ARTICLE 405

III R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT

405.150: USES PERMITTED

Except as otherwise provided in this Chapter, the following uses shall be permitted in an R-1 Single-Family Residential District.

  1. Single-family dwellings.
  2. Parks, playgrounds, libraries and community buildings owned or operated by the City.
  3. Home occupations, as regulated by Article XIII, Section 405.690, Subsection (B) of this Chapter.
    1. Accessory buildings and uses customarily incidenta1 to the above uses not involving the conduct of a business, including servant’s quarters for persons employed on the premises and one (1) private garage or private stable.
    2. Any accessory building that is not a part of the main structure shall be located not less than sixty (60) feet from the front lot line.
    3. Accessory uses shall also include churches or public building bulletin boards and temporary real estate signs pertaining to the sale, lease or renting of a building or premises, not exceeding ten (10) square feet in area.
  4. Temporary buildings for use incidental to construction work, which buildings shall be removed upon the completion or abandonment of the construction work. (Ord. No. 710, 11-15-90)

405.160: AREA REGULATIONS

The following area regulations shall apply within a R-1 Single-Family Residential District.

  1. Minimum lot area. The minimum lot area per dwelling unit shall be seven thousand five hundred (7,500) square feet, except when lot or tract has less area than herein required and was recorded under separate ownership from adjoining property on March 11, 1976, such lot or tract of land may be used for any use permitted in this district. If the lot is not connected to the Municipal Sanitary Sewer System the requirements contained in Section 620.030, as amended from time to time, must be satisfied.
  2. Minimum lot widths.
    1. No lot may be created that is so narrow or otherwise so irregularly shaped that it would be impracticable to construct on it a building that:
      1. Could be used for purposes that are permissible in that zoning district, and
      2. Could satisfy any applicable setback requirements for that district.
    2. Determination of minimum lot width. The lot width shall be measured along a straight line connecting the points at which a line that demarcates the building site and from the street intersects with the lot boundary line at opposite sides of the lot.
    3. The building site must meet all setback requirements.
  3. Minimum front yard.
    1. The minimum front yard depth shall be twenty-five (25) feet.
    2. Where a lot has a double frontage, the required front yard depth shall be provided on both streets.
    3. Where a lot is located at the intersection of two (2) or more streets there shall be a front yard depth of twenty-five (25) feet on each side of a corner lot.
    On a corner lot no accessory building or structure shall project into the required front yard located adjacent to either street.
  4. Minimum side yard. There shall be a side yard on each side of a dwelling of not less than eight (8) feet.
  5. Minimum rear yard. The minimum rear yard depth shall be twenty-five (25) feet. (Ord. No. 710, 11-15-90; Ord. No. 1264 §l, 8-17-06)

405.170: HEIGHT REGULATIONS

The maximum height of buildings in an R-1 Single-Family Residential District shall not exceed two and one-half (2 1/2) stories or thirty-five (35) feet above the average finished grade. (Ord. No. 710, 11-15-90)
