, "Overlay Districts," of this title, is created to preserve a variety and balance of housing types within the Town, and provides assurances that existing senior mobilehome parks within the senior mobilehome park overlay district will remain primarily available to seniors. (Ord. 330, 9-16-2025)
9.23.020: LOCATION:
Prior to the adoption of the ordinance adding this chapter to the code, the Town conducted age verification surveys of each of the following mobilehome parks and verified that at least eighty percent (80%) of each park's occupied spaces were occupied by at least one Senior. Each of the below mobilehome parks are designated as a Senior Mobilehome Park and included within the MHP overlay district.

9.23.030: DEFINITIONS:
ALL-AGES MOBILEHOME PARK: A mobilehome park that is not a Senior Mobilehome Park.
CONVERT OR CONVERSION: Changing from a seniors mobilehome park to an all-ages mobilehome park.
SENIOR: An individual fifty-five (55) years old or older.
SENIOR MOBILEHOME PARK: A mobilehome park in which at least eighty percent (80%) of the spaces are occupied by or intended for occupancy by at least one person who is age fifty-five (55) or older. (Ord. 330, 9-16-2025)
9.23.040: APPLICABLE REGULATIONS:
A. A mobilehome park within the MHP overlay district shall be operated as a Senior Mobilehome Park. The owner of a mobilehome park within the MHP overlay district shall ensure that at least eighty percent (80%) of the mobilehomes in their mobilehome park are occupied by at least one person fifty-five (55) years of age or older at all times.
B. The signage, advertising, park rules, regulations, rental agreements, and leases for spaces in a Senior Mobilehome Park in the MHP overlay district shall state that the park is a Senior Mobilehome Park.
C. From and after the effective date of the ordinance codified in this section, senior mobilehome parks are required to issue new leases only when at least one (1) occupant of the space is a senior. If the occupants of a space who do not meet this requirement rented the space before the effective date of the ordinance codified in this section, they shall be allowed to remain. When such occupants cease to occupy a space, the space must thereafter be rented as set forth in this section.
D. No Senior Mobilehome Park located within the MHP overlay district shall convert to an All-Ages Mobilehome Park. (Ord. 330, 9-16-2025)
9.23.050: AGE VERIFICATION AND REPORTING REQUIREMENTS:
The Town will verify the occupancy of each senior mobilehome park to confirm its status as a senior mobilehome park at least once every two years. When a new lease is signed, the owner or operator of a park within the MHP overlay district shall verify that the lease complies with the requirements of section 9.23.040
(C). On a monthly basis, the owner or operator of a park within the MHP overlay district shall provide notice to the Town of all new leases signed in the previous month and a certification that each new lease complies with the requirements of section 9.23.040
(C). Each senior mobilehome park shall have procedures in place to document the percentage of occupied spaces that have at least one (1) senior. The park owner shall provide an affidavit demonstrating compliance with this documentation requirement upon request by the Town. (Ord. 330, 9-16-2025)
9.23.060: PENALTIES/ENFORCEMENT:
Failure to comply with the requirements of this section shall constitute a violation of this code, subject to enforcement in the manner and form provided for in the Town of Yucca Valley Municipal Code. (Ord. 330, 9-16-2025)
