CHAPTER 10

NONCONFORMING USES

10-10-1: ILLEGAL STRUCTURES AND USES:

   A.   Declared Nuisance: Any building or structure erected or maintained or any use of property contrary to the provisions of this title is unlawful and a public nuisance.
   B.   Abatement: The city attorney shall, upon order of the city council, immediately commence an action or proceeding for the abatement, removal and enjoinment thereof in the manner provided by law and shall take such other steps, and shall apply to such court as may have jurisdiction, to grant such relief as will abate or remove such building or use and restrain and enjoin any person from erecting or maintaining such building or using any property contrary to the provisions of this title. 10-10-2: CONTINUATION OF LAWFUL NONCONFORMING USE:

A lawful use of land or buildings, not in conformance with the regulations for the district in which it is located, existing on November 8, 1963, may be continued, except as provided in this section:
   A.   Discontinued Use: If a nonconforming use is discontinued for a period exceeding six (6) months, the use of such land or building thereafter shall be subject to the provisions of this title and full compliance therewith required.
   B.   Extended Or Expanded: The nonconforming use of land or buildings shall not be extended or expanded in any way and shall not be changed except to a conforming use, or as may be required to bring such use of land or building into conformity.
   C.   Applicability: The provisions of this section shall apply to uses of property or to buildings which may become nonconforming by reason of amendment or supplement to this title, or by reason of annexation, to the city. (1973 Code § 17.60.020)
