ARTICLE 405

XII I-3 HEAVY INDUSTRIAL DISTRICT

405.610: GENERAL DESCRIPTION

This district is intended for heavy industrial uses and other uses that may pose a hazard to the public. The intensity of the uses in this district require that safeguards be established to protect the public from the potential hazard. (Ord. No. 710, 11-15-90)

405.620: USES PERMITTED UPON REVIEW ONLY

The following uses or the manufacture, compounding, processing, packaging or treatment of products not specifically listed below, but which may have accompanying hazards such as fire, explosion, noise, vibration, dust or the emission of smoke, odor, toxic gases or other pollutants, may be located in an 1-3 Heavy Industrial District, if not in conflict with any Federal or State law, only after the location and nature of such use shall have been approved by the Planning & Zoning Commission after a public hearing. The Planning & Zoning Commission shall review the plans and statements and shall not permit such buildings, structures or uses until there has been shown that the public health, safety, morals and general welfare will be properly protected, and the necessary safeguards will be provided for the protection of streams or other water areas or surrounding property and persons. The Planning & Zoning Commission, in reviewing the plans and statements, shall consult with other agencies created for the promotion of public health and safety.

  1. Acetylene generation and storage.
  2. Adhesives, glue or sizing.
  3. Alcohol, industrial.
  4. Ammunition and explosives storage.
  5. Asbestos products.
  6. Asphalt or asphalt products, or central asphalt mixing or batching.
  7. Automobile wrecking yard.
  8. Candles, including wax or tallow manufacture.
  9. Concrete products or central mixing and proportioning plant and cement manufacture.
  10. Distillery (alcoholic), breweries and makers of alcoholic spirits (nonindustrial).
  11. Engine testing (internal combustion engines), but not jet engines or rockets.
  12. Film, photographic.
  13. Fish curing or smoking, fish oils and meal.
  14. Flour, feed and grain milling.
  15. Galvanizing or plating (hot dip).
  16. Glass and glass products.
  17. Hides and raw fur, curing, tanning, dressing, dyeing and storage.
  18. Insecticides, fungicides, disinfectants or related industrial or household chemical compounds.
  19. Junk yards, open or enclosed storage of junk.
  20. Leather tanning and curing.
  21. Linoleum and other hard-surface floor coverings, except wood.
  22. Match manufacture.
  23. Meat or fish products, including slaughtering of animals or poultry or preparation of fish for packing.
  24. Oils, shortenings and fats (edible), manufacture and storage.
  25. Paint, oil, shellac, turpentine or varnish.
  26. Petroleum storage.
  27. Plastic material and synthetic resins, processing only.
  28. Railroad yards.
  29. Starch manufacture.
  30. Stockyard.
  31. Wood preserving treatment.
  32. Quarry with rock crushing operation. (Ord. No. 710, 11-15-90)

405.630: AREA REGULATIONS

  1. Minimum Lot Area. No minimum lot area is required in an I-3 Heavy Industrial District.
  2. Minimum Front Yard. No building or structure shall be erected closer than thirty (30) feet from the right-of-way line of any street or highway.
  3. Minimum Side Yards. No building or structure shall be erected closer than thirty (30) feet to any lot line, except where the lot abuts upon a lot zoned for residential purposes, in which event there shall be a side yard of no less than fifty (50) feet and further the side yard adjoining a lot zoned for residential purposes shall be completely screened from view with a permanent screening material.
  4. Minimum Rear Yard. The minimum rear yard shall not be less than thirty (30) feet except where the lot abuts upon a lot zoned for residential purposes, in which event there shall be a rear yard not less than fifty (50) feet and further, the rear yard shall be completely screened from view with a permanent screening material.
  5. Percentage Lot Coverage. All buildings and structures including accessory buildings shall not cover more than forty percent (40%) of the lot. (Ord. No. 710, 11-15-90)

405.640: HEIGHT REGULATIONS

No building or structure shall exceed forty (40) feet in height. (Ord. No. 710, 11-15-90)

405.650: USE REGULATIONS

Uses with an I-3 Heavy Industrial District must comply with the following requirements. Compliance with these restrictions shall be certified by the Zoning Administrator. If at any time compliance with the requirements and restrictions cease, it shall be considered a violation of this Chapter and the penalty provisions shall apply.

  1. All open storage and display of merchandise, material equipment shall be so screened by ornamental fencing or evergreen planting that it cannot be seen by a person standing on ground level in a residential district when located to the side or rear of the lot on which said open storage or display occurs; provided however, that screening shall not be required in excess of seven (7) feet in height. All planting shall be kept neatly trimmed and maintained in good condition at all times.
  2. All yards unoccupied with buildings, merchandise, equipment or materials or used as traffic-ways shall be landscaped with grass and shrubs and maintained in good condition the year round.
  3. All of the lot used for parking of vehicles, for the storage of merchandise, equipment and materials and all driveways used for vehicle ingress and egress shall be paved with a sealed surface pavement and maintained in such a manner that no dust will be produced by continued use.
  4. All servicing of vehicles and assembly of equipment carried on as an incidental part of the operation shall be conducted within a completely enclosed building.
  5. Driveways used for ingress and egress shall not exceed twenty-five (25) feet in width, exclusive of curb returns.
  6. Outdoor lighting, when provided, shall have an arrangement of reflectors and an intensity of lighting that will not interfere with adjacent streets, and shall not be a flashing or intermittent type.
  7. No use shall disseminate dust, fumes, gas, noxious odors, smoke, glare or other atmospheric influence beyond the boundaries of the property on which such use is located.
  8. No use shall produce any noise that exceed the average intensity of noise of street traffic at the boundaries of the property.
  9. No use shall create a fire hazard on surrounding property. (Ord. No. 710, 11-15-90)

405.660: COMPLIANCE REVIEW REQUIREMENTS

No building or structure shall be built, used or occupied within an I-3 Heavy Industrial District until and unless the following conditions are met and certified by the Zoning Administrator.

  1. A plot plan indicating the location of present and proposed buildings, driveways, parking lots and other necessary uses.
  2. Preliminary architectural plans for the proposed building or buildings.
  3. An estimate of the maximum number of employees contemplated for the proposed development and the number of shifts during which they would work.
  4. Any other information that is needed to adequately consider the affect that the proposed use(s) may have upon the environment and on the cost of providing municipal services to the area. All sewage disposal systems must be approved by the County Health Officer before a building or zoning permit is issued. (Ord. No. 710, 11-15-90)
