CHAPTER 6

R-3 TWO-FAMILY RESIDENTIAL DISTRICT

10-6-1: STATEMENT OF PURPOSE:

The two-family residential district is established as a district in which the principal use of land is for single- and two-family dwellings. The specific intent of this chapter is:
   (A)   To encourage the construction of, and continued use of the land for residential purposes.
   (B)   To prohibit commercial and industrial use of the land, and to prohibit any other use which would substantially interfere with the development or continuation of residential uses in the district.
   (C)   To encourage the discontinuance of existing uses that would not be permitted as new uses under the provisions of this chapter.
   (D)   To ensure that only such single- and two-family residential uses as can be properly designed and built will be allowed in this district, as not to overcrowd the land, cause parking or traffic congestion, or to have injurious effects on adjacent single- and two-family residential property. 10-6-2: PERMITTED USES:

All uses permitted in residence R-1 and R-2 districts subject to all requirements for such uses in zoning districts where first permitted unless otherwise specified in this chapter.
Accessory buildings or uses customarily incidental to any of the permitted uses including private garages serving the principal residential building, containing space for not more than two (2) passenger vehicles for each dwelling unit in the principal building on the lot.
Two-family dwellings, excluding mobile homes. (Ord. 567, 11-1976)

10-6-3: SPECIAL USE EXCEPTIONS:

All special use exceptions permitted in the R-2 district subject to all requirements of this chapter.
Bed and breakfast.
Signs when located on the same lot pertaining to the use of that particular building or buildings; provided, that they will not overhang any public right of way, shall not be illuminated, and shall not exceed twelve (12) square feet in area. (Ord. 567, 11-1976; amd. Ord. 1714, 12-4-2001)

10-6-4: BUILDING HEIGHT:

Two and one-half (21/2) stories, but not more than thirty five feet (35'). (Ord. 567, 11-1976)

10-6-5: LOT REQUIREMENTS:

   (A)   Minimum lot area: Five thousand (5,000) square feet for single-family and three thousand (3,000) square feet for each unit in a two-family structure.
   (B)   Minimum width of lot: Fifty feet (50') for a single-family structure and sixty feet (60') for each two-family structure.
   (C)   Minimum floor space per dwelling unit: Eight hundred (800) square feet. (Ord. 567, 11-1976)

10-6-6: LOT COVERAGE:

Maximum coverage of the principal structure shall not be more than forty percent (40%) of the lot area. (Ord. 567, 11-1976)

10-6-7: YARD REQUIREMENTS:

   (A)   Front yard: Twenty five feet (25'), corner lots shall provide a front yard on each street side of the lot, except that the buildable width of a lot shall not be reduced to less than thirty two feet (32').
   (B)   Side yard: Must have two (2) side yards totaling twelve feet (12') in width, neither of which can be less than five feet (5') in width. See additional requirements in chapter 15 of this title. (Ord. 567, 11-1976)
   (C)   Rear yard: Twenty five feet (25') when rear yard abuts any public alley, street or thoroughfare; also when rear yard contains or is abutting property which contains easements for utilities, whether they be for underground or overhead. When the rear yard abuts the side yard of adjacent property then the required side yard setback for that adjacent property shall be the setback for the rear yard when utilities are present along the property line. When the rear yard contains no easements for utilities nor does not abut property containing easements abutting subject property, then the minimum rear yard setback shall be equal to the combined side yard required for that lot.
