CHAPTER 4

RESIDENTIAL DISTRICTS

10-4-1: ACCESSORY BUILDINGS:

   A.   Permanent Main Building Required; Temporary Building: No person shall construct or locate in any residential area any private garages or other accessory buildings without a permissive main building, except that a temporary building may be allowed pending the erection and completion of a permanent use. No permit shall be issued for any temporary structure unless a permit also be issued at the same time for the permanent building, and the temporary building be either removed or converted to an allowed use upon the completion of the main building.
   B.   Detached Accessory Building: A detached accessory building not exceeding fifteen feet (15') in height may occupy not more than one-half (1/2) of the total rear yard area if not closer than ten feet (10') to the rear property line.
   C.   Corner Lot: In case of a corner lot abutting two (2) streets, no accessory building shall be erected so as to encroach upon the front half of such lots. (1973 Code § 17.24.010)

10-4-2: AREA REGULATIONS:

   A.   Reduction Of Lot Or Parcel: No lot or parcel shall be so reduced in area so as to be less in any dimension than is required by the regulations applicable to the land use district in which it is located.
   B.   Use Of Required Area: No portion of any lot or parcel which is part of required area for one building shall be used as a part of a required area for any other building. When a portion of any lot or parcel is sold or transferred and the area of that portion or the portion remaining no longer conforms to the required area, as defined in the respective land use district, the portion sold and the portion remaining shall be considered as one parcel only in determining the allowable number and location of buildings on both parcels.
   C.   Minimum Requirements: The minimum square footage requirements of this title are in addition to and not in lieu of the requirements of the uniform building code. (1973 Code § 17.24.020)

10-4-3: YARDS:

   A.   Use By Adjoining Lots: No required yard or open space around an existing building or other buildings hereafter erected shall be considered a yard or open space for any other buildings on an adjoining lot or parcel. (1973 Code § 17.24.030)
   B.   Front Yards:
      1.   Through Lots: On through lots, either end lot line may be considered the front line, in which case the minimum rear yard shall not be less than is required as a front yard in the respective land use district.
      2.   Corner Lots: There shall be no plantings, fences, shrubbery or other obstruction to vision more than three feet (3') higher than the curb level within twenty feet (20') of the intersection of any two (2) streets on corner lots. (1973 Code § 17.24.040)
   C.   Side Yards:
      1.   Corner Lot: On a corner lot, the building line from the street running parallel with the side line of such lot shall be not less than the front yard, as required in that district, except in the R-1 residence district, as noted.
      2.   Outside Stairs Or Landing: Outside stairs or landing places, if unroofed or unenclosed, may extend into a side yard not to exceed three feet (3'). (1973 Code § 17.24.050)
   D.   Rear Yards:
      1.   Outside Stairs Or Landing: An outside stair or landing place, if unroofed or unenclosed, may extend into a rear yard not to exceed five feet (5').
      2.   Detached Accessory Building: A detached accessory building may occupy a portion of the rear yard subject to the provisions of this chapter, and chapters 3 and 5 of this title. (1973 Code § 17.24.060)

10-4-4: WALLS, FENCES AND BARRIERS:

   A.   Maximum Height:
      1.   Front Yards: Walls, fences and barriers not over six feet (6') in height may be erected on lot lines except in required front yard areas.
      2.   Other Yards: Fences not over three feet (3') in height may be built anywhere on the lot except as otherwise provided.
   B.   Nonvisual Barrier: A four foot (4') nonvisual barrier (i.e., chain link) fence may be substituted for a three foot (3') fence wherever a three foot (3') fence is indicated in these requirements. (1973 Code § 17.24.070)

10-4-5: BUILDING HEIGHT:

No building shall exceed a height of two and one-half (21/2) stories or thirty five feet (35'), except as specified in this chapter. Requirements of this title shall not apply to church spires, belfries, cupolas, domes, chimneys, flues, flagpoles, and the like except where they may be deemed a hazard. (1973 Code § 17.24.080)

10-4A-1: GENERALLY:

Within R-1 single-family residence districts, the regulations set out in this chapter shall be complied with. (1973 Code § 17.32.010)

10-4A-2: PERMITTED USES:

The following are permitted on a lot or parcel having the required area and width. Minimum area of seven thousand (7,000) square feet excluding road rights of way and sixty feet (60') average width:
Accessory uses customary and incidental to the dwelling, when located on the same lot, and provided it is not closer than fifteen feet (15') to a main building on the adjoining lot nor closer than ten feet (10') to any main building on the same lot.
Home occupations as permitted within this title.
Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.
Additional single-family dwellings, providing there is not less than seven thousand (7,000) square feet of lot area respectively for each such additional dwelling, and they are not closer than twenty five feet (25') apart. (1973 Code § 17.32.020)

10-4A-3: SPECIAL USES:

Uses allowed by special use permit shall include:
   Assisted living facility providing:
   A.   Off street parking of at least one space per eight hundred (800) square feet of total floor area.
   B.   Compliance with setback requirements of this title for the district where the premises are located.
Family daycare.
   Golf courses.
Residential industry providing:
   A.   Off street parking of at least one space per three hundred (300) square feet of total floor area plus one space for each five (5) seating capacity.
   B.   Compliance with setback requirements of this title for the district where the premises are located. (Ord. 05-09, 9-12-2005)

10-4A-4: YARDS:

Yards, except as provided otherwise, shall be:
   A.   Front: Each lot or parcel shall have a front yard having a depth equal to the building line setback, but in no event less than twenty feet (20').
   B.   Side: There shall be a side yard along each side of the main building, to be not less than seven feet (7'). The side yard along the street side of a corner lot must be at least twenty feet (20'), regardless of other provisions of this title.
   C.   Rear: There shall be a rear yard of not less than twenty feet (20'). (1973 Code § 17.32.040)

10-4B-1: GENERALLY:

Within R-2 limited multiple-residence districts, the regulations set out in this chapter shall be complied with. (1973 Code § 17.36.010)

10-4B-2: PERMITTED USES:

The following are permitted on a lot or parcel having the required area and width. Minimum area of seven thousand (7,000) square feet excluding road rights of way and sixty feet (60') average width:
Accessory structures customary and incidental to the dwelling, when located on the same lot, and providing it is not closer than fifteen feet (15') to a main building on the adjoining lot, nor closer than ten feet (10') to any main building on the same lot.
Home occupations as permitted within this title.
Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.
Additional single-family dwellings, providing there is not less than seven thousand (7,000) square feet of lot area respectively for each such additional dwelling, and they are not closer than twenty five feet (25') apart.

10-4B-3: SPECIAL USES:

Uses allowed by special use permit shall include:
   Assisted living facility providing:
   A.   Off street parking of at least one space per eight hundred (800) square feet of total floor area.
   B.   Compliance with setback requirements of this title for the district where the premises are located.
Bed and breakfast facility.
Boarding house.
Churches and other similar quasi-public buildings.
Family daycare.
Museums and libraries.
Private clubs.
Residential industry providing:
   A.   Off street parking of at least one space per three hundred (300) square feet of total floor area plus one space for each five (5) seating capacity.
   B.   Compliance with setback requirements of this title for the district where the premises are located.
   C.   Structure is a single-family dwelling.

10-4B-4: YARDS:

Yards, except as provided otherwise, shall be:
   A.   Front: Each lot or parcel shall have a front yard or depth equal to the building setback line, but in no event less than twenty feet (20').
   B.   Side: There shall be a side yard along each side of the main building to be not less than seven feet (7'). The side yard along the street side of a corner lot must be at least twenty feet (20') regardless of other provisions of this title.
   C.   Rear: There shall be a rear yard of not less than twenty feet (20'). (1973 Code § 17.36.040)

10-4C-1: GENERALLY:

Within R-3 multiple-residence districts, the regulations set out in this chapter shall be complied with. (1973 Code § 17.40.010)

10-4C-2: PERMITTED USES:

The following are permitted on a lot or parcel having the required area and width. Minimum area of seven thousand (7,000) square feet excluding road rights of way and sixty feet (60') average width:
Accessory uses customary and incidental to the dwelling, when located on the same lot, and providing it is not closer than fifteen feet (15') to a main building on the adjoining lot, nor closer than ten feet (10') to any main building on the same lot.
Home occupations as permitted in this title.
Multiple-family dwellings, provided not more than one dwelling unit shall be constructed for each two thousand (2,000) square feet of lot area.
   Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.
Additional single-family dwellings, providing there is not less than seven thousand (7,000) square feet of lot area respectively for each such additional dwelling, and they are not closer than twenty five feet (25') apart. (1973 Code § 17.40.020)

10-4C-3: SPECIAL USES:

10-4C-4: YARDS:

Yards, except as provided otherwise, shall be:
   A.   Front: Each lot or parcel shall have a front yard or depth equal to the building setback line, but in no event less than twenty feet (20').

10-4D-1: GENERALLY:

Within R-C transition use residence districts, the regulations set out in this chapter shall be complied with. (1973 Code § 17.44.010)

10-4D-2: PERMITTED USES:

The following are permitted on a lot or parcel having the required area and width. Minimum area of six thousand (6,000) square feet excluding road rights of way and sixty feet (60') average width:
All uses permitted in R-1, R-2 and R-3 districts.
Accessory uses and structures customary and incidental thereto, providing they are not closer than ten feet (10') to any main building on the same or adjoining lots.
Advertising in connection with the uses designated in this section shall be limited to one lighted or unlighted sign (but not flashing) per building face, not exceeding sixteen (16) square feet in area.
Home occupations as permitted within this title.
Offices and office buildings wherein no retail activity or merchandising is maintained, sold, displayed, and there is a limited contact only with the general public.

10-4D-3: SPECIAL USES:

Uses allowed by special use permit shall include the following:
Assisted living facility providing:
   A.   Off street parking of at least one space per eight hundred (800) square feet of total floor area.

Accessory uses customary and incidental to the dwelling, when located on the same lot, and provided it is not closer than fifteen feet (15') to a main building on the adjoining lot nor closer than ten feet (10') to any main building on the same lot.
Home occupations as permitted within this title.
Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.

Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.

Accessory uses customary and incidental to the dwelling, when located on the same lot, and provided it is not closer than fifteen feet (15') to a main building on the adjoining lot, nor closer than ten feet (10') to any main building on the same lot.
Home occupations as permitted in this title.
Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.
Additional single-family dwellings with a minimum living area of one thousand (1,000) square feet, providing there is not less than fourteen thousand (14,000) square feet of lot area respectively for each such additional dwelling, and they are not closer than twenty five feet (25') apart. Home occupations as permitted in this title.
Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.
Additional single-family dwellings with a minimum living area of one thousand (1,000) square feet, providing there is not less than sixteen thousand (16,000) square feet of lot area respectively for each such additional dwelling, and they are not closer than twenty five feet (25') apart. The following are permitted on a lot or parcel having the required area and width (minimum area of 1 acre [43,560 square feet] excluding road rights of way and a 140 foot average width):
Accessory uses customary and incidental to the dwelling, when located on the same lot, and providing it is not closer than fifteen feet (15') to a main building on the adjoining lot, nor closer than ten feet (10') to any main building on the same lot.
Domestic livestock farming limited to the raising, feeding, maintaining, and breeding of livestock, subject to a minimum twenty thousand (20,000) square foot gross area and the following cumulative limitations and conditions:
   A.   One hog or pig per each twenty thousand (20,000) square feet of gross area; or
   B.   One horse or mule or cow or steer (includes miniature) per each twenty thousand (20,000) square feet of gross area; or
   C.   Twenty five (25) chickens per each twenty thousand (20,000) square feet of gross area; or
   D.   Three (3) goats or sheep or similar livestock per each twenty thousand (20,000) square feet of gross area.
The area used to justify one class of animals may not be used concurrently to justify another class of animals.
Home occupations as permitted in this title.
Playgrounds.
Public parks.
Single-family dwelling of a permanent nature with a minimum living area of one thousand (1,000) square feet.
Additional single-family dwellings, providing there is not less than one acre (43,560 square feet) of lot area respectively for each such additional dwelling, and they are not closer than twenty five feet (25') apart. (Ord. 06-06, 10-9-2006)

10-4J-3: SPECIAL USES:

Uses allowed by special use permit shall include:
Assisted living facility providing:
   A.   Off street parking of at least one space per eight hundred (800) square feet of total floor area.
   B.   Compliance with setback requirements of this title for the district where the premises are located.
Bed and breakfast facility.
Boarding house.
Business colleges.
Childcare centers.
Churches, schools and other similar quasi-public buildings.
Educational and philanthropic institutions.
Family daycare.
Fraternity and sorority houses.
Galleries.
Group home.
Hotels and motels.
Lodges.
Mobile home parks, consisting of a minimum of one-half (1/2) acre or twenty one thousand seven hundred eighty (21,780) square feet.
Museums and libraries.
Private clubs.
Residential industry providing:
   A.   Off street parking of at least one space per three hundred (300) square feet of total floor area plus one space for each five (5) seating capacity.
   B.   Compliance with setback requirements of this title for the district where the premises are located.
Rest homes.
Schools and similar uses offering specialized training. (Ord. 06-06, 10-9-2006)

10-4J-4: YARDS:

Yards, except as provided otherwise, shall be:
   A.   Front: Each lot or parcel shall have a front yard or depth equal to the building setback line, but in no event less than twenty five feet (25').
   B.   Side: There shall be a side yard along each side of the main building to be not less than ten feet (10'). The side yard along the street side of a corner lot must be at least twenty feet (20') regardless of other provisions of this title.
   C.   Rear: There shall be a rear yard of not less than twenty feet (20'). (Ord. 06-06, 10-9-2006)
