The Building Official shall not grant a permit for the construction or alteration of any building or structure if such construction or alteration would be in violation of any of the provisions of this chapter; nor shall any city officer grant any permit or license for the use of any building or land if such use would be in violation of this chapter.
(A) It shall be the duty of the Building Official to inspect, or cause to be inspected, all buildings in the course of construction or repair. He or she shall enforce the provisions of this chapter, entering actions in the courts when necessary, and his or her failure to do so shall not legalize any violation of such provisions.
(B) No city official shall issue any permit unless the plans of, and for, the proposed erection, construction, reconstruction, alteration, and use fully conform to all zoning regulations then in effect.
§ 157.018 FEES FOR PROCESSING ZONING PETITIONS AND PLANNED RESIDENTIAL UNIT DEVELOPMENTS.
(A) Fees relating to zoning map amendments, ordinance amendments, commercial site plans, conditions uses, Hearing Officer applications or petitions, annexations, appeals, and other activities as may from time to time be authorized by the City Council.
(B) Fees for processing zoning petitions, conditional use applications, Hearing Officer applications, excavation applications, and other activities as authorized by the City Council, shall be recommended by the Planning Commission for consideration for adoption by the City Council and such fees as are approved by the City Council shall be collected by the City Recorder.
(C) The fee schedule shall be in accordance with the West Haven City Consolidated Fee Schedule. The West Haven City Consolidated Fee Schedule is hereby adopted by reference.
All departments, officials, and public employees of the city vested with the duty or authority to issue permits or licenses shall conform to the requirements of this chapter and shall issue no permit or license for uses, buildings, or purposes where the same would be in conflict with the provisions of this chapter, and any such permit or license, if issued in conflict with the chapter, shall be null and void.
Should any section, clause, or provision of this chapter be declared by the courts to be invalid, the same shall not affect the validity of the chapter or any part thereof, other than the part so declared to be invalid.
