§ 14.02.016 "B-3

Central business district.

(a) 
General purpose and description.
The "B-3" district is intended to provide a zoning category to meet the special needs and interests of the historically central commercial area of the community. A variety of commercial uses are permitted although all permitted activities are conducted within a building or structure.
(b) 
Use regulations.
(1) 
A building or premises shall be used only for the following purposes:
(A) 
Uses permitted in the B-1 district.
(B) 
Building material sales (no outside sales or storage).
(C) 
Secondhand store, furniture, or clothing, indoors,[.]
(D) 
Single-family residential attached and multifamily dwellings.
(E) 
Boarding and rooming house.
(F) 
Open market sales.
(2) 
The following specific uses shall be permitted in a B-3 district when granted in accordance with section 14.02.023:
(A) 
Wine tasting rooms.
In addition to general requirements, wine-tasting rooms shall be subject to the provisions:
(i) 
A valid license issued by the Texas Alcoholic Beverage Commission shall be held by the establishment at all times, and the conditions of any such license shall be adhered to by the operator of the establishment at all times;
(ii) 
Only wine, nonalcoholic beverages and food other than meals, such as appetizers, tapas, snacks and similar types of food may be served. For purposes of this section, "meals" shall mean an assortment of foods commonly ordered in bona fide, full-service restaurants as principal meals of the day;
(iii) 
Wine and nonalcoholic beverages may be sold at retail for on-premises consumption and for off-premises;
(iv) 
There shall be no sale or consumption of wine on the premises between midnight and ten o'clock (10:00) a.m.; and
(v) 
Live music shall be performed only inside the establishment and doors and windows shall remain closed during such performances, except during the actual ingress and egress of patrons and employees.
(B) 
Other uses as listed in section 14.02.022 of this article.
(c) 
Height regulations.
No building shall exceed one hundred (100) feet in height, except cooling towers, vent stacks or mechanical equipment rooms may project not more than twelve (12) feet beyond maximum building height.
(d) 
Area regulations.
(1) 
Size of yard.
(A) 
Front yard.
None required.
(B) 
Side yard.
None required, except where a B-3 district abuts a residential district in which case a minimum side yard of ten (10) feet shall be provided. The side yard setback from a side street shall be twenty-five (25) feet.
(C) 
Rear yard.
None required, except where a B-3 district abuts a residential district (whether separated by an alley or not) in which case a minimum back yard of ten (10) feet shall be provided.
(2) 
Size of lot.
(A) 
Minimum lot size.
None.
(B) 
Minimum lot width.
None.
(C) 
Minimum lot depth.
None.
(3) 
Lot coverage.
The maximum lot coverage by buildings shall be sixty (60) percent of the lot area.
(e) 
Parking requirements.
Off-street parking and loading shall be provided as asset forth in section 14.02.024
