CHAPTER 8

B-1 LOCAL COMMERCIAL DISTRICT

10-8-1: STATEMENT OF PURPOSE:

The local commercial district as established in this chapter is intended to be that district permitting retail business and service uses which are designated to serve the surrounding residential areas. In order to promote such business development so far as is possible and appropriate in each area, uses are permitted which would not create hazards, offensive and loud noises, vibration, smoke, glare, or excessive truck traffic. The intent of this district is also to encourage the concentration of local business by locating proposed areas to the mutual advantage of both the consumer and merchant. This will promote the best use of land at certain strategic locations and avoid the encouragement of marginal strip business development along major streets.

10-8-2: PERMITTED USES:

Accessory structures, uses, and signs customarily incidental to the permitted uses herein, provided that signs are in accord with chapter 15 of this title.
Barbershops and beauty parlors.
Bicycle rental and repair shops.
Clinics, medical and dental.
Clubs and lodges, not for profit.
Dressmaking, millinery, and tailoring, clothes pressing and repair.
Eating and drinking places in which there is not dancing, a floor show, or other live entertainment involving more than one person.
Greenhouses, retail food stores, including bakeries, provided that processing of food shall be for retail sale on the premises only.
Laundry agency or dry cleaning agency, hand laundry, and laundry operated by customers, such as launderettes, laundromat, and the like.
Mortuaries.
Offices, business, professional or governmental.
Publicly owned buildings and public utility buildings, including, but not limited to, telephone exchanges, transformer stations and substations, and gas regulator stations with service yards but not including storage yards.
Repairs: electrical or other household appliances, locks, radios, televisions, and the like; shoes, timepieces.
Shops or stores for the sale of art supplies, beverage, including package liquor outlets, confections, delicatessens, drugs, dry goods, flowers, foodstuffs, gifts, hardware, household appliances, jewelry, leather goods, music, notions, paint, periodicals, radio, television and the like.
Other uses similar to the above and subject to the following:
   (A)   All business establishments shall be retail or service establishments, dealing directly with consumers. All goods produced on the premises shall be sold at retail exclusively on premises where produced.
   (B)   All business, servicing or processing, except for off street parking or loading, shall be conducted within completely enclosed buildings. (Ord. 567, 11-1976)

10-8-3: SPECIAL USE EXCEPTIONS:

A childcare center, nursery school or day nursery with no limit on the number of children; provided, that the provisions of state law and chapter 15 of this title are complied with.
Automobile service stations; providing, that such use is located at least five hundred feet (500') from an entrance or exit to property on which is located a public school, playground, play field, or park; that the minimum frontage on any street shall be one hundred twenty five feet (125'), and that no storage outside the building shall be permitted. The lot area minimum shall be fifteen thousand (15,000) square feet.
Bed and breakfast.
Bus stations only if located on a major thoroughfare.
Commercial planned unit development, subject to the provisions of chapter 13 of this title.
Multi-family dwellings, subject to the provisions of chapter 7 of this title.
Signs when located on the same lot pertaining to the use of that particular building or buildings; provided, that they will not overhang any public right of way, shall not be illuminated, and shall not exceed twelve (12) square feet in area. 10-8-4: BUILDING HEIGHT:

Two (2) stories, but not more than thirty five feet (35'). Planned developments involving five (5) acres or more under one ownership, may exceed the height limitations, subject to review and approval by the city council. (Ord. 567, 11-1976)

10-8-5: LOT REQUIREMENTS:

   (A)   Minimum lot requirements: Not required.
   (B)   Minimum lot width: Fifty feet (50'). (Ord. 567, 11-1976)

10-8-6: YARD REQUIREMENTS:

   (A)   Front yard setback: None required, except that where located on a street frontage within a residential district, the front yard regulations of that district shall be required.
   (B)   Side yard: No side yards or rear yards are required along the interior side lot lines, except as otherwise specified by the building code 1 . On the exterior side yard or rear yard which borders on a residential district there shall be provided a side yard equal to that required by the residential district.
   (C)   Rear yard: Twenty feet (20'), except that where located adjacent to a residential district, the yard regulations of that district shall apply. (Ord. 567, 11-1976)

10-8-7: LOT COVERAGE:

Not more than sixty percent (60%) of the lot area. (Ord. 567, 11-1976)

10-8-10: SIGN REGULATIONS:

Exterior signs must relate solely to the business activity carried on in the structure. The size of all signs shall be limited in area to one-half (1/2) of the linear street frontage of the particular lot expressed in square feet. Signs shall not extend above the roofline of the building, nor into public rights of way. Each local commercial district may erect one freestanding sign, the area of which shall be included in the total area of permitted signs. See chapter 15 of this title for additional sign regulations.
