ARTICLE 405

VII C-1 NEIGHBORHOOD COMMERCIAL DISTRICT

405.330: GENERAL DESCRIPTION

This commercial district is for the conduct of retail trade and to provide personal services to meet the regular needs and for the convenience of people of adjacent residential areas. Because these shops and stores may be an integral part of the neighborhood closely associated with residential, religious, recreational and educational elements, more restrictive requirements for air, light, open space and off-street parking are made than are provided in other commercial districts. 405.340: USES PERMITTED

The following uses shall be permitted in C-1 Districts:

  1. Food retail stores.
  2. Drug stores.
  3. Personal service uses including shoe repair, beauty parlor, barber shop, professional offices and clinics.
  4. Laundromat and dry-cleaning outlets.
  5. Restaurants, lunch rooms and boarding houses.
  6. Accessory retail or service uses that are necessary for convenience of residential districts subject to review by the Planning & Zoning Commission to insure conformity to the intent of the Chapter.
  7. Accessory residential use when owner or operator of commercial use has a dwelling unit contiguous to business establishment.
  8. Mixed-Use Low-Intensity to include residential/commercial usage such as:
    1. Single-use detached one- or two-family residential.
    2. Single-use garden apartments, townhouses, and condominiums.
    3. Mixed-building attached studio apartments.
    4. Mixed-building attached condominiums.
  9. Medical marijuana dispensary facilities. (Ord. No. 710, 11-15-90)

405.350: AREA REGULATIONS

  1. Minimum Lot Area. The minimum lot area of any lot in a C-1 District shall be seven thousand five hundred (7,500) square feet.
  2. Minimum Front Yard. No building or structure shall be erected closer than twenty-five (25) feet from the right-of-way line of any street or highway.
  3. Minimum Side Yard. No side yard is required for any permitted commercial use, except where the lot abuts upon a lot zoned for residential purposes, in which event there shall be a side yard of not less than ten (10) feet.
  4. Minimum Rear Yard. The minimum rear yard shall not be less than thirty (30) feet and when the rear yard adjoins a residential district the rear yard shall be completely screened from view with a permanent screening material. (Ord. No. 710, 11-15-90)

405.360: PERCENTAGE LOT COVERAGE

All buildings including accessory buildings shall not cover more than forty percent (40%) of the lot. (Ord. No. 710, 11-15-90)

405.370: HEIGHT REGULATIONS

Three and one-half (3 1/2) stories or forty-five (45) feet plus one (1) foot for each additional two (2) feet of setback provided on each side of the structure up to seventy-five (75) feet. Above seventy-five (75) feet, no additional setback is required. (Ord. No. 710, 11-15-90; Ord. No. 958 §1-2, 5-21-98)
