CHAPTER 4

R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT

10-4-1: STATEMENT OF PURPOSE:

The single-family residential districts are established as districts in which the principal use of land is for single-family dwellings. For the single-family residential districts in promoting the general purpose of this chapter, the specific intent of this district is:
   (A)   To encourage the construction of, and the continued use of the land for single-family dwellings.
   (B)   To prohibit business, commercial or industrial use of the land, and to prohibit any other use which would be incompatible with continued development of single-family dwellings in the district.
   (C)   To encourage the discontinuance of existing uses that would not be permitted as new uses under the provisions of this chapter.
   (D)   To discourage any land use which would generate traffic on minor or local streets, other than normal traffic to serve the residences on those streets.
   (E)   To discourage any use which, because of its character and size, would create requirements and costs for public services such as fire and police protection, water supply, and sewerage, substantially in excess of such requirements and costs if the district were developed solely for single-family dwellings. 10-4-2: PERMITTED USES:

The following uses shall be permitted in an R-1 residence district:
Accessory uses customarily incident to the permitted uses in this chapter.
Golf courses, country clubs, private swimming clubs; provided that no building shall be located within twenty five feet (25') of any lot line of an abutting lot in any of the other residence districts.
Nurseries and greenhouses for growing plants.
One-family dwellings, excluding mobile homes.
Parks and recreational areas owned or operated by governmental agencies.
Public libraries, public museums, public schools, public buildings, memorial buildings, water supply facilities, and cemeteries; provided, that no building shall be located within twenty five feet (25') of any lot line of an abutting lot in any of the residence districts. (Ord. 567, 11-1976)

10-4-3: SPECIAL USE EXCEPTIONS:

Bed and breakfast.
Churches and other facilities normally incidental thereto, provided that the proposed site for a church is not less than two (2) acres; that there is adequate access to all required off street parking areas; that there is no parking in the required front yard; and that the church site is adjacent to a major thoroughfare.
Home occupations 1 .
Public hospital, but not including institutions for the care of the feeble minded or mentally ill, provided that the hospital site is adjacent to a major thoroughfare.
Public utility buildings, telephone exchange buildings, electric transformer stations and substations, and gas regulator stations, but not including service or storage yards when operating requirements necessitate the locating within the district in order to serve the immediate vicinity.
Residential planned unit developments subject to the provisions of chapter 13 of this title.
Signs when located on the same lot pertaining to the use of that particular building or buildings; provided, that they will not overhang any public right of way, shall not be illuminated, and shall not exceed twelve (12) square feet in area.
Stables for the housing of no more than two (2) horses, provided that lot area requirements set forth in section 10-4-5 of this chapter are met. (Ord. 567, 11-1976; amd. Ord. 1714, 12-4-2001)

10-4-4: BUILDING HEIGHT:

Two and one-half (21/2) stories, but no more than thirty five feet (35'). (Ord. 567, 11-1976)

10-4-5: LOT REQUIREMENTS:

   (A)   Minimum lot area: Fifteen thousand (15,000) square feet or one and one-half (11/2) acres if one horse is to be kept and one additional acre for each additional horse to be kept. (Ord. 4027, 4-5-2016)
   (B)   Minimum width of lot: One hundred feet (100').
   (C)   Minimum floor space per dwelling unit: One thousand eight hundred (1,800) square feet for one-story dwelling. Each dwelling with one and one-half (11/2) or more stories shall have a minimum first floor area of not less than one thousand (1,000) square feet. (Ord. 567, 11-1976)

10-4-6: LOT COVERAGE:

Maximum coverage of all structures, including accessory buildings, shall be thirty percent (30%) of the lot. (Ord. 567, 11-1976)

10-4-7: YARD REQUIREMENTS:

   (A)   Front Yard: Forty feet (40'), corner lots shall provide a front yard on each street side of the lot, except that the buildable width of a lot shall not be reduced to less than thirty two feet (32').
   (B)   Side Yard: Must have two (2) side yards totaling twenty feet (20') in width, neither of which can be less than eight feet (8') in width. See additional requirements in chapter 15 of this title. (Ord. 567, 11-1976)
   (C)   Rear Yard: Twenty five feet (25') when rear yard abuts any public alley, street or thoroughfare; also when rear yard contains or is abutting property which contains easements for utilities, whether they be for underground or overhead. When the rear yard abuts the side yard of adjacent property then the required side yard setback for that adjacent property shall be the setback for the rear yard when utilities are present along the property line. When the rear yard contains no easements for utilities nor does not abut property containing easements abutting subject property, then the minimum rear yard setback shall be equal to the combined side yard required for that lot.    (D)   Fences: In the event that horses are kept, fences shall be erected no closer than twenty five feet (25') from each property line so as to provide a source of containment. (Ord. 567, 11-1976)
