CHAPTER 3

DISTRICTS GENERALLY

10-3-1: ESTABLISHED AND ENUMERATED:

In order to classify, regulate, restrict and segregate the use of land, the location, use and bulk of structures, and to carry out the purposes of this title, land use districts are established, as follows:

10-3-2: FACTORS IN COUNCIL CONSIDERATIONS:

In the creation of this title and land use plan, the city council has given careful consideration to the suitability of each district for the regulations applied thereto, and the location and extent of each district and the comprehensive grouping and arrangement of the various uses and the densities of populations in accordance with a well considered plan for the development of the city and its desirable relationship to adjoining jurisdictions. (1973 Code § 17.20.020)

10-3-3: VACATED RIGHTS OF WAY:

Where a dedicated street or alley is abandoned, the regulations applicable to abutting properties shall apply to that portion of such right of way as vacated. (1973 Code § 17.20.030)

10-3-4: ANNEXED LANDS:

Land annexed to the city shall, upon date of annexation, be classified by the planning commission and city council in a zone appropriate to its location and relationship to the master plan. (1973 Code § 17.20.040)

10-3-5: APPLICABILITY:

   A.   The provisions of this title are in effect upon all land within the boundaries of each district established.
   B.   No lot or parcel of land, nor any building, shall be used or occupied for any purpose or in any manner not specifically permitted in the regulations as applicable to the land use district in which such lot or building is situated. (1973 Code § 17.20.050)

10-3-6: ZONING MAP:

   A.   Adopted By Reference: The districts enumerated in section 10-3-1 of this chapter and boundaries of said districts are established and adopted as shown on that map entitled "Land Use Map, A Part Of The Master Plan Of Yerington, Nevada", which map is made a part of this title together with all notations, references, date and other information thereon.
   B.   Amendments: All subsequent changes and amendments to the plan or this title shall be equally effective as if incorporated in the plan as adopted. (1973 Code § 17.20.060)
   C.   Interpretation Of Boundaries: Where uncertainty exists as to the boundaries of land use districts as shown on the zoning map, the following applies:
      1.   Boundaries are intended to parallel street lines or to follow lot lines as they existed on November 8, 1963, unless specifically shown otherwise.
      2.   In cases of uncertainty, the planning commission shall interpret the intent of the boundary location. (1973 Code § 17.20.070)

10-3-7: USES:

   A.   Prohibition: The express enumeration in this title of a particular class of building or use in any district shall be determined a prohibition of such building or use in all more restrictive districts unless so specified. (1973 Code § 17.20.080)
   B.   Within Hotels And Motels: A hotel or motel may contain such business uses as are customary and incidental thereto, providing such business uses, unless otherwise permitted, have all public entrances thereto restricted to the interior of the hotel and no advertising or displays are visible from the outside thereof. (1973 Code § 17.20.090)

10-3-8: LOTS DIVIDED INTO SEPARATE OWNERSHIPS:

Where a lot is divided into separate ownerships, and the area of either portion is such that the number and location of buildings thereon no longer conform to the lot area requirements of the districts, in the determination of the permissive number and location of buildings on either portion, both parts shall be considered as one unit. (1973 Code § 17.20.100)

10-3-9: SETBACKS:

   A.   Construction Prohibited: No building shall be constructed within the setback distance and no portion of a building extended into said distance shall be altered.
   B.   Accessory Or Temporary Buildings: Accessory buildings and temporary buildings less than two hundred (200) square feet in size may be placed in a rear yard not closer than five feet (5') from the rear or side property line. Accessory buildings over two hundred (200) square feet in size must comply with the provisions of section 10-4-1 of this title.
   C.   Corner Lots Or Parcels: When a building setback distance is required on both street fronts of a corner lot or parcel, such setback distance shall prevail regardless of the side yard requirements of the situation.
   D.   Yard Requirements: Except for the above, all yard setbacks shall comply with the provisions of chapters 4 through 7, inclusive, of this title, as each zone district has yard requirements therein. (Ord. 326, 10-9-2000)
