Frontage. A building or use having frontage on two streets may include 20 percent of the length of the lot facing the second street.
      E.   Removal of Certain Signs. The following signs shall be removed at the owner’s expense:
         (1)   Any existing sign which previously advertised a bona bide business or product sold shall be removed after 30 days after the date on which the bona fide business no longer exists on the site of the sign.
         (2)   Any existing sign which advertises, promotes, or advocates for an event that occurs on a specific date shall be removed within 14 days after said specific event.
      F.   Interference. No billboard, signboard or similar advertising signs shall be located at an intersection so as to obstruct vision, hearing, pedestrian or vehicular safety, or the use and enjoyment of the adjoining property.
   2.   Size and Setback Requirements.
      A.   Side yard and rear yard setbacks shall be the same as for structures in each zoning district.
      B.   Front yard setbacks and size requirements shall be in accordance with the following schedule:

      C.   Signs accessory to roadside stands shall be limited to two signs per lot with no sign being larger than 10 square feet in area and set back at least 10 feet from the right-of-way of a street, highway or road.
   3.   Signs Permitted in the R-1 District.
      A.   Real estate signs of a temporary nature.
      B.   A sign or signs flat against a building appertaining to a nonconforming use on the premises, not exceeding in the aggregate 50 square feet in area except as may be authorized by the Board of Adjustment.
      C.   Small announcement or professional signs, not over six square feet in area, except that an announcement sign or bulletin board not over 18 square feet in area, set back at least 20 feet from any highway, street or road, may be erected in connection with any of the permitted principal uses of nonresidential nature.
      D.   One nameplate not exceeding two square feet for each dwelling.
   4.   Signs Permitted in the R-S District. Signs as permitted and regulated in Subsection 3 of this section.
   5.   Signs Permitted in the R-2 District. Signs as permitted and regulated in Subsection 3 of this section.
   6.   Signs Permitted in the R-3 District.
      A.   Signs permitted and regulated in Subsection 5 of this section.
      B.   Signs flat against the building, appertaining to any of the permitted principal uses of a nonresidential character.
   7.   Signs Permitted in the R-4 and R-5 Districts. Signs as permitted and regulated in Subsection 6 of this section.
   8.   Signs Permitted in the B-1 District.
      A.   Signs as permitted and regulated in Subsection 7 of this section, except as hereinafter modified.
      B.   The total area of all signs permitted on any one lot shall not exceed two times the number of linear feet the lot abuts on the street.
      C.   Projecting signs at least eight feet above the sidewalk and extending no further than five feet from the building to which it is attached.
   9.   Signs Permitted in the B-2 District.
      A.   Signs as permitted and regulated in Subsection 8 of this section, except as hereinafter modified.
      B.   Billboards and signboards subject to the same height and location requirements as other structures in the B-2 District and also subject to the following conditions and restrictions:
         (1)   No billboard, signboard or similar advertising signs shall be located at intersections so as to obstruct vision, hearing or interfere with pedestrian or vehicular safety.
         (2)   No billboard, signboard or similar advertising signs shall be located within 50 feet of any lot in an R-1 District or within 40 feet of any lot in an R-2 or R-3 District.
         (3)   No billboard or signboard shall exceed 300 square feet in area.
         (4)   No billboard, signboard or similar advertising signs shall be so constructed or located where it will unreasonably interfere with the use and enjoyment of adjoining property.
      C.   Elevated signs at least five feet from any lot line.
   10.   Signs Permitted in the I-1 District. Signs as permitted and regulated in Subsection 9 of this section.
   11.   Signs Permitted in the I-2 District. Signs as permitted and regulated in Subsection 10 of this section.
