CHAPTER 5

- RESIDENCE ZONE, CLASS B

Sec. 9-5-1.- Intent.

This chapter establishes the Residence Zone, Class B (RB) Zoning District, the purpose of which is to protect property values and the quality of life in neighborhoods of single-family and multiple-family dwellings by excluding the potential nuisances associated with commercial and industrial uses.

Sec. 9-5-2. - Permitted uses.

The permitted uses allowed in the RB zoning district shall be:

(1)

Single-family and two-family dwellings.

(2)

Accessory uses and structures customarily associated with one- and two-family dwellings in the RB zoning district.

(3)

Minor utility installations.

(4)

Home occupations, in compliance with the detailed performance standards of section 9-17-2. A development permit is required for the establishment of a home occupation.

(5)

Customary accessory uses shall not include the keeping of livestock, kennels, or other uses, structures, or activities that are prohibited or restricted by the performance standards of section 9-5-6.

(6)

Accessory structures not over 20 feet from finish grade to peak of roof customarily associated with one- and two-family dwellings in the areas included in the RB zoning district.

Sec. 9-5-3. - Special permit uses.

The uses permitted in the RB zoning district after public review for compliance with the applicable performance standards and approval of a special use permit shall be:

(1)

Radio or television antennas that are over 15 feet in height above the structure to which they are accessory (shorter antennas are customary accessory uses);

(2)

Multiple-family dwellings, including condominiums;

(3)

Churches;

(4)

Nursing homes, congregate living facilities, and professional services (SLUC 65);

(5)

Day care centers and schools;

(6)

Parks and playgrounds; and

(7)

Major utility installations and public facilities, including water storage tanks, fire stations, recreation centers, and similar public facilities.

Sec. 9-5-4. - Prohibited uses.

All uses not explicitly permitted by section 9-5-2 or 9-5-3 shall be prohibited.

Sec. 9-5-5. - Specification standards.

The specification standards for the RB zone shall be the same as for the RA zone.

Sec. 9-5-6. - Performance standards specific to district.

The performance standards for the RB zone shall be the same as for the RA zone.
