CHAPTER 5

NONRESIDENTIAL DISTRICTS GENERALLY

10-5-1: RESIDENCE DISTRICT USES:

   A.   Permitted: All uses or buildings permissive in residence districts are also permissive in nonresidence districts, except the M-1 districts; provided, that they are established or located in accordance with the provisions of the R-C district.
   B.   Waiver Of Yard Requirements: Yard requirements may be waived for dwelling units erected above the ground floor when such ground floor is designed and used exclusively for commercial purposes, unless such yards may be required by other ordinances or other provisions of this title. 10-5-2: NOISE, SMOKE, ODORS, GASES AND NOXIOUS NUISANCES:

Noise, smoke, odors, gases, and other noxious nuisances shall be so controlled as not to become objectionable, adversely affect the properties in the vicinity, nor be detrimental to the public health, safety and general welfare. (1973 Code § 17.28.020)

10-5-3: OPEN STORAGE:

All open storage shall be enclosed by a structure or planting strip not less than six feet (6') high. Storage of lumber, coal or other combustibles shall not be less than ten feet (10') from any interior lot line, and a suitable roadway from the street to the rear of the property shall be provided, maintained and kept open at all times, except during nonbusiness hours. No merchandise shall be displayed nor any business conducted between the street line and the building line in any nonresidential district. (1973 Code § 17.28.030)

10-5-4: INFLAMMABLE LIQUIDS, LIQUEFIED PETROLEUM AND EXPLOSIVES:

Storage and handling of inflammable liquids, liquefied petroleum and explosives shall comply with all state rules and regulations as well as those of the city. Bulk storage of inflammable liquids, liquefied petroleum, gases and explosives above ground is unlawful in all districts, except gasoline and lubricating fuel oil, lubricating oil, and fuel oil as allowed. (1973 Code § 17.28.040)

10-5-5: CONTIGUOUS TO RESIDENCE DISTRICT; SIDE YARD:

Wherever a nonresidence district is contiguous to a residence district, a side yard of not less than ten feet (10') shall be required by the nonresidence district use regardless of other provisions of this title. (1973 Code § 17.28.050)

10-5-6: LIGHTING:

Exterior lighting shall be so installed as to eliminate any nuisance to adjoining residential districts or to traffic on the public streets or highways. No unshaded light sources shall be permitted. Necessary safety lighting of road and buildings, and lighting required by governmental regulations shall be required. (1973 Code § 17.28.060)
