CHAPTER 7

R-4 MULTIPLE-FAMILY RESIDENTIAL DISTRICT

10-7-1: STATEMENT OF PURPOSE:

The R-4 multiple-family residential district is designed to permit a more intensive residential use of land with various types of multiple dwellings and related uses. These areas would be located near major streets for good accessibility. Various types and sizes of residential accommodations, for ownership or rental, would thereby be provided to meet the needs of the different age and family groups in the community. 10-7-2: PERMITTED USES:

All uses permitted in R-1, R-2 and R-3 districts, subject to all requirements for such uses in zoning districts where first permitted, unless otherwise specified in this chapter.
Buildings converted from a lower density provided, however, that they conform in every way to the provisions of this chapter.
Maintenance and management buildings designed and operated to exclusively serve the multiple dwellings.
Multiple dwellings, excluding mobile homes, and including:
   (A)   Apartment houses.
   (B)   Row and town house dwellings.
Private garages serving the principal residential building, containing space for no more than two (2) passenger vehicles for each dwelling unit in the principal building on the lot.
Private swimming pools designed and operated only for occupants of the principal building and their personal guests.
Signs when located on the same lot pertaining to the use of that particular building or buildings; provided, that they will not overhang any public right of way, shall not be illuminated, and shall not exceed twelve (12) square feet in area. (Ord. 567, 11-1976)

10-7-3: SPECIAL USE EXCEPTIONS:

All special exception uses permitted in the R-3 district, subject to all requirements of that district.
A residential structure for a home for persons aged, handicapped or impaired or a rest or convalescent home.
Bed and breakfast.
Boarding houses when located on a major thoroughfare.
Clubs and lodges operated not for profit, provided no advertising sign is displayed.
Mortuaries and professional offices such as doctor, lawyer, engineer, architect, dentist, or chiropractor, not including the office of a veterinarian, when located on a street designated as a major thoroughfare; art and music schools with programs and recitals incidental to the instruction provided.
Residential planned unit developments subject to the provisions of chapter 13 of this title.
Signs when located on the same lot pertaining to the use of that particular building or buildings; provided, that they will not overhang any public right of way, shall not be illuminated, and shall not exceed twelve (12) square feet in area. 10-7-4: BUILDING HEIGHT:

Building height shall not exceed ten (10) stories or one hundred twenty feet (120'). (Ord. 567, 11-1976)

10-7-5: LOT REQUIREMENTS:

   (A)   Minimum Lot Area: No multiple dwelling structure shall be erected on a lot or parcel of land which has an area of less than six thousand (6,000) square feet or has a width of less than sixty feet (60'). The required lot area per dwelling unit shall be computed as follows:
      1.   Efficiency unit, eight hundred fifty (850) square feet.
      2.   One bedroom unit, one thousand (1,000) square feet.
      3.   Two (2) bedroom unit, one thousand two hundred (1,200) square feet.
      4.   Each additional bedroom, three hundred (300) square feet.
Provided, however, that if more than fifty percent (50%) of the units in any structure are efficiency units, those efficiency units which are in excess of fifty percent (50%) shall conform to the lot area requirements for one bedroom units.
   (B)   Minimum Width Of Lot: Fifty feet (50').
   (C)   Minimum Floor Space Per Dwelling Unit: Where multiple dwellings are permitted in an R-4 district, the required floor space per unit shall be as follows:
      1.   Efficiency unit, three hundred (300) square feet.
      2.   One bedroom unit, five hundred (500) square feet.
      3.   Two (2) bedroom unit, six hundred fifty (650) square feet.
      4.   Three (3) bedroom unit, eight hundred (800) square feet.
Plus one hundred fifty (150) square feet for each bedroom in excess of three (3) bedrooms in a dwelling unit. (Ord. 567, 11-1976)

10-7-6: LOT COVERAGE:

Maximum coverage of the principal structure shall not exceed forty percent (40%) of the lot. (Ord. 567, 11-1976)

10-7-7: YARD REQUIREMENTS:

   (A)   Front yard: Twenty five feet (25').
   (B)   Side yard: Same as R-3 district. (Ord. 567, 11-1976)
   (C)   Rear yard: Twenty five feet (25') when rear yard abuts any public alley, street or thoroughfare; also when rear yard contains or is abutting property which contains easements for utilities, whether they be for underground or overhead. When the rear yard abuts the side yard of adjacent property then the required side yard setback for that adjacent property shall be the setback for the rear yard when utilities are present along the property line. When the rear yard contains no easements for utilities nor does not abut property containing easements abutting subject property, then the minimum rear yard setback shall be equal to the combined side yard required for that lot.
