CHAPTER 2

ESTABLISHMENT OF DISTRICTS

10-2-1: DISTRICTS ESTABLISHED:

The area of zoning jurisdiction is hereby divided into the following zoning districts:
CO-1
Conservation district
AG-1
Agriculture district
R-1
One-family residential district
R-2
One-family residential district
R-3
Two-family residential district
R-4
Multiple-family residential district
B-1
Local commercial district
B-2
General business district
B-3
Central business district
I-1
Light industrial district
I-2
Heavy industrial district
 
The boundaries of such districts are as shown on the maps entitled "map A, zoning district", Canton, Illinois, on file in the city hall of the city of Canton, which, with all explanatory material thereon are hereby made a part of this title by reference. (Ord. 567, 11-1976)

10-2-2: INTERPRETATION, DISTRICT BOUNDARIES:

Where uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the zoning map, the following rules shall apply:
   (A)   Where district boundaries are indicated as approximately following the centerlines of streets or highways, street lines or highway right of way lines, such centerlines, street lines or highway right of way lines shall be construed to be such boundaries.
   (B)   Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries.
   (C)   Where a district boundary line as established in this section or as shown on the zoning map, divides a lot which was in a separate ownership and of record at the time of enactment of this chapter, the use authorized thereon and the other district requirements applying to the least restricted portion of such lot, under this chapter, shall be considered as extending to the entire lot, provided that the more restricted portion of such lot is entirely within twenty five feet (25') of said dividing district boundary line. The use so extended shall be deemed to be conforming.
   (D)   Where district boundaries are so indicated that they are approximately parallel to the centerlines or street lines of streets, or the centerline or right of way lines of highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the zoning map. If no distance is given, such dimension shall be determined by the use of the scale shown on said zoning map.
   (E)   Where the boundary of a district follows a railroad line, such boundary shall be deemed to be located midway between the main tracks of said railroad line.
   (F)   In areas not subdivided into lots and blocks, the district boundary lines shall be determined by scale to the nearest ten feet (10'). (Ord. 567, 11-1976)
   (G)   Questions concerning the exact location of district boundary lines which are not resolved by application of the foregoing rules shall be determined by the city council, after recommendation from the joint planning and zoning commission, according to rules and regulations which may be adopted by said commission. 10-2-3: TRANSITION ZONING:

   (A)   Where a lot in a business or industrial district abuts a lot in a residential district, there shall be provided along such abutting lines a yard equal in width or depth to that required in the residential district.
   (B)   Where the frontage on one side of a street between two (2) intersecting streets is zoned partly as residential and partly as business or industrial, the front yard depth in the business or industrial district shall be equal to the required front depth of the residential district. 10-2-4: APPLICATION OF REGULATIONS:

Except as hereinafter provided:
   (A)   No building or land or portion thereof hereinafter erected, moved, remodeled, or otherwise altered, shall be used or occupied unless in conformity with the provisions of this chapter.
   (B)   Except as may otherwise be permitted under the provisions of this chapter, no building may be constructed so as:
      1.   To exceed the height;
      2.   To accommodate or house a greater number of families or dwelling units;
      3.   To occupy a greater percentage of lot area; or
      4.   To have narrower or smaller rear yards, front yards, side yards, inner or outer courts than is specified herein for the district in which such building is located.
   (C)   No part of a yard or other open space required about any building for the purpose of complying with the provisions of this chapter shall be included as part of a yard or other open space similarly required for another building.
   (D)   All territory which may hereafter be annexed to the city shall be considered as being in the CO-1, if public, or AG-1, if private, or such other zoning configuration under this chapter as may be approved by the city council, and only after proper notice and hearings have been held in accord with this chapter.
   (E)   Whenever any street, alley or other public way is vacated by official actions of the city council, the zoning district adjoining such area shall be automatically extended to the center of such vacation, or in those instances where less than the entire public way is vacated, the zoning classification shall be contiguous, and the area included in the vacation shall then henceforth be subject to all regulations of the extended districts.
