§ 157.060 BOUNDARIES.

   For the purpose of this chapter, the city, to which this chapter applies, is divided into 25 classes of zones as follows:

§ 157.061 HEIGHT-LIMITING ZONES.

   In addition to the zones hereinabove established, all the land within the boundaries of the city, and within 50,000 feet of the established airport reference points at Hinckley Municipal Airport in the county and Hill Air Force Base in Davis County, is hereby divided into the following listed height limiting zones:
   (A)   Horizontal Surface Zone;
   (B)   Approach Surface Zone;
   (C)   Transitional Surface Zone;
   (D)   Concial Surface Zone;
   (E)   Turning Zone; and
   (F)   Clear Zone.

§ 157.062 BOUNDARIES OF ZONES.

   The boundaries of each of the said zones are hereby established as described herein, or as shown on the map entitled “Zoning Map of West Haven” and maps entitled “Airport Zoning Map of Weber County” and “Planning District Maps,” which map or maps are attached and all boundaries, notations, and other data shown thereon are made by this reference as much a part of this chapter as if fully described and detailed herein.

§ 157.063 MAPS OF DISTRICTS.

   Each of the districts of the city which are hereby amended or zoned are shown on maps attached to this chapter, and such maps are made by this reference as much a part of this chapter as if fully described and detailed herein.

§ 157.064 TITLE OF ZONING MAP.

§ 157.065 FILING OF SUBCHAPTER AND MAPS.

   This chapter and the maps shall be in the custody of the City Recorder, and may be examined by the public subject to any reasonable regulations established by the Recorder.

§ 157.066 RULES FOR LOCATING BOUNDARIES.

   Where uncertainty exists as to the boundary of any zone, the following rules shall apply.
   (A)   Wherever the zone boundary is indicated as being approximately upon the centerline of a street, alley, or block, or along a property line, then, unless otherwise definitely indicated on the map, the centerline of such street, alley, or block of such property line shall be construed to be the boundary of such zone.
   (B)   Whenever such boundary line of such zone is indicated as being approximately at the line of any river, irrigation canal, or other waterway or railroad right-of-way, or public park or other public land, or any section line, then in such a case, the center of such stream, canal, or waterway, or of such railroad right-of-way, or the boundary line of such public land or such section line, shall be deemed to be the boundary of such zone.
   (C)   Where such zone boundary lines cannot be determined by the above rules, their location may be found by the use of the scale appearing upon the map.
   (D)   Where the application of the above rules does not clarify the zone boundary location, the Board of Adjustment shall interpret the map.

§ 157.067 CONDITIONS TO ZONING MAP AMENDMENT.

   (A)   In order to provide more specific land use designations and land development suitability, to ensure that proposed development is compatible with surrounding neighborhoods, and to provide notice to property owners of limitations and requirements for the development of property, conditions may be attached to any zoning map amendment which limit or restrict the following:
      (1)   Uses;
      (2)   Dwelling unit density;
      (3)   Building square footage; and
      (4)   Height of structures.
   (B)   A zoning map amendment attaching any of the conditions set forth in division (A) above shall be designated “ZC” after the zoning classification on the zoning map, and any such conditions shall be placed on record with the City Planning Commission and recorded with the City Recorder.
   (C)   In the event any zoning condition is declared invalid by a court of competent jurisdiction, then the entire zoning map amendment shall be void.
   (D)   Any deletion in, or change to, zoning conditions shall be considered an amendment to the zoning ordinance and shall be subject to the requirements of this chapter.
   (E)   The attachment of conditions to any zoning map amendment shall not affect the applicability of other ordinance provisions.
