CHAPTER 4

- RESIDENCE ZONE, CLASS A

Sec. 9-4-1.- Intent.

This chapter establishes the Residence Zone, Class A (RA) Zoning District, the purpose of which is to protect property values and the quality of life in neighborhoods of single-family dwellings by excluding the concentrations of people and traffic and the potential nuisances associated with higher density residential, commercial, and industrial development.

Sec. 9-4-2. - Permitted uses.

The permitted uses allowed in the RA zoning district shall be:

(1)

Single-family dwellings at least 20 feet in width at their narrowest dimension.

(2)

Accessory uses and structures customarily associated with single-family dwellings in the areas included in the RA zoning district.

(3)

Minor utility installations.

(4)

Home occupations, in compliance with the detailed performance standards of section 9-17-2. A development permit is required for the establishment of a home occupation.

(5)

Customary accessory uses shall not include the keeping of livestock, kennels, or other uses, structures, or activities that are prohibited or restricted by the performance standards of section 9-4-5.

(6)

Accessory structures not over 20 feet from finish grade to peak of roof customarily associated with single-family dwellings in the areas included in the RA zoning district.

Sec. 9-4-3. - Special permit uses.

The uses permitted in the RA zoning district after public review for compliance with the applicable performance standards and approval of a special use permit shall be:

(1)

Radio or television antennas that are over 15 feet in height above the structure to which they are accessory (shorter antennas are customary accessory uses);

(2)

Two-family dwellings;

(3)

Churches;

(4)

Nursing homes, congregate living facilities, and professional services (SLUC 65);

(5)

Day care centers and schools;

(6)

Parks and playgrounds; and

(7)

Major utility installations and public facilities, including water storage tanks, fire stations, recreation centers, and similar public facilities.

Sec. 9-4-4. - Prohibited uses.

All uses not explicitly permitted by section 9-4-2 or 9-4-3 shall be prohibited.

Sec. 9-4-5. - Specification standards.

(a)

Setback from street. All buildings shall be set back at least 25 feet from any property line paralleling a street, except:

(1)

On corner lots where the minimum setback from any street on which no dwelling presently does or may reasonably be expected to front on the same side, the setback from the street may be reduced to 20 feet; or

(2)

Where the dwellings on 50 percent or more of the lots on the same block and same side of the street have been built to a fairly even setback line of less than 25 feet from the street, future buildings may extend to the reduced setback line. Minor irregularities shall be ignored in determining whether or not a reduced setback line has been established by past development. When any dispute arises in the determination of a front building line, the decision of the administrator may be appealed using the procedure provided in section 9-2-34.

(b)

Side yard. All buildings shall maintain a minimum side yard setback of at least 7½; except that one accessory building, 144 square feet or less, including the overhang, and at least ten feet from the principal building may be located up to the side yard property line.

(c)

Rear yard. No setback is required from a platted alley. Where no alley is platted, a minimum rear yard setback of 7½ feet is required.

(d)

Lot coverage. The maximum lot coverage shall be 60 percent.

Sec. 9-4-6. - Performance standards specific to district.

The following performance standards apply within the RA zoning district. All developments are also subject to the applicable performance standards of chapters 10 through 15 of this title:

(1)

Fences. Fences in excess of six feet in height shall be prohibited. Fences constructed from the street frontage to the building setback line shall not exceed four feet in height. The construction of fences that obstruct views at intersections or points of access to public roads is prohibited by section 9-12-4(d).

(2)

Outdoor storage. There shall be no outdoor storage in required front or side yards, except the temporary storage of construction materials and equipment used for construction authorized by a permit issued pursuant to this title or the International Building Code.

(3)

Signs. See section 9-17-1.

(4)

Radio and television antenna height limitations. Radio and television antennas in excess of ten feet in height above the structure to which they are accessory shall be prohibited.
