CHAPTER 13

A INTERIM AGRICULTURAL DISTRICT

10-13-1: PURPOSE:

The purpose of the A Interim Agricultural District is to preserve land in interim agricultural use and to protect against premature urban development, which is presently unneeded, and for which it may be not practical to provide urban services. (Ord. 04-02, 5-10-2004)

10-13-2: PRINCIPAL PERMITTED USES:

The following are principal permitted uses in the A District:
Domestic livestock farming limited to the raising, feeding, maintaining, and breeding of livestock, subject to a minimum twenty thousand (20,000) square foot gross lot area and the following cumulative limitations and conditions:
   A.   One hog or pig per each twenty thousand (20,000) square feet of gross lot area; or
   B.   One horse or mule or cow or steer (includes miniature) per each twenty thousand (20,000) square feet of gross lot area; or
   C.   Twenty five (25) chickens per each twenty thousand (20,000) square feet of gross lot area; or
   D.   Three (3) goats or sheep or similar livestock per each twenty thousand (20,000) square feet of gross lot area.
The lot area used to justify one class of animals may not be used concurrently to justify another class of animals.
One single-family dwelling per lot; as provided for in chapter 4 of this title.
The growing and harvesting of shrubs, plants, flowers, trees, vines, fruits, vegetables, hay, grain, and similar food and fiber crop(s), including greenhouses and orchards. (Ord. 05-04, 6-13-2005)

10-13-3: ACCESSORY USES:

The following are accessory uses in the A District:
Accessory uses and structures incidental and appurtenant to any permitted use, provided that no accessory use or structure shall be initiated or constructed prior to the main use or building nor on a separate lot from the main use or building. (Ord. 04-02, 5-10-2004)

10-13-4: SPECIAL USES:

The following uses may be permitted by special use permit and then only when use conforms to every term and condition of the permit:
   Assisted living facility providing:
   A.   Off street parking of at least one space per eight hundred (800) square feet of total floor area.
   B.   Compliance with setback requirements of this title for the district where the premises are located.
Churches, temples, clubs, lodges.
Farm labor housing. Landowners may provide buildings for use as farm labor housing for seasonal or temporary employees of the landowner. Such housing units may include cooking facilities and must comply with United States Department of Labor standards per title 20, chapter V of the Code of Federal Regulations.
Home occupations.
Parking lots.
Private recreational facilities for which a membership charge may be made but which are not open to the general public.
Public buildings, public utility structures, parks.
Public or private schools.
Sale of agricultural products produced on the premises.
The packing, polishing and the like of unprocessed agricultural yield grown on the premises; nurseries and aviaries; commercial riding academy located on the same premises. (Ord. 18-02, 5-14-2018)

10-13-5: DISTRICT REGULATIONS:

The following regulations and requirements shall apply in the A Interim Agricultural District:
   A.   Site And Building Requirements:

   B.   Maximum Lot Area: Maximum area of a lot that may be covered by structures: Forty percent (40%).
   C.   Crop, Barn, Stable Or Corral: No crop, barn, stable or corral shall be maintained closer than twenty feet (20') from any front lot line, or closer than ten feet (10') from any other lot line.
   D.   Fences, Hedges And Walls: Fences, hedges, and walls may be erected and maintained to a height not to exceed three feet (3') in any required front yard and to a height not to exceed six feet (6') in any other location on the lot. (Ord. 04-02, 5-10-2004)
